Providing Regulations on Open-Source Software Prioritized Procurement and Use in State

CIRCULAR Providing regulations on open-source software prioritized procurement and use in State agencies and organizations. ______Pursuant to Law Information Technology dated June 29, 2006; Pursuant to Law on Bidding dated November 26, 2013; Pursuant to Decree No. 64/2007/ND-CP dated April 10, 2007 of the Government on the application of information technology in the operation of state agencies; Pursuant to Decision No. 169/2006/QD-TTg dated July 17, 2006 of the Prime Minister on the regulations on investment and procurement of information technology software by agencies and organizations funded by State Budget and Decision No. 223/2006/QD-TTg of October 04, 2006 by the Prime Minister on the amendment of some articles of Decision No. 169/2006/QD-TTg; Pursuant to Decree No. 132/2013/ND-CP of October 16, 2013 of the Government providing regulations on the functions, tasks, powers and organizational structure of the Ministry of Information and Communications; At the request of the Director of Information Technology, Minister of Information and Communications issued Circular providing regulations on the open-source software prioritized for procurement and use in State agencies, organizations. Article 1: Scope of regulation This Circular provides regulations on the list and criteria for the selection of open- source software are prioritized for procurement and use in State agencies and organizations and the priorities for procurement and use of open source software in State agencies and organizations. Article 2: Subjects of application 1. This Circular is applicable to: a) The State agencies, political organizations, socio-political organizations, professional socio-political organizations, social organizations, units of the people’s armed force, public non-business units (thereafter referred to as the State agencies and organizations) use state capital for investment and procurement of information technology products for activities of non-commercial purposes; b) The organizations, enterprises participating in the construction, supply of software for State agencies and organizations.

1 2. Encourage agencies and organizations other than those mentioned in this clause 1 of this Article to apply the regulations of this Circular. Article 3: Criteria for selection of open-source software products prioritized for procurement and use in State agencies and organizations The open-source software prioritized for procurement and use in State agencies, organizations must satisfy the following criteria: 1. Criteria of the functions, technical features a) The software must have functions, technical features consistent with corresponding business requirements or regulations, guidelines on the application of information technology in state agencies and organizations; b) The software must satisfy the compatibility requirements for information systems, existing databases of agencies and organizations. 2. The criteria of openness and sustainability of software a) The software must ensure the rights: freedom to use the software without having to pay licensing fees, freedom to redistribute the software, freedom to modify the software on demand of use, freedom to redistribute modified software (with or without charge); b) The software must have the source code, and installation program is provided free on-line (Internet). Software with installation instructions or with such instruction in Vietnamese takes priority; c) Software must have a POF (Point of Failure) of 50 points or less, and OSMM (Open Source Maturity Model) of 60 points or more. Article 4: Regulations on the List 1. The list of open-source software products prioritized for procurement, use in State agencies and organizations (thereafter referred to as the list) is specified in Appendix of this Circular. The open-source software products in the list meets the criteria specified in Article 3 of this Circular. 2. The list is posted on the portal of the Ministry of Information and Communications. 3. The list will be updated and supplemented to comply with development. 4. The unit responsible for information technology of the ministries, ministerial-level agencies, government agencies and the Department of Information and Communications of the provinces and cities under the Central shall form the committee to assess products not listed but meet the criteria specified in Article 3 of this Circular to apply within the ministries, branches and localities. Article 5: Regulations on priorities for procurement and use of open-source software in State agencies and organizations 1. The open-source software products prioritized for procurement and use in State agency and organizations include: a) The open-source software included in the list specified in Article 4;

2 b) The open-source software products that meet the criteria specified in Article 3 of this Circular, especially those produced, finalized, operated or supplied by domestic organizations and businesses. 2. If State agencies, organizations have demand to use state capital for investment in construction, procurement, or renting the software included in the list specified in the Appendix of this Circular, or other any types of software on the market that has the corresponding open-source software satisfying the criteria specified in Article 3 of this Circular, they must give priority to the corresponding open-source software products prescribed in paragraph 1 of this Article and shall clearly indicate such priorities in the documents such as preliminary design, construction design, tender plans, investment plans, bidding documents, request for offer, request for quotation or other procurement requirements. 3. State agencies, organizations must ensure that they shall not set out any conditions or requirements or technical features that may lead to the elimination of open source software products in the documents such as preliminary design, construction design, tender plans, investment plans, bidding documents, request for offer, request for quotation or other procurement requirements. Article 6: Responsibility of relevant agencies 1. The Ministry of Information and Communications (Department of Information Technology) is responsible for organizing, guiding the implementation of this Circular; consider and propose amendment to the Circular to update the list of open-source software products prioritized for procurement and use in State agencies, organizations. 2. The unit responsible for information technology of the ministries, ministerial-level agencies, government agencies and the Department of Information and Communications of the provinces and cities under the Central Government shall have to guide, speed up and implement the regulations of this Circular in agencies and units of the ministries, branches or localities; collect data and send a report on the procurement and use of open source software in state agencies and organizations within its sectors and localities to the Ministry of Information and Communications as prescribed. Article 7: Transitional provisions 1. In case investment and procurement of information technology products have been assessed, approved and implemented before the date of this Circular takes effect, it shall continue to comply with the regulations of Circular No. 41/2009/TT-BTTTT dated December 30, 2009 by the Minister of Information and Communication issued the list of open source software products to meet the requirements of use in State agencies and organizations. 2. In case investment and procurement of information technology products have been assessed and approved but not yet implemented before the effective date of this Circular shall comply with the regulations of this Circular. Article 8: Implementation effect 1. This Circular takes effect from January 20, 2015.

This Circular replaces Circular No. 41/2009/TT-BTTTT dated December 30, 2009 by the Minister of Information and Communications issuing the list of open-source software products satisfying the requirements of use in State agencies and organizations. 3. During the implementation, if any problem arises, they should be reported to the Ministry of Information and Communications for consideration and resolution. 4. Chief of Office, Director of Information Technology, heads of agencies and units under the Ministry of Information and Communications, Head of unit in charge of information technology in government agencies, and relevant organizations and individuals shall implement this Circular. /.
