Re: Petition Regarding the Commercial Availability of Certain Fabrics

Dear Mr. Chairman:

On behalf of the Government of the Dominican Republic, we herewith submit this request for a finding of commercial non-availability pursuant to the provisions of Section 203(o) (4) of the Dominican Republic-Central America-United States Free Trade Agreement (“DR- CAFTA”) Implementation Act and your Federal Register notice of March 15, 2007, with respect to certain fabrics which apparel manufacturers in the Dominican Republic wish to use in the manufacture of apparel. By means of this letter, we request that the subject fabrics be added to Annex 3.25 of the Agreement.

The 29 fabrics in question are listed in the attached Annex. The Annex also contains applicable information regarding fiber type, construction, and quantities required. Each fabric description constitutes a unique fabric that is not substitutable for any other fabric types that may or may not be produced in the region.

Please note that for all fabrics containing spandex, the stated size of the spandex yarns is in the condition as delivered to the yarn spinner. Variance may occur in the final fabric. Further, variances of up to three percentage points are allowable for the purposes of quantifying fiber content. Variances of up to three percent are acceptable for yarn sizes, thread counts, fabric weight and fabric width.

Due Diligence

The following firms and associations were contacted and asked if they or their members could supply the subject fabrics. Full product details, as set forth in the Exhibit, were provided. It should also be noted that the list of fabrics was compiled after close consultation with US industry representatives and their communications described below constitute the agreement of the U.S. industry. During consultations with US Government officials, it was agreed that as a result of the consultative process among the US textile industry and the Dominican apparel industry in this instance only, a single submission for multiple fabrics would be acceptable from the point of view of CITA.
