NOTICE.

IN VIRTUE of the powers vested in me by the Defence (Military Commanders) Regulations, 1938, I, PHILIP NEAME, on whom His Majesty has conferred the Vic• toria Cross, Companion of the Most Honourable Order of the Bath, Companion of the Distinguished Service Order, Lieutenant-General Commanding the Forces in Palestine and Trans-Jordan, with the consent of the High Commissioner, do hereby appoint BRIGADIER HORACE CLEMENT HUGH ROBERTSON, Companion of the Dis• tinguished Service Order, to be Military Commander of the Area or Place known as the Gaza District, with effect from the twenty-eighth day of August, 1940, and until further notice, vice MAJOR-GENERAL IVAN GIFFARD MACKAY, Companion of the Order of St. Michael and St. George, Companion of the Distinguished Service Order, on whom his Majesty has conferred the Volunteer Decoration.

DEFENCE REGULATIONS, 1939.

ORDER MADE BY A COMPETENT AUTHORITY UNDER REGULATION 46 OF THE DEFENCE REGULATIONS, 1939.

I, CHRISTOPHER WILSON BROWN, Director of Public Works, being a Competent Authority appointed by the High Commissioner for the purpose of regulation 46 of the Defence Regulations, 1939, hereby order that no person who, at the time

— 1167 — — 1168 — when this Order takes effect, has in his possession or under his control at any pre• mises in Palestine any of the articles or materials set forth in the Schedule to this Order shall sell or otherwise dispose of the ownership in or remove such articles or materials or cause or permit them to be removed from the said premises until the sale or disposal or removal of such articles or materials is authorised by me.

And I do further hereby order that any person who, at the time when this Order comes into effect, has in his possession or under his control at any premises in Palestine any of the articles or materials set forth in the Schedule to this Order shall, within five days from the time when this Order comes into effect, send to me at the Public Works Department Headquarters, P.O.B. 585, Jerusalem, a written declaration stating the number or quantity of such articles or materials aforesaid which are in his possession or under his control.

This Order shall come into effect on the 5th September, 1940.

CURFEW ORDER.

IN VIRTUE of the powers vested in me by regulation 10 of the Emergency Regu• lations, 1936, I, LIEUT.-COL. C.H. GAISFORD ST. LAWRENCE, Military Commander of the Lydda District, hereby declare that all persons within the Local Council area of Herzliya shall remain within doors between the hours 9 a.m. on the 18th August, 1940, and 6 a.m. on the 19th August, 1940.

And I hereby give notice that any person found in the said area without a permit from me, or some other duly authorised person, will render himself liable for an offence under the above-mentioned regulations.

PALESTINIAN CITIZENSHIP ORDER, 1925.

REVOCATION OF CERTIFICATE OF NATURALIZATION.

IT IS HEREBY NOTIFIED that, in exercise of the powers vested in him by Article 10(1) of the Palestinian Citizenship Order, 1925, and with the approval of the Sec• retary of State, the High Commissioner has revoked, with effect from the twenty- eighth day of August, 1940, the certificate of naturalization granted to MR. JACOB YUDKEVITCH, on the ground that he has been for a period of not less than three years since its grant ordinarily resident out of Palestine.

AND IT IS FURTHER NOTIFIED that, in exercise of the powers vested in him by Article 11(1) of the said Order, the High Commissioner has ordered that FRIDA YUDKEVITCH, née WEIGENBAUM, wife of the said JACOB YUDKEVITCH, and their minor son CHAIM, shall cease to be Palestinian citizens from the twenty-eighth day of August, 1940, subject to FRIDA YUDKEVITCH, née WEIGENBAUM, not being a Pales• tinian citizen under Article 1 or Article 6 of the Palestinian Citizenship Orders, ' 1925-1931.

NOTICE.

NOTICE IS HEREBY GIVEN that whereas MRS. TANA VINOKUR, maiden name GINC- BURGS, while in a foreign state and not under disability has by a voluntary and formal act acquired Latvian nationality, the said MRS. TANA VINOKUR ceased as from the date of such naturalization to be a Palestinian citizen in accordance with Article 15 of the Palestinian Citizenship Order, 1925.

NOTICE OF PROVISIONALLY APPROVED SCHEME, JERUSALEM DISTRICT.

NOTICE IS HEREBY GIVEN in accordance with section 16(1) of the Town Planning Ordinance, 1936, that the town planning scheme within the Town Planning Area of Jerusalem, known as Scheme No. 3A—Katamon (Amended and Consolidated) De• tailed Town Planning Scheme, in a revised form, has been provisionally approved by the Jerusalem District Building and Town Planning Commission and deposited to• gether with the relative plans at the Municipal Offices, Jerusalem, where they may be inspected by any person interested between the hours of 8 and 10 a.m. daily.

NOTICE OF FINAL APPROVAL OF A PARCELLATION SCHEME, JERUSALEM DISTRICT.

WHEREAS a parcellation scheme within the Town Planning Area of Jerusalem, known as Scheme No. RJ/1—of D. ORDER, NO. 112 OF 1940, BY THE HIGH COMMISSIONER.

IN EXERCISE of the powers vested in him by section 34 of the Land (Settlement of Title) Ordinance, the High Commissioner has ordered that within the boundaries of the village of Qaryat el Tnab (Abu Gosh) in the Settlement Area of the Jeru• salem Sub-District, no registration of land in respect of any claimant shall be effected where the area or the breadth of a parcel or the area represented by the share of an undivided parcel or of village masha' claimed by any one claimant is less than the following minima : MINIMA.

4. (i) A fragment of land which under the terms of this Order may not be re• gistered, shall be added to the land of an adjoining owner who shall pay to the owner of the fragment compensation which shall be assessed by the Settle• ment Officer. (ii) A share which under the terms of this Order may not be registered, shall be added to the share of a co-owner in the same parcel who shall pay to the owner of the share compensation which shall be assessed by the Settlement Officer.

In default of payment or of other mutually satisfactory arrangements by the parties concerned the Settlement Officer shall enter the amount of compensation or the unpaid portion thereof on the Schedule of Rights or the Schedule of Parti• tion as a charge against the land in favour of any person or persons to whom any such compensation may be due. (hi) Where there are two or more adjoining owners, or two or more additional co-owners the addition of the fragment or of the share shall be effected by the Settlement Officer in one of the following ways : (a) Where only one of the adjoining owners or co-owners desires the trans• fer to him of the fragment or of the share, it shall be added to his parcel or share; (b) Where more than one of the adjoining owners or co-owners desire the transfer to them of the fragment or share, it shall be added to the parcel or share of such adjoining owner or co-owner as may be decided by lot; (c) Where none of the adjoining owners or co-owners desires the transfer of the fragment or share, it shall be added to the parcel or share of such ad• joining owner or co-owner as the Settlement Officer may direct : — 1175 —

Provided that no fragment or share shall be added to any parcel or share unless the parcel or share resulting from such addition is capable of registration under the terms of this Order. (iv) (a) Where two or more adjacent fragments of land are incapable of registra• tion under this Order, the Settlement Officer may combine a sufficient number of fragments to form a parcel which is capable of registration under the terms hereof. (b) Where two or more shares are incapable of registration under this Order, the Settlement Officer may combine a sufficient number of shares to form a share the total area represented by which would enable registration of the combined share. IN EXERCISE of the powers vested in him by section 34 of the Land (Settlement of Title) Ordinance, the High Commissioner has ordered that within the boundaries of the villages of Jabaliya and En Nazla in the Settlement Area of the Gaza Sub- District, no registration of land in respect of any claimant shall be effected where the area or the breadth of a parcel or the area represented by the share of an un• divided parcel or of village masha' claimed by any one claimant is less than the following minima :— — 1181 —

The site on which a building is erected or which is reserved for a building. Private or party roads. The yard appurtenant to a house. Land containing, and appurtenant to, a well. Private streams and irrigation channels. Private threshing-floors. Private quarries.

3. Where the breadth of a parcel is less, but the area is not less than any of the prescribed minima, the Settlement Officer may at his discretion order the adjustment ôf a parcel or parcels within the boundaries of an adjoining parcel or parcels by the exchange of land of equal value.

, 4. (i) A fragment of land which under the terms of this Order may not be re• gistered, shall be added to the land of an adjoining owner who shall pay to the owner of the fragment compensation which shall be assessed by the Settle• ment Officer. I

(ii) A share which under the terms of this Order may not be registered, shall be added to the share of a co-owner in the same parcel who shall pay to the owner of the share compensation which shall be assessed by the Settlement Officer. In default of payment or of other mutually satisfactory arrangements by the parties concerned the Settlement Officer shall enter the amount of compensation — 1182 —

or the unpaid portion thereof on the Schedule of Rights or the Schedule of Parti• tion as a charge against the land in favour of any person or persons to whom any such compensation may be due. (iii) Where there are two or more adjoining owners, or two or more additional co-owners the addition of the fragment or of the share shall be effected by the Settlement Officer in one of the following ways : (a) Where only one of the adjoining owners or co-owners desires the trans• fer to him of the fragment or of the share, it shall be added to his parcel or share; (b) Where more than one of the adjoining owners or co-owners desire the transfer to them of the fragment or share, it shall be added to the parcel or share of such adjoining owmer or co-owner as may be decided by lot; '•(c) Where none of the adjoining owners or co-owners desires the transfer of the fragment or share, it shall be added to the parcel or share of such ad• joining owner or co-owner as the Settlement Officer may direct : Provided that no fragment or share shall be added to any parcel or share unless the parcel or share resulting from such addition is capable of registration under the terms of this Order. (iv) (a) Where two or more adjacent fragments of land are incapable of registra• tion under this Order, the Settlement Officer may combine a sufficient number of fragments to form a parcel which is capable of registration under the terms hereof. (b) Where two or more shares are incapable of registration under this Order, the Settlement Officer may combine a sufficient number of shares to form a share the total area represented by which would enable registration of the combined share. The person in whose name the parcel or share resulting from such addition shall be registered, shall be decided by the Settlement Officer in one of the following . ways : (i) Where only one of the owners of the fragments or only one of the co- owners desires the combined parcel or share resulting from such addition, it shall be registered in his name; (ii) Where more than one of the owners of the fragments or more than one of the co-owners desire the combined parcel or share resulting from such addi• tion, it shall be registered in the name of such owner or co-owner as may be decided by lot; (iii) Where none of the owners of the fragments or none of the co-owners desires the combined parcel or share resulting from such addition, it shall be regist• ered in the name of such one of the owners or co-owners as the Settlement Officer may direct.

CUSTOMS ORDINANCE.

RULES MADE BY THE HIGH COMMISSIONER UNDER SECTION 230.

IN EXERCISE of the powers vested in him by section 230 ol the ­Customs Ordinance, the High Commssioner has made the follow •׳*'Cal'• 2 ing rules :— Citation. 1. These rules may be cited as the Textile Manufactures Im­ portation (Dyeing and Printing) Rules, 1940. Interpretation. 2. Ill these rules : — "goods" means any tissues made from one or more of the fol­ lowing materials :— silk, artificial silk, cotton, wool or linen. — 1187 —

"process" means the process of dyeing' and/or printing.

"trader" means the person or firm to whom or to which any goods are consigned for the purpose of the carrying out of the process thereon with a view to subsequent exportation.

3. Subject to the conditions laid down in these rules, goods im• Importation ported for the purpose of dyeing and/or printing in Palestine may of goods free of duty for be admitted free of duty, provided that such goods are exported to process. the country whence consigned within six months from the date of importation.

4. —(1) The goods shall be consigned to the trader. Mode of entry.

(2) The entry shall be made in the name of the trader and the import entry form shall contain the following particulars :— (a) full description, net weight and metreage of the goods; and (6) full postal address of the trader's premises; and (c) a statement to the effect that the goods are imported solely for the purpose of dyeing and/or printing and that they will be exported after the completion of such process.

5. The trader shall give a general bond, with such security and Bond. in such amount and under such conditions as the Director of Customs may require, for the due observance of the obligations under these rides. 6. The goods will be stamped or otherwise marked by a customs Procedure on officer at the place of importation : import duty shall be paid on importation. such goods should any such mark be in any way altered, obliterated or deleted.

7. —(1) On receipt by the trader of any consignment of goods for Procedure the purpose of the carrying out of the process thereon, he shall give on trader's premises. the consignment a stock number which shall be adhered to through• out the process until the goods are exported. (2) The trader shall keep a stock account showing particulars of goods so imported and particulars of their subsequent exportation. (3) The trader shall on demand allow any officer of Customs to examine his accounts and records and shall provide such assistance as may be necessar}? to enable the officer to trace the receipt and disposal of any consignment.

8. When goods on which by virtue of these rules import duty Procedure on has not been paid are to be exported, the trader shall comply with exportation. the following provisions :— (a) the goods shall be entered on Form No. C. 339 which shall be retitled "Goods exported after process" and the claim to drawback appearing therein shall be deleted; and — 1188 —

(6) a declaration shall be signed on the export entry form to the effect that the goods are identical with those imported except as regards the process; and (c) each package entered for export shall bear a card on which shall be printed or written in bold characters the" words "Under bond. To be produced to the Chief Examination Officer at the " (the name of the customs house being given); and the goods shall be produced to the customs officer at the (•/־>•) place of exportation and the trader shall provide such assist­ ance as the customs officer may require for the purpose of examining and identifying the goods.

Duty on goods 9. Import duty shall be paid on all goods admitted free of duty not exported under these rules, if such goods are not exported to the country within certain whence consigned within six months from the date of importation, period. or such further time as the Director of Customs may allow.

Revocation. 10. The Silk Tissue Importation (Dyeing and Printing) Rules, 1936, are hereby revoked.
