SUBJECT: District-Wide Savings on Procurement Activities – Fiscal Years 2019 & 2020 Strategic Priority – Strong District Finances/Student and Staff Well-Being

PURPOSE

To provide the Board of Education an annual report regarding the key functions and efficiencies in the Purchasing Department. The Purchasing Department provides buying and contracting services in support of all District schools and departments. In addition, the Purchasing Department coordinates the sale and disposal of District surplus property. This memo will demonstrate the value of the services provided by the Purchasing Department through established key performance measures—including procurement cost savings data, vendor participation, solicitation process lead time, and surplus property sale proceeds and disposal process.

BACKGROUND

Procurement Cost Savings: The attached cost savings reports summarize detailed competitive bid activity completed by the procurement staff in FY19 and FY20. The FY19 spreadsheet details total purchases and contracts of $6,565,021 reflecting total cost savings of $1,021,439. The FY20 spreadsheet details total purchases and contracts of $5,561,440 reflecting total cost savings of $752,509. This is a 16% savings rate over all purchases during FY19 and a 14% savings rate over all purchases during FY20. Cost savings are calculated as the difference between the total amount of the awarded contract and the average cost of all submitted bid proposals. The report is not inflated and is a clear representation of the savings generated through the efforts of the purchasing staff.

The purchasing staff facilitated 89 formal invitations to bid (ITB) and requests for proposal (RFP) solicitations to select qualified contractors in FY19 and facilitated 75 solicitations in FY20. Procurement secures the integrity of the process and ensures that all interested suppliers are treated fairly and encouraged to compete as evidenced by the number of participating vendors submitting a response to each individual solicitation. During FY19 the average turn-around time was 25 days from release date of a solicitation to submission deadline date. Due to the pandemic, the Purchasing Department transitioned to full electronic submission of bids and RFPs. This change significantly improved turn- around time, averaging 14-18 days from release date to submission deadline date in FY20. 24 solicitations were successfully completed during this time working remotely and through virtual processes.

Processes Where No Cost Savings Reported: Procurement staff review and process all District purchase orders. The vast majority of the purchase orders are not subject to bidding requirements and have no savings reported. Purchases made under educational pricing contracts or with p-cards, state bid awards, and cooperative procurement agreements are not reported as cost savings when these agreements can be accessed without the direct involvement of procurement staff.

The reports do not reflect cost savings from service and term contract solicitations completed by the procurement staff. The District’s objectives for establishing these contracts are to reduce costs by eliminating repetitive bidding requirements for each project that leads to improved flow of information between the contractor and our District.

Contracts include establishing professional auditing services, parent teacher conferencing solution, WAN and support, pre-qualified furniture providers, District website/content management, specialized education services, prequalifying general contractors and electrical contractors, janitorial cleaning services, data management platform, District/school mass communication tool, dental, vision and EAP insurance providers, and surplus technology buyback providers.

Surplus Property Sales/Disposal: It is the responsibility of the Purchasing Department to oversee the declaration and disposal of District surplus equipment, furniture, and materials—including textbooks and technology items. The disposal of District surplus is fundamentally an issue of demonstrating proper stewardship of public resources in accordance with District policies and ethical standards. Items no longer needed in the system are sold through online auction or offered without cost to charitable and civic organizations per Board policy. Contracts were established with pre-qualified surplus technology buyback providers to streamline technology surplus disposal and increase revenue. Sale proceeds are used to supplement capital project funds.

The following provides a summary of the proceeds from the sales of surplus assets received from July 2019 through June 2020.

To further confirm the District is utilizing best resources, the Purchasing Department strives to improve internal processes by streamlining both our performance as well as the services we provide. We are refining our annual report by continually researching best practices, establishing key performance measures, and enhancing customer satisfaction. We are always open to discuss topics and learn of opportunities of how we can improve processes that successfully impact the organization.

The summary below reflects historical results over a seven-year period of the cost savings generated versus the Purchasing Department total cost (regular as well as temporary salaries, benefits, and department budget) from our annual reports to the Board:

Our department will continue to track key performance measures to ensure we are, at a minimum, a cost-effective use of District resources. The bottom line is the Purchasing Department is a value-added service that makes every effort to receive optimum value for the dollars spent through sound Board-approved procurement policies and procedures.

RECOMMENDATION

For the Board of Education to adopt revisions to Board Policies JII – Student Concerns, Complaints, and Grievances and LBD* – Relations with District Charter Schools.

BACKGROUND

These Board policies have revisions to reflect changes to current laws, rules, and regulations of Colorado legislation, the U.S. Department of Education, and the Colorado Department of Education. These revisions are recommended by the Colorado Association of School Boards, administration, and District legal counsel.

Board Policy BG – School Board Policy Process states, “Policy revision shall be accomplished in the same manner as policy adoption, except that revisions mandated by changes in law shall not require a second reading and may be adopted upon majority vote of the Board.” File: JII

Student Concerns, Complaints, and Grievances

Decisions made by school personnel which students believe are in violation of pertinent Board policies or individual school rules may be appealed to the principal or a designated representative or by following the specific appeal process created for particular complaints.

Grievance and investigation procedures (AC-R) are available for students to receive prompt and equitable resolution of allegations of discriminatory actions on the basis of disability, race, color, national origin, ancestry, creed, color, sex, sexual orientation (which includes transgender status), marital status, national origin, religion, disabilityancestry, or need for special education services, which students are encouraged to report or other protected class.

Complaints must be initiated in writing, dated and signed by the complainant. Forms for this purpose are available in the principals’ offices. Completed forms must be filed with the appropriate persons as follows:

1. Conduct of an individual: immediate supervisor of the individual. The building principal is the supervisor of the teachers and support staff; the appropriate area assistant superintendent is the supervisor of the principal.

2. Departmental procedures: Building principal.

3. Building procedures: Building principal.

4. Board policies and regulations: Building principal.

5. Curricular programs: Building principal.

6. Unlawful discrimination: see Policies AC, JB, and JBB.

7. All others: Building principal.

When a complaint is filed in writing, a conference will be held with the complainant within five school days. A written response will be given to the complainant within 10 school days following the conference.

If the complaint is not resolved to the satisfaction of the student, a written appeal may be submitted within 10 school days in accordance with the appeal procedures.

Appeals must be made in the following order: building principal, area assistant superintendent, superintendent.

When an appeal has been filed in writing, a conference will be held with all parties involved within 10 school days. A written response will be given to the complainant within 10 school days following the conference.

Relations with District Charter Schools

A district charter school shall beis a public, nonsectarian, nonreligious, non-home-based school which operates within the school district and is accountable to the district’s Board of Education. It is subject to all federal and state laws and constitutional provisions prohibiting discrimination on the basis of disability, race, creed, color, sex, sexual orientation (which includes transgender status), genetic information, age, marital status, national origin, religion, ancestry, or age, genetic information, need for special education services, conditions related to pregnancy or childbirth, or other protected class and any court-ordered desegregation plan in effect for the district. A district charter school has standing to sue and be sued in its own name for the enforcement of any contract it is authorized by law to enter into.

Enrollment shall beis open to any child who resides within the school district or in contiguous school districts and who meets the criteria in the district charter school application. However, no district charter school shall beis required to make alterations in the structure of its facility or the arrangement or function of rooms within the facility except as may be required by state or federal law. The majority of the district charter school’s students must reside in the school district or in contiguous school districts. A district charter school shallwill not charge tuition except as otherwise provided by law.

Each district charter school shall beis governed by its own governing body in a manner agreed to by the district charter school applicant and the Board.

A district charter school shallmust comply with all the state financial and budget rules, regulations and financial reporting requirements with which the school district is required to comply.

To ensure that the district charter schools will fulfill their fundamental obligations to the public, including providing sound governance, management, and stewardship of public funds, as well as being held locally accountable for their performance, the governing body shall consist of local citizens being a majority of the membership on each district charter school’s board.

A district charter school shall beis responsible for its own operation including but not limited to preparation of a budget, personnel matters, contracting for services, and acquiring facilities. Services for which a district charter school contracts with the school district shallwill be negotiated and provided at district cost. No rent shallwill be charged for use of district facilities which may be available for the district charter school. Any moneys received by a district charter school from any source that remain at the end of any budget year shallwill remain in the district charter school account for use by the district charter school in subsequent years.

The relationship between the district and the district charter school shallwill be established by contract. The contract shallwill also reflect all agreements between the district and the district charter school including the release of the district charter school from Board of Education policies, negotiated agreement, and all requests for release from state regulations which the Board of Education and the district charter school shallwill jointly request from the State Board of Education.

Each district charter school shallwill have an educational program with student performance standards and curriculum that meets or exceeds district academic standards.

A district charter school may offer any educational program that is specifically approved in their contract. Additional educational programs, including an online program, must go through the district Board of Education and charter school contract approval process.

A district charter school shallwill begin operation in the fall following the date the application is approved, unless another starting time is agreed upon by the Board and the applicant.

The period for which a new district charter may be approved is a minimum of four academic years. Renewal of a district charter shallmust be for specified periods of time.

SUBJECT: Approval of Request to Grant an Exception to Board Policy GBEA – Staff Ethics/Conflict of Interest – Mary A. “Mollie” Kelleher Strategic Priority – Student and Staff Well-Being

RECOMMENDATION

That the Board of Education allow an exception to the current Board Policy GBEA— Staff Ethics/Conflict of Interest. This exception would enable Mollie Kelleher to provide copies of her children’s book Hadassah and the Honeybees to schools within the District.

BACKGROUND

Board Policy GBEA - Staff Ethics/Conflict of Interest, states, "No school district employee or firm owned by a school district employee shall be allowed to sell to the school district or its schools or staff goods or services of any kind without the express prior written consent of the Board of Education.”

Mollie Kelleher previously taught computer science at Altona Middle School and is currently employed as a licensed substitute teacher for the District. Due to her standing as a District employee, she is requesting a waiver from Board Policy GBEA, so that she can provide copies of her children’s book to the District.

The administration recommends approval of this exception, with services for the 2020- 2021 school year not to exceed $5,000. If her services should exceed $5,000, her exception will be brought back to the Board of Education for additional approval.

SUBJECT: Adoption of a Resolution Equalizing the Director District Population for 2020 Strategic Priority – High-Functioning School Board

RECOMMENDATION

That the Board of Education adopt a resolution approving the proposed director district boundaries to equalize the population, in compliance with Colorado Revised Statute 22- 31-109, 110.

BACKGROUND

Directors are elected to at-large seats by the School District electorate. However, each director represents a specific area of the St. Vrain Valley School District (SVVSD). State statute requires each director district be equal in population. This reapportionment is required every four years.

Director districts were last drawn in 2016. The proposed 2020 districts (attached) were drawn using criteria that sought to equalize the population and align with streets, township boundaries, and/or geographic features.

Planning staff attempted to balance the population of each district with as little variance as possible, generally keeping it within 1% while also keeping all Board members in their current districts.

METHODOLOGY

The School District’s Geographic Information System (GIS) was utilized with data obtained from county, state, and municipal governments, as well as from the U.S. Census Bureau. Care was taken to make the process as consistent as possible across the whole District.

The average population in each district in 2016 was 23,445. That average has increased to 26,131 in 2020. Overall, the District’s population has increased from 164,118 in 2016 to an estimated population of 182,920, today (+18.802). Population estimates are structured around the following formula: Population Estimate = (dwelling units x Occupancy rate) x Average Household Size + Group homes

While growth was spread across the school district; director districts B, D, F & G saw the highest gains. In order to equalize the population in each of the districts, shifts were made in all districts with additional area added to A, C & E.

WHEREAS, Colorado Revised Statute Annotated 22-31-110 requires School Districts to review the population balance of their Director Districts every four years and, if discrepancies are found, to revise the boundaries to contain substantially the same number of persons; and WHEREAS, the current Director Districts established in 2016 have been found to have significant imbalances in population between them; and WHEREAS, the St Vrain Valley School District Board of Education has been presented with a plan that establishes new Director District Boundaries which are relatively compact with minimal variation in population among each of the districts. NOW, THEREFORE, BE IT RESOLVED, by the Board of Education that the School District approve the revised Director Districts shown in the attached maps and legal descriptions.

RECOMMENDATION

That the Board of Education adopt a boundary adjustment between Blue Mountain/Altona and Longmont Estates/Westview to help balance future development among District schools.

BACKGROUND

Board Policy acknowledges there may be situations where boundary adjustments are necessary due to the impact of large-scale developments proposed on or near boundary lines between schools.

The area bounded by Nelson Road, Hover Road, the St. Vrain River, and Airport Road had long been designated for primarily industrial and commercial with little impact to the neighborhood schools in the area. Over the past few years, comprehensive plan changes in the City of Longmont have shifted these areas to a future with a much greater potential for residential development. Because this area is entirely in the Blue Mountain/Altona area the student yield could burden the capacity of these schools. At the same time, Longmont Estates and Westview could benefit by some of this future growth potential included in their attendance area. The center of this development area is also in closer proximity to Longmont Estates than to Blue Mountain.

The placement of the future housing projects between Blue Mountain and Longmont Estates creates a boundary that does not impact any current residents and students. The proposed boundary is supported by the Transportation Department and by all administrators of the associated schools. The City of Longmont Planning staff has reviewed the plan and is also in support as it helps with balancing growth among school areas and therefore does not impact the City benchmark guidelines.

This entire area is within Silver Creek High attendance area and is scheduled to remain. Between the Longmont High feeder and the Silver Creek High area, housing is still weighted towards Longmont High. There is a total of 8,575 housing units within the Silver Creek High feeder and 10,493 housing units in the Longmont High feeder area. At build- out, both will be between 11,000 and 12,000 dwelling units.
