As evidenced by the technical assistance and research carried out by PGA on the basis of the existing literature and jurisprudence concerning other countries with internal armed conflicts prior to the ratification of the Statute, allow us to stress that the absolute principle of non-retroactivity of the Rome Statute affects neither positively nor negatively the sovereign decision(s) that El Salvador may undertake to remedy past wrongs.

The people of El Salvador have recently suffered a tragic story. The ratification by El Salvador will help to consolidate a multiparty platform in support of the principle of "never again,” a vital legacy of your Presidential term and a promise to future generations.

We would like to reiterate the offer of full support, both technical and political, with respect to the possible transmission of the Rome Statute to the Legislative Assembly for ratification, which will enable El Salvador to become the next State Party to the Rome Statute.

Somos conscientes de la existencia de un debate nacional sobre la percepción errónea de que la CPI pueda tener jurisdicción sobre los crímenes del pasado, o que pueda tener una influencia en las decisiones nacionales relativas a la responsabilidad de los presuntos responsables de las atrocidades que ocurrieron en El Salvador. Como lo demuestra la asistencia técnica y la investigación llevada a cabo por PGA sobre la base de la literatura y de la jurisprudencia en relación a muchos de nuestros países, países con conflictos armados internos antes de la ratificación del Estatuto, permítanos subrayar que el principio absoluto de la no retroactividad del Estatuto de Roma no afecta ni positiva ni negativamente la(s) decisión(es) soberana(s) que El Salvador pueda emprender para remediar los errores del pasado.

El pueblo de El Salvador ha sufrido recientemente una trágica historia. La ratificación de El Salvador contribuirá a consolidar en una plataforma pluripartidista en apoyo al principio de “nunca más” un vital legado de su mandato Presidencial y una promesa para las generaciones futuras.

Nos gustaría reiterar la oferta de apoyarlo plenamente, tanto técnica como políticamente, con respecto a la posible transmisión del Estatuto de Roma a la Asamblea Legislativa para su ratificación, lo que permitirá a El Salvador convertirse en el próximo Estado Parte en el Estatuto de Roma.
