Architectural Changes and Controls Any owner wishing to make any exterior additions or changes to a unit (Note: “Exterior” includes, but may not be limited to: patios, decks, fences, landscaping, landscaping accessories, arrangements, flag poles, entrances, windows, doors, garage doors, and light fixtures, etc.) must comply with the following procedure:

 Requests must be submitted in advance of making changes and in writing to the Managing Agent, who will forward the request to the Board. Requests must be approved by the Board before any changes are made. Architectural Change Request (ACR) forms are available from the Managing Agent.  When requests are presented at scheduled HOA meetings, they must be approved by a majority of the Board members. When requests are made between meetings, they must be approved by all Board members.  Requests must include: name, address and telephone number, a written statement describing the proposed alteration/addition, a drawing showing plan, elevation and all dimensions, and all specifications describing materials, sizes, type, gauge, color and finish. A photo of the exterior site/plans and a picture of the proposed new product to be used in the alteration or addition should be provided, if available. Also required is a copy of the approved city permit where permits are required. Please work with the Managing Agent to finish the form completely, before sending it to the Board for review.  Building-wide changes (e.g. Including but not limited to door color, roof replacement, exterior light fixtures) must be coordinated among all homeowners within the building and must occur at the same time.  Any structure erected or alteration made to a unit without prior Board approval is in direct violation of the Declarations and the Board may assess fines of $50 or more, or may assess fines according to the schedule set forth in the Enforcement of Regulations section of Rules and Regulations for the River Bend Townhome Association. Additionally, unapproved changes may be removed by the Association at the homeowner’s expense. The Board has the authority to sue the owner to return the property to its original condition or to modify or alter the structure. The owner will be responsible for all costs and legal fees.  An architectural change approval is valid for two years from the date of approval.

Plantings Flower bed plantings (e.g. annuals that homeowners may add to their existing landscaping) must be low growing, and be maintained by the homeowner. Small planters and small flower plantings routinely do not require an Architectural Change Request, although they do remain under the oversight of the Board. Large plants and flowers, bushes, trees, flower bed structures, etc. that homeowners wish to add to their current landscaping require the completion of an Architectural Change Request form, and a specific description and photo of those plantings being considered must be included.

Landscaping Control …..Any owner desiring to change the landscaping by either planting or removing plant material (including any perennials, trees, and shrubs) must put the request in writing to the Managing Agent and obtain approval prior to modifications being done. Any plantings installed or removed by the unit owner on individual property, without prior approval, will be cited as a violation and may be returned to its original state by the Association, with charges for the work billed to the individual owner.
