Legalbrief | your legal news hub Thursday 23 September 2021 Media storm over Malema's tender excesses A picture of unrestrained excess and cronyism is painted in three Sunday newspaper reports claiming ANC Youth League president Julius Malema's millionaire lifestyle is being bank-rolled by lucrative government contracts awarded to his companies, writes Legalbrief. The Sunday Times, City Press and Rapport all allege Malema has benefited substantially from several tenders - and that most of them stem from his home province Limpopo, where he wields significant influence. According to the Sunday Times, official tender and government documents show Malema was involved in more than 20 contracts, each worth between R500 000 and R39m between 2007 and 2008. One of Malema's businesses, SGL Engineering Projects, has profited from more than R130m worth of tenders in just two years. Among the tenders awarded to SGL, notes the report, was one by Roads Agency Limpopo, which has a budget of over R2bn, and which is headed by Sello Rasethaba, a close friend of Malema. Rasethaba was appointed last year shortly after Malema's ally, Limpopo Premier Cassel Mathale, took office. Spokesperson Brian Sokutu said: 'Comrade Malema is neither a member of Parliament or a Cabinet Minister and he has therefore not breached any law or code of ethics by being involved in business.' ID leader Patricia De Lille said Malema should stop pretending to represent the poor when he was living in opulence earned from the poor and ordinary taxpayers in a society plagued by the worst inequalities in the world. -

South Africa Political Snapshot New ANC President Ramaphosa’s mixed hand holds promise for South Africa’s future South Africa’s ruling party, the African National Congress, yesterday (20 December) concluded its 54th National Conference at which it elected a new leadership. South African Deputy President Cyril Ramaphosa was announced the ANC’s new leader against a backdrop of fast-deteriorating investor confidence in the country. The new team will likely direct the ANC’s leadership of the country for the next five years and beyond. Mr Ramaphosa’s victory is not complete. The election results have been the closest they have been of any ANC leadership election in recent times. The results for the top six leaders of the ANC (Deputy President, National Chairperson, Secretary-General, Treasurer-General and Deputy Secretary-General) and the 80-member National Executive Committee (NEC - the highest decision-making body of the party between conferences) also represent a near 50-50 composition of the two main factions of the ANC. Jacob Zuma, Mr Ramaphosa’s predecessor, still retains the presidency of South Africa’s government (the next general election is still 18 months away). It enables Mr Zuma to state positions difficult for the new ANC leadership to find clawback on, and to leverage whatever is left of his expanded patronage network where it remains in place. A pointed reminder of this was delivered on the morning the ANC National Conference commenced, when President Zuma committed the government to provide free tertiary education for students from homes with combined incomes of below R600 000 – an commitment termed unaffordable by an expansive judicial investigation, designed to delay his removal from office and to paint him as a victim in the event it may be attempted. -

CLAREMONT MCKENNA COLLEGE AN ANALYSIS OF EDUCATION REFORM IN SUB-SAHARAN AFRICA SUBMITTED TO PROFESSOR WILLIAM ASCHER AND DEAN PETER UVIN WRITTEN BY KATHARINE MIRANDA EGER FOR SENIOR THESIS SPRING APRIL 25, 2016 Abstract Sub-Saharan Africa continues to fall behind other developing regions regarding educational attainment, despite recent progress in enrollment. This thesis examines a variety of external conditional factors that could contribute to a country’s relative success, in terms of years spent in school using a prediction model that compares years enrolled in secondary education as a foundation to determine over- and under-performing countries in sub-Saharan Africa. By exploring various educational policies, historical patterns, and projects executed in Rwanda, South Africa, Ghana, and Botswana, this thesis sheds light on four main challenges that can impact educational attainment: ethnic and racial tensions, an acute shortage of learning materials and trained teachers, inappropriate curricula, and high costs of education. Some of these challenges have been met with an array of policies, with mixed results in terms of the soundness and fairness of policies as well as the effectiveness of implementation. -

MEDIA RELEASE PSA calls for decisive actions by newly-appointed Ministers DATE 31 May 2019 EMBARGO None ENQUIRIES [email protected] The Public Servants Association (PSA) welcomes the appointments of Cabinet Ministers by President Cyril Ramaphosa, sworn in at the Union Buildings on 30 May 2019. The non-politically affiliated Union, representing over 240 000 public-sector workers, is looking forward to progressive engagements with the leadership for a better Public Service. The Union, however, raised concerns about the operations of several key departments and indicated that it will engage with the relevant Ministers. The Department of Public Service and Administration is key to the well-being of the Public Service. The relationship between labour and the Ministry was starting to take positive form and with the appointment of Mr Senzo Mchunu as the new Minister, the PSA is looking forwards to building on the progress. The PSA is the majority Union at the Department of Home Affairs, another key department in service delivery. The PSA has experienced a hostile approach from the Department’s leadership in the past, which led to cases being heard in the Constitutional Court where the PSA was victorious in advancing workers’ rights. The PSA will be engaging with the new Minister, Dr Aaron Motsoaledi, to address outstanding matters. Health and safety continue to be a major issue in many government buildings with many not meeting the requirements of Occupational Health and Safety Act and posing danger to employees and the public. The PSA is an advocate for safe working conditions and unfortunately the employer has not been forthcoming in resolving the issues, regardless of judgements that found it guilty of not following procedure.
