Initial Analysis of the Israeli Supreme Court's Decision in the Settlements Regularization Law Case HCJ 1308/17, Silwad Municipality, et al. v. The Knesset, et. al Issued 15 June 2020 On 9 June 2020, the Israeli Supreme Court decided in an 8 to 1 judgment to cancel the "Settlements Regularization Law for Judea and Samaria [the West Bank]".1 In a ruling spanning 107 pages, the court found that the law violates the rights of Palestinians to property, equality and dignity disproportionately.2 The Knesset passed the controversial law in February 2017. The law provides that the State of Israel could expropriate privately-owned Palestinian land in the occupied West Bank, and to retroactively “regularize” or “legalize” the Israeli settlements built on it. An Addendum to the Law identified 16 settlements to which the law would apply (see Annex at the end of this paper, which also includes a list of the Palestinian villages on which these settlements encroach). According to the court's decision, as of 2016, the scope of Israeli construction on privately-owned Palestinian land in the West Bank amounted to 3,455 structures, of which 1,285 are residential buildings or public institutions.3 The Court’s decision is based on several main legal principles: 1. International law and the non-sovereignty principle applies to the West Bank: The decision stresses that since June 1967, the laws that apply in the West Bank are the laws of "belligerent occupation," supplemented by international human rights law. International Court of Justice Advisory Opinion Proceedings On Legal Consequences of the Construction of a Wall in the Occupied Palestinian Territory Palestine Written Statement (30 January 2004) And Oral Pleading (23 February 2004) Preface 1. In October of 2003, increasing concern about the construction by Israel, the occupying Power, of a Wall in the Occupied Palestinian Territory, including East Jerusalem, in departure from the Armistice Line of 1949 (the Green Line) and deep into Palestinian territory, brought the issue to the forefront of attention and debate at the United Nations. The Wall, as it has been built by the occupying Power, has been rapidly expanding as a regime composed of a complex physical structure as well as practical, administrative and other measures, involving, inter alia, the confiscation of land, the destruction of property and countless other violations of international law and the human rights of the civilian population. Israel’s continued and aggressive construction of the Wall prompted Palestine, the Arab Group, the Non-Aligned Movement (NAM) and the Organization of the Islamic Conference (OIC) to convey letters to the President of the United Nations Security Council in October of 2003, requesting an urgent meeting of the Council to consider the grave violations and breaches of international law being committed by Israel. 2. The Security Council convened to deliberate the matter on 14 October 2003. A draft resolution was presented to the Council, which would have simply reaffirmed, inter alia, the principle of the inadmissibility of the acquisition of territory by force and would have decided that the “construction by Israel, the occupying Power, of a wall in the Occupied Territories departing from the armistice line of 1949 is illegal under relevant provisions of international law and must be ceased and reversed”. -

During this period, over 27,000 attacks against Israeli citizens and residents have been recorded, and over 1000 Israeli citizens and residents have lost their lives in these attacks. Out of these, 155 (May 2007) attacks were suicide bombings, carried out against Israeli targets by 178 (August 2007) suicide terrorists (male and female). (It should be noted that from 1993 up to the beginning of the conflict in September 2000, 38 suicide bombings were carried out by 43 suicide terrorists). Despite the fact that suicide bombings constitute 0.6% of all attacks carried out against Israel since the beginning of the conflict, the number of fatalities in these attacks is around half of the total number of fatalities, making suicide bombings the most deadly attacks. From the beginning of the conflict up to August 2007, there have been 549 fatalities and 3717 casualties as a result of 155 suicide bombings. Over the years, suicide bombing terrorism has become the Palestinians’ leading weapon, while initially bearing an ideological nature in claiming legitimate opposition to the occupation. -

The Palestinian Counseling Center A Rapid Assessment of the Needs of 14 Marginalized Areas in the West Bank during the COVID-19 Pandemic May 2020 This paper reports the results of a needs assessment carried out by the Palestinian Counseling Center (PCC) in 14 areas in the West Bank, Jerusalem, and Area C: Silwan, Al-Issawiya, Al-Tur, Kafr Aqab, Qalandia, Beit Sakarya, Beita, Duma, Qaryout, Jayyous, Qalqilya, Alfasayel, and Alzbaidat. The PCC collected information about the 14 areas included in the needs assessment in order to identify the priorities of the populations and contribute to building sector plans to meet their needs. The necessity of this needs assessment arose from the spread of the COVID-19 pandemic, which led to a declaration of a state of emergency on 5 March 2020 and a total lockdown on 22 March. This has affected the income of over 453 thousand families who may not be able to meet their basic needs if the lockdown continues, with daily-wage workers and workers in Israel being the most vulnerable in this situation. 14 phone interviews were conducted with Community Based Organization (CBO) representatives in the target areas. The needs of each area were collected at multiple levels, including health, mental health, environmental, and educational needs. Summary of Findings See Annex 1 for details of each region's need The results indicates that the residents of the regions have new, emergent needs resulting from the spread of the COVID-19 virus pandemic. In addition, there are needs that existed before the emergency, especially among the communities living in the Jordan Valley, such as Alzbaidat and Alfasayel. -
Ground to a Halt, Denial of Palestinians' Freedom Of
Since the beginning of the second intifada, in September 2000, Israel has imposed restrictions on the movement of Palestinians in the West Bank that are unprecedented in scope and duration. As a result, Palestinian freedom of movement, which was limited in any event, has turned from a fundamental human right to a privilege that Israel grants or withholds as it deems fit. The restrictions have made traveling from one section to another an exceptional occurrence, subject to various conditions and a showing of justification for the journey. Almost every trip in the West Bank entails a great loss of time, much uncertainty, friction with soldiers, and often substantial additional expense. The restrictions on movement that Israel has imposed on Palestinians in the West Bank have split the West Bank into six major geographical units: North, Central, South, the Jordan Valley and northern Dead Sea, the enclaves resulting from the Separation Barrier, and East Jerusalem. In addition to the restrictions on movement from area to area, Israel also severely restricts movement within each area by splitting them up into subsections, and by controlling and limiting movement between them. This geographic division of the West Bank greatly affects every aspect of Palestinian life.
