1 ORDINANCE NO. 2010 2 3 AN ORDINANCE OF THE CITY OF HALLANDALE BEACH, 4 FLORIDA, APPLYING THE PLANNED DEVELOPMENT 5 OVERLAY DISTRICT TO THE “PALMS GATEWAY”, THE 6 PROPERTY LEGALLY DESCRIBED AS LOTS 2, 4, 6 BLOCK “F” 7 AND ALL OF BLOCK “E”, GEORGE M. PHIPPENS 8 SUBDIVISION GENERALLY LOCATED AT 500 N. DIXIE 9 HIGHWAY AND 501-509 NW 1ST AVENUE. 10
11 WHEREAS, as the purpose of a planned development district is to provide an
12optional zoning procedure to permit site design flexibility and greater land use intensity
13and density to encourage high quality, innovative development that is consistent with
14comprehensive plan policies and the City’s development and redevelopment plans, and
15 WHEREAS, applying the guidelines and development standards of a Planned
16Development Overlay District to the “Palms Gateway” property would permit greater
17latitude in development or redevelopment, without the necessity of adhering to strict
18guidelines and predetermined development standards.
19 WHEREAS, The City’s Application No. 66-10-Z would apply the Planned
20Development Overlay District (“PDD”) to the property legally described in the heading of
21this Ordinance; and,
22 WHEREAS, after a courtesy public notice was mailed to all property owners
23within the affected area, and within 1,000 foot radius from the affected area; and,
24 WHEREAS, after notice of a public hearing being duly published, a public
25hearing was held before the Planning and Zoning Board of the City of Hallandale Beach
26on August 25, 2010 at which hearing all interested parties were afforded the opportunity
27to be heard; and,
28 WHEREAS, at the August 25, 2010 Planning and Zoning Board meeting, the
29Board recommended approval of the proposal to apply the “PDD” Overlay District to the
30property; and
31 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE

33 Section 1. In addition to the underlying Business Limited, (B-L) zoning
34District, the Palms Gateway property located at 500 North Dixie Highway and 501-509
35NW 1st Avenue as shown and described on Exhibit “A”, is hereby designated as a
36Planned Development Overlay District.
37 Section 2. All ordinances or parts of ordinances and all resolutions or parts
38of resolutions in conflict herewith are hereby repealed, to the extent of the conflict.
39 Section 3. If this ordinance or any part thereof is declared by a court of
40competent jurisdiction to be invalid; such decision shall not affect the validity of the
41remainder of the ordinance other than the part declared to be invalid.
