FISCAL COURT MEETING: Woodford County Courthouse, Tuesday, October 10, 2017 at 5:30 p.m.

PRESIDING: John “Bear” Coyle, Woodford County Judge/Executive

PRESENT: Magistrates Linda Popp, C.L. Watts, Gary Finnell, Ken Reed, Gerald Dotson, Duncan Gardiner, Mary Ann Gill, and Jackie Brown

APPROVAL OF MINUTES

Judge/Executive Coyle called for any additions, corrections, or amendments to the minutes of the Regular Fiscal Court Meeting of September 26, 2017. Hearing none, these minutes stood approved as presented.

REPORTS

Treasurer’s Report (Sabra Garmon) – Treasurer Garmon reported the financial status through today with the total cash amount of $3,793,212.79, less claims of $624,945.13, less a certificate of deposit of $400,000.00, leaving an adjusted money market checking account balance of $2,768,267.66.

Maintenance Superintendent, Rick Wade gave a progress update on the courthouse renovation project. Metal work around clock tower has been completed and the final coat of paint will be applied once weather permits. The weather vane needs repair and the cost for that repair will come out of the contingency fund. The scaffolding is scheduled to come down on the 23rd. The project is still on target to be completed hopefully no later than the 2nd week of November.

County Road Engineer, Buan Smith reported that the demolition of the Griers Creek Bridge has begun. There are a few pieces of the bridge that can be kept for future projects, but Mr. Smith would like to declare the rest surplus and sell to the scrap yard.

1. A motion was made by Jackie Brown and seconded by Mary Ann Gill to allow County Road Engineer Buan Smith to surplus the pieces from the Griers Creek Bridge and sell them as scrap.

Mr. Smith also submitted a request from the court to consider the discontinuation of 180 feet of right of way easement at the end of Shryocks Ferry Road. After some discussion, it was decided to have the Road Committee meet regarding the potential closure and report back to the court as to how to proceed.

Emergency Management Director, Drew Chandler informed the court that the LEPC meeting scheduled for Thursday has been cancelled. Also, Director Chandler would like to adopt into the county fleet a 2005 Ford Explorer that was declared surplus and removed from the city fleet. Once that vehicle has been properly inspected and made road worthy, he would like to surplus a 1998 Jeep Cherokee from the county fleet.

2. A motion was made by Ken Reed and seconded by Gary Finnell to adopt a 2005 Ford Explorer into the county fleet and surplus a 1998 Jeep Cherokee from the county fleet.

Director Chandler also requested to surplus a list of items from the Emergency Management Department.

Jouett House Director, Jill Roseberry informed the court that Frontier Days was a success with 365 students attending. Also, the last event at the Jouett House is scheduled for Saturday, October 21 st at 2:00 and is the “Bringing a Cemetery to Life” program. Participants will learn about and assist in cleaning and repairing the cemetery. The Jouett House will close on October 30th for the regular season.

REPORTS FROM SPECIAL COMMITTEES

Squire Gill reported that the Ordinance Committee will meet October 24th at 8:00 a.m. The committee hopes to have two ordinances prepared for first reading at the October 24th fiscal court meeting. They are also working on parking in residential areas and animal ordinances.

4. A motion was made by Mary Ann Gill and seconded by Jackie Brown to authorize and direct County Attorney Alan George to have the proposed nuisance ordinance and proposed retention basin ordinance prepared for first reading at the October 24th fiscal court meeting.

Squire Finnell reported that the Harm Reduction Committee met Tuesday, October 3rd at 8:00 a.m. in the 2nd floor courtroom with Cassie Prather from the Health Department in attendance. The committee would like to have a work session at 6:15 before the October 24th regular fiscal court meeting.

Copier Proposal from County Clerk

County Clerk Sandra Jones was present at the meeting to answer any questions regarding her proposal to surplus the Toshiba copier from her office and transfer it to the Coroner’s office. The lease on the copier expires December 31, 2018. The total buyout amount for the copier is $6,010.24. That money is not currently in the Clerk’s budget and would need to come out of the county reserve. The other option is to transfer the contract to the Coroner’s office and have the Coroner pay $274 per month for the lease. Clerk Jones has received a written statement from Toshiba stating the contract can be transferred to the Coroner’s office. After some discussion, a motion by Ken Reed and second by Linda Popp was withdrawn. The court asked that the issue be put on the October 24th agenda in order to have the Coroner be present at the meeting to share his wishes regarding the copier.

NEW BUSINESS

Approval of Contract for Transportation of Non-Public School Students

6. A motion was made by Mary Ann Gill and seconded by Duncan Gardiner to approve the contract for the transportation of non-public school students for the 2017-2018 school year. (Attachment)

Approval of Courthouse Opening for Christmas Parade and Events

7. A motion was made by C.L. Watts and seconded by Jackie Brown to have the courthouse open on December 1st from 3:00 p.m. until 7:30 p.m. and on December 2nd from 4:30 p.m. until 8:00 p.m. for the annual Christmas parade and events.

Acceptance of Annual Report for the Woodford County Library District

8. A motion was made by Jackie Brown and seconded by Gary Finnell to accept into the record the annual report for the Woodford County Library District. (Attachment)

Reappointment of Lori Garkovich to Agricultural Advisory Board

15. A motion was made by Ken Reed and seconded by Mary Ann Gill to re-appoint Lori Garkovich to the Agricultural Advisory Board for a 4 year term ending October 14, 2021. (Attachment)

GOOD OF THE COUNTY

PROGRAM:

Jim Magazine, an attorney from Clearwater Florida, came before the court to discuss pending litigation against distributors that have broken federal laws that have brought drugs into this country and added to the opioid epidemic. A growing number of states, cities and counties have filed civil cases against manufacturers, distributors and large drugstore chains. As of September, 2017, 20 Kentucky counties had filed suits. Mr. Magazine will be present at the October 24th meeting to answer any additional questions the court may have and the resolution authorizing the county’s participation in the potential litigation will be on the agenda for consideration.

16. A motion was made by Gary Finnell and seconded by Ken Reed to go into Executive Session to discuss the possible acquisition of land.
