MEMORANDUM OF SETTLEMENT ARRIVED AT UNDER SECTION 12 (3) OF THE INDUSTRIAL DISPUTES ACT, 1947 BETWEEN THE MANAGEMENT OF ANDHRA BANK AND THE ALL INDIA ANDHRA BANK AWARD EMPLOYEES’ UNION BEFORE THE ASSISTANT LABOUR COMMISSIONER[C], HYDERABAD ON 13.12.2010 REGARDING THE PROCEDURE & POLICY TO BE FOLLOWED IN THE MATTER OF RECRUITMENT AND PROMOTION TO THE POSTS / VACANCIES OF OFFICERS IN JMGS-I CADRE.

SHORT RECITAL OF THE CASE

Whereas the Management of Andhra Bank and the Andhra Bank Employees’ Union (Regd) had signed a Settlement dt. 08.10.1983 regarding the procedure and policy to be followed in the matter of Recruitment and Promotion to the posts / vacancies of Officers in JMGS-I Cadre and whereas certain modifications in some of the provisions in the said settlement were carried out vide settlement dt. 16.10.1989.

Whereas the Settlements dated 08.10.1983 and 16.10.1989 are not meeting the requirements of the present day, the Management vide their lr. no. 666/3/20/IR/291 dt. 20.02.2008 had served a notice on the General Secretary, All India Andhra Bank Award Employees’ Union (Regd), intimating their intention to terminate the Settlement with effect from the date of expiry of the notice period of two months.

Where as the General Secretary of the All India Andhra Bank Award Employees’ Union vide their lr. No. 4/2008/G/205 dt.12.03.2008 had raised an Industrial Dispute before the Asst. Labour Commissioner [C], Hyderabad demanding continuance of the settlement until a new settlement is arrived at.

And where as the Assistant Labour Commissioner [C], Hyderabad intervened in the matter and held discussions on several dates and finally on 13.12.2010 the matter was seized in conciliation and the following settlement has been arrived at by the parties.

TERMS OF SETTLEMENT

The following shall be the policy and procedure to be followed in the matter of Recruitment / Promotion to the posts / vacancies in the Junior Management Grade Scale I in Andhra Bank.

The vacancies identified and approved at any given point of time in Officer Junior Management Grade Scale I Cadre shall be filled in, in the manner as provided for hereunder:

1. The total number of vacancies with regard to recruitment and promotion to the posts of officers in Junior Management Grade Scale I in any financial year until the year March, 2012 shall be mutually discussed between the union and the management and arrived at. Thereafter (i.e. after March, 2012) both parties shall mutually discuss and arrive at the ratios / percentage of vacancies to be filled by way of direct recruitment and by promotions from within.

2. Promotions:

Out of the total vacancies arrived at for being filled through promotions, 70% shall be filled in through merit quota and 30% through seniority quota.

Candidates desirous of participating in the promotion process either under merit or seniority quota have to invariably submit an application in the prescribed format.

i. Merit Quota:

a) 70% of the vacancies identified shall be filled in by promotion of Employees in the clerical cadre on the basis of aggregate marks obtained for Written Test, Interview, Educational Qualifications and Service.

b) Eligibility: Employees having the following service and educational qualifications shall be eligible to appear for written test under this quota. All such eligible candidates shall apply in writing to the management as per the proforma / circular issued by the bank.

Completed years Qualifications of Service Two years Graduates and above Five years Matriculates / SSC, PUC / Inter or any equivalent examination c) The completed years of service stipulated above shall be reckoned as on the date of notification of the vacancies / circular. d) Written Test (50 Marks): The employees eligible for promotion under merit quota shall be subjected to a written test conducted by the Bank / IBPS or any other outside agency identified by the Bank, which test is inclusive of a Test in Banking. Candidates who secure a minimum of 40% marks in the written test shall be eligible to be called for the interview, subject to clause 2(e) infra. e) Interview (20 Marks) :

The total number of employees to be called for interview shall be 3 times the number of vacancies to be filled in under this quota on the basis of their ranking in the written test. However, a marginal increase or decrease may be made in the number of candidates to be called for interview, in case the exact number of candidates are not available at a particular cut off point. The interview shall be mostly based on knowledge of banking. f) Educational Qualifications (Maximum 20 Marks) Weightage shall be given for Educational Qualifications for candidates under merit quota as under:

Additional marks for each of the following qualifications

CAIIB Part-I/ JAIIB 5 Marks

CAIIB Part-II 15 Marks (cumulative) Post Graduates in Economics, 5 Marks Commerce/ MSc / MCA / MTech CA, CS, & ICWA - Inter 10

(Subject to a maximum of 20 marks) g) Service (Maximum 10 Marks)

Service shall carry weightage at the rate of 1 mark for every completed year of service, subject to a maximum of 10 marks.

h) Final Selection shall be made based on the aggregate marks secured by the candidates in the order of merit for service, educational qualifications, written test and interview to the extent of vacancies available under this quota. ii. Seniority Quota:

a) The remaining 30% of the vacancies identified shall be filled in by promotion of employees under Seniority Quota.

b) Eligibility: Clerical staff, who have completed a minimum of 5 years service in clerical cadre are eligible to apply under this quota. The total number of employees to be called for interview from among the applicants shall be 3 times the number of vacancies to be filled in under this quota based on their seniority. However, a marginal increase or decrease may be made in the number of candidates to be called for interview to suit the cut off point.

An employee who is desirous of participating in the promotion process under this quota shall apply in writing to the management in the proforma prescribed by the bank.

c) Service (Maximum 30 Marks): Each completed year of service shall carry two marks, subject to maximum of 30 marks.

d) Educational Qualification (Maximum 40 Marks): Weightage shall be given for educational qualifications for promotion under this quota as follows:

e) Interview (30 Marks): The Interview shall carry 30 marks. Candidates shall be promoted on the basis of aggregate marks obtained in the order of merit for

service, educational qualifications and interview to the extent of vacancies available under this quota.

3. Fitment:

a) A clerk on promotion to Junior Management Grade Scale -I shall be fitted at the minimum of the pay scale in Junior Management Grade Scale-I, subject to the following:

b) For the purpose of fixation in officers' scale any special pay drawn as a clerk shall not be taken into consideration.

c) The promotee officers will draw their annual increments on the anniversary date of their clerical increments except those who are drawing a basic pay in the clerical scale at a stage lower than ` 10500/-, who will draw their increments on the anniversary date of their promotion.

d) Those who have completed more than one year at the maximum in the clerical scale of pay would be given the next increment immediately on fitment in the officers' scale of pay and future increments on the anniversary date of promotion.

e) The fitment formula will be revised if the existing scales of clerical cadre and / or Junior Management Grade Scale-I officers are revised during the tenure of this agreement.

4. General Conditions :

a) An employee who is desirous of participating in the promotion process shall invariably submit an application in the format prescribed by the bank.

b) All the vacancies in Junior Management Grade Scale I shall be filled in the manner laid down in the above paras.

c) The Bank may keep a panel of wait list candidates both under merit and seniority quotas to the extent of 30% over the required vacancies. The wait list shall be valid till the completion of the process of promotion of the next financial year. The vacancies arising out of non reporting or refusal to accept the offer of promotion by any selected candidates shall be filled by promoting the candidates in the wait list in the order of merit under the respective quota.

d) An employee punished by the Indian Institute of Banking & Finance for resorting to unfair means at the examination would not be considered for promotion to higher cadre for one year if he is already eligible or for one year from the date he becomes eligible for such promotion.

e) An employee in respect of whom disciplinary action has been taken and imposed a punishment for major misconduct will not be eligible to participate in the promotion process for 1 year from the date of imposition of the punishment or next promotion process, whichever is earlier.

f) An employee under suspension or against whom departmental action for gross misconduct is pending or who has been charge sheeted for gross misconduct can appear for the written test and / or interview but shall not be eligible for promotion till he is exonerated of the charge/s. If ultimately, he is found to be not guilty and is qualified in the test and or interview the bank shall promote the employee retrospectively from the original date of such promotions along with other employees.

g) On refusal to accept promotion or failure to report for duty at the place of posting as officer within the time prescribed in the offer letter, the employee shall be debarred for promotion for a period of 2 years from the date of such refusal / not reporting

h) An employee after promotion may seek reversion to clerical cadre before his confirmation. However, he /she shall be debarred for promotion for a period 2 years from the date of such reversion to the clerical cadre.

i) Employees called for test and interview shall be treated as on duty and shall be paid TA & DA as per rules in force. Local employees shall be reimbursed conveyance expenses for attending test and / or interview.

j) In case of the subordinate staff who have been promoted to clerical cadre, the date of their promotion to clerical cadre shall be taken into consideration for the purpose of service under the merit and seniority quota.

k) The management shall supply copies of the following to the union in the manner stated as follows: i. List of the selected candidates both under seniority and merit quota with marks obtained under various heads. ii. List of unsuccessful candidates in the written test alongwith the marks scored by them.

5. Reservations:

a) SC & ST Employees and other categories of employees: The relaxations / reservations for scheduled Castes / scheduled tribes and other category of employees shall be as per directions of the Government from time to time.

b) Ex-servicemen: Weightage will be given to Ex-servicemen candidates keeping in view the Government directives issued in this regard from time to time. However, they should complete at least two years service in the clerical cadre in the Bank.

6. Any amendments / modifications to the Settlement shall be made with the mutual consent of the parties to this Settlement and a fresh agreement covering all the relevant issues shall be entered into.

7. This settlement supersedes the settlement dt. 08.10.1983 and 16.10.1989.

8. If any doubt or difficulty arises regarding interpretation of any of the provisions of this settlement, the matter shall be taken up only at the level of Head Office of the Bank and Union for discussion and settlement.

9. This settlement shall come into force with effect from the date of signing this settlement and shall be binding on the parties for a period of two years and shall continue to be binding even thereafter until either party gives two months’ notice in writing of their intention to terminate the settlement.

10. However, the direct recruitment of the officers for the year 2010-11 & 2011-12 will have no relation to the ratio of promotions from within for the said years and for the year 2012-13 onwards the ratio will be mutually discussed and arrived at.
