Minute of Ordinary Meeting of the Council on Monday 11th November 2019

The meeting started at: 7.30pm, CCllr D Brown in the Chair. Agenda Item Narrative 2. Declaration of None interest 3. Approval Of The minute of the meeting held in Ollaberry Primary School on Previous Minute Monday 14th October 2019 approved: CCllr K Williamson, seconded: CCllr D Robertson. 4. Police report PC Jamie Henderson informed members that Police Scotland have started their Winter Safety Campaign which will run until January. They will be doing speed checks and vehicle checks. He also stated they would be focusing on ensuring young people knew how to drive in wintry conditions.

5. Matters arising Previous visit from Capt Maitland – SIC Ports & Harbours. Nothing further. It was agreed that members will continue to monitor infrastructure at the pier.

Broadband An e-mail has been received from D Lamont at BT regarding the 4g EE mast at North Roe. Mr Lamont planned to travel up to w/c 18/10 to meet with the crofter with a view to resolving the last point, allowing the overall site legals to be signed off and access obtained, with site becoming live soon thereafter. Action – Clerk to contact Mr Lamont for update

ASCC CCllr D Brown attended the meeting on 17th September, which he found very worthwhile. CCllr D Brown found the meeting to be informative and said it gave an insight into issues, like Viking Energy, transport, etc. Eleven Community Councils represented at the meeting, with a broad range of different views. CCllr D Brown would like to maintain membership and always try to have someone attending future meetings.

Collafirth Hill Road An Email was received from N Hutcheson, SIC Roads, stating that the Collafirth Hill Road was originally a MoD road and is now used by Arqiva, HM Coastguard and the BBC to access the transmitter. It is not a public road so the Council would have no responsibility for its maintenance. However, they have recently been installing warning signs on MoD roads in etc. to inform drivers that the roads are suitable for “off-road” vehicles only. Mr Hutcheson has issued a works order to their contractor for the provision of a sign at the junction of the Collafirth Hill road.

Clerk contacted MOD, providing photos of Collafirth Hill road. A letter received back from MOD stated Arqiva would look at the disrepair aspect with a view to carrying out remedial work next year – probably around Easter. In the mean time, they decided speed limit warning signs (10mph) would be put in place along the bottom stretch, also to warn of the poor road surface.

Parking at Hillswick – West Ayre/Fire station area The clerk had previously e-mailed SIC Roads re white lines and new signage to discourage parking on the corner near the entrance to the West Ayre – nothing further. Action – clerk to contact SIC Roads to chase response

Planning Application: 2019/232/LBC and 2019/231/PPF. Hillswick Wildlife Sanctuary Hillswick Shetland ZE2 9RW. Proposal; Install sea water pump system; construct a visitor centre and pumphouse building and construct a respite building for otters with a small viewing area; construct 6 no. animal enclosures with pools and undertake internal alterations to existing seal unit and external alterations to outdoor seal pools. NCC members discussed application with Pete and Jan Bevington following response to questions raised by NCC. After discussion, members agreed NCC had no objections to the application. Action – Clerk to send comments to SIC Development

Hillswick Public Toilets Following a discussion, Pete and Jan Bevington informed NCC they have been looking after the public toilets voluntarily so the SIC didn’t close them. However, the toilets are not up to standard and would

benefit from improved/disabled access. Members agreed to send a letter to SIC noting their support for the improvements to be made. Action – Clerk

Planning Appeal PPA-360-2009 Temporary Residential Accommodation, Sellaness, Graven Clerk submitted apologies for site visit on 17th October. No further update.

Planning Application 2019/234/CLUP. Redevelop storage shed Lang Ayre Urafirth Hillswick Shetland ZE2 9RH SIC Planning refused application. The applicant will submit a revised plan.

Members agreed this item could be removed from next minute.

Local Review Ref: 2019/094/PPF – LR35: Precast concrete steps and Kee-Klamp handrail on both sides (Retrospective application), Eshaness, Shetland, ZE2 9RS A response was sent to development management noting that members agreed the current steps were already suffering from erosion at the top, steps were not flush and water was ponding at the bottom of the steps. Members agreed a natural slope would be preferable to steps. NCC are keen to promote tourism but would be looking for a more sustainable solution. The date for planning appeal is set for 16th December.

Urafirth School Parking Urafirth Parent Council wrote a letter of concern to NCC regarding parking issues at Urafirth School. A letter and photos was also received from school pupils. Urafirth School Parent Council contacted SIC Roads and Education Services but had not received a response.

Proposed tourist viewpoint at Zoar An email was sent to M Sandison – SIC Chief Executive, noting that NCC thought a view point in Eshaness would make good use of Crown Estate funds. A response from Mrs Sandison said she had spoken to SIC Roads who highlighted that the situation described was not limited to this area. There was a number of locations across Shetland where tour/ tourist coaches were parking in passing places to allow their passengers to view the scenery or visit points of interest which was inevitably going to be increasing as the tourist Industry develops. Rather than addressing a single issue, the SIC are looking to develop a strategy to improve areas across Shetland and see whether there is funding through the Infrastructure fund. Mrs Sandison will ensure NCC are kept informed as they develop the strategy.

Planning Application 2016/228/MIN - Sullom Quarry, proposed extension of quarry void A response was sent to SIC development management noting that NCC members agreed that the road was sufficient for the volume of traffic.

Members agreed this item could be removed from the next minute.

Parking at Kirkyard, Eshaness A response was received from Mr K Mckenzie regarding access to the Kirkyard. The area in front of the gate had been scraped and new hard core added in October. His department will monitor the turning area in the future, but have no plans to upgrade as yet, unless it is deemed to be detrimental to the safety of the visiting public.

Agenda Items 6. Review of Electoral Arrangements: Shetland Islands council area – public consultation. CCllr D Brown informed members that for Shetland North this meant reduction of elected members from 3 to 2.Boundary changes are proposed, with Voe being a new area comprising , Skerries, Nesting and Vidlin. CCllr D Brown stated this would make Shetland North the least represented area in Shetland, with each councillor expected to look after 880 people (an increase of 10.2%)

Action – CCllr D Brown to send clerk comments to pass on for response to consultation. (closing date 2nd December)

7. Crown Estate Scotland Draft 2020-23 Corporate Plan consultation CCllr D Brown informed members that a substantial amount of money is paid into the Crown Estate through aquaculture and pipelines from Shetland. Aquaculture businesses in contributes a large percentage of these funds and he would like to see a proportional share of that money coming back into Northmavine where it came from. Action – CCllr D Brown to send letter to clerk for Crown Estate response. Closing date 25th November 2019.

8. Shetland Islands Regional Marine Plan 2019 Consultation This item will be discussed at the next meeting and members were encouraged to review the online information. The closing date 30th December 2019. Action – CCllr D Brown to send through comments as he can not attend the next meeting.

9. ‘Warmer Greener Homes for Shetland’ CAB request for letter of support Citizens Advice Bureau have requested a letter of support for continuation of funding for 2020-2022 for their ‘Warmer Greener Homes for Shetland’ project. CAB offer energy advice on a monthly basis at Hillswick Health Centre. Members agreed to add their support to the project. Action – Clerk to submit letter of support to CAB

10. Review local grant applications Member reviewed the grant applications and awarded funds to the following:

11. Works Licence Consultation - 2019/026/WL To install 2 no. 90mm-diameter seawater intake pipes to serve Hillswick Wildlife Sanctuary Members discussed the application and agreed that there were no objections. Action – clerk to respond to SIC

12. Correspondence Shetland Gas Plant Key stakeholder day on Tuesday 19th November

Action – Clerk to send apologies

Marine planning partnerships – Scottish Parliament Inquiry (17th/18th November). CCllr D Brown hopes to attend.

Developers Workshop – 21st November

13. AOCB Community Defibrillators ASCC is asking Community Councils to gather information on defibrillators in their area and find out who is responsible for their upkeep, (batteries/renewal).

Action – CCllr D Robertson to look out defibrillator map and pass on to clerk. 14. Date of next 9th December 2019 at 7.30pm in Ollaberry School meeting
