Please keep in mind that this delegation requires that you carry out this procurement according to requirements of Section 518 of the Commonwealth Procurement Code (62 Pa. C. S. 518) and to the policies and procedures outlined by DGS in the Field Procurement Handbook.

Service: This is for maintenance certification services and repairs of mission critical instruments used by The Department of Agriculture Lab. These services include, unlimited number of demand on-site service visits with a maximum 72-hour response. Engineer labor and travel responses are also included. Priority status for technical support inquires with one schedule preventative maintenance visit. Thermo Scientific computers are covered including factory certified parts along with software updates and notifications. They also offer a 20% discount. Ten percent of the discount is a one time discount on Parts, Accessories or Consumables for end users during the life of the maintenance agreement.

Agency Summary: Thermo Fisher Scientific is the single source manufacturer of the Thermo Gas Life Science Mass Spectrometry instruments and software. These instruments use a technologically advanced method to analyze and to identify unknown samples and can only be serviced by the manufacturer. They are the only company certified to provide support, maintenance and upgrade services to ensure that the instrumentation sampling accessories and software will continue to perform according to original manufacturing specifications. The Department of Agriculture has received a waiver from the Remi Group, LLC who is the supplier for the Equipment Maintenance Contract. They must use Thermo certified technicians and parts. Due to the extra time it takes for the third party scheduling and ordering parts it does not allow us to meet reporting deadlines for the PA Horse Racing Commission, as has been demonstrated with repeated service failures for Thermo equipment covered under the third party agreement. By law it is required that urine and blood samples of race horses are tested for the presence of foreign substances and these samples are processed by the Department of Agriculture lab using the Thermo Fisher Scientific instruments. If there are delays in service it will cause problems in the certification and accreditation for this equipment. It is also imperative that the test samples are processed in a timely manner to ensure that racing participants receive purse monies earned. Rev. 04/27/09 Sole Source Summary

Procurement Summary: I am recommending that this sole source be approved because this supplier is the only single source supplier that can maintain this equipment. A waiver was received by The Remi Group, LLC who is the supplier on the statewide Equipment Maintenance Contract 4400014325. Due to the time it takes to schedule and order parts and delays in processing samples Remi is unable to provide maintenance coverage on this equipment. This procurement will produce a cost savings of $235,201.00. The maintenance is due to start on July 1, 2017 - June 30, 2022. The yearly cost for maintenance will be $188,160.80. The maintenance cost for the all five years will be 940,804.00.
