HYDE PARK CITY PLANNING COMMISSION October 18, 2017 Minutes

The Hyde Park City Planning Commission meeting began at 7:00 p.m. and was conducted by Chairman Mark Lynne.

APPROVAL OF MINUTES Mark Lynne requested clarification on his motion to approve Juniper Ridge. David made a motion to approve the minutes of the Planning Commission meeting held October 4, 2017. Melinda seconded the motion. Mark Lynne, David Zook, Tiffany Atkinson, and Melinda Lee voted in favor.

CITY COUNCIL REPORT Councilman Mark Hurd reported on the City Council meeting held October 11, 2017: 1. During Citizen Input a resident asked for the animal ordinance to be on the agenda again for a vote. 2. Passed a change (from pounds to tons) regarding commercial trucking, 3. Granted the re-zone of Juniper Acres Subdivision. 4. Made and passed a motion to show support for a Master Trails Plan. They will not adopt anything until wording accompanies the map.

PUBLIC HEARING - FOTHERINGHAM SUBDIVISION PRELIMINARY PLAT (Legislative) Chairman Lynne opened the public hearing regarding the proposed Fotheringham Subdivision Preliminary Plat at 496 North 100 East, consisting of 7 lots on 5.92 acres, in a proposed residential (RE- 20) zone. The owners have also applied for the property to be annexed into Hyde Park City. (parcel ID:04-004-0060) Engineer Zan Murray said the City Council plans to have a hearing for annexation and rezone on November 7. The subdivision proposal and annexation and rezone are happening simultaneously. Mark Lynne noted this is unusual but not improper. No corners are being cut. The Public Hearing was closed 1 without public comment. Zan also verified storm water compliance. The ponds on lots 1 and 4 are the low points of the entire property and sized for retention. The ditch would be used only for emergency overflow.

Zan read the two notes from Scott Archibald, city engineer at Sunrise: 1. Retention pond requirements 2. Note the bearing distance on the north border of lot 4 along Pursers’ property.

PUBLIC HEARING - FOTHERINGHAM SUBDIVISION FLAG LOTS (Legislative) Mark Lynne then opened the Public Hearing for the two flag lots included in the Fotheringham Subdivision. It was decided to write these as two separate agenda items, and separate from the Commission considering them, in the future. The public hearing for the flag lots was also closed without public comment. Zan verified the flag lots each have 30 feet frontage. Appropriate density for the RE-20 zone was verified. Mark made a motion to approve the Fotheringham Subdivision two flag lots as a conditional use. David verified the length and width of the driveways. The Fire Department approved them at the LUA meeting. David seconded the motion. Mark Lynne, David Zook, Tiffany Atkinson, and Melinda Lee voted in favor.

David then made a motion to approve the Fotheringham Subdivision Preliminary Plat on the conditions of: 1. Compliance with the engineer’s requests 2. Annexation approval 3. Re-zone to RE-20 approval. Tiffany seconded the motion. Mark Lynne asked Zan to note on the plat that the ditch will serve as overflow to the ponds. Mark Lynne, David Zook, Tiffany Atkinson, and Melinda Lee voted in favor.

PUBLIC HEARING - EMALIE PETERSON HOME SALON (Legislative) The public hearing was opened and closed due to no public comment. Emalie said they are building a home in Juniper Ridge right now and she wants to include a salon in one room. She will not post signs in the yard or windows to advertise, or demonstrate a business in any way. She knows she can only increase business by ‘word of mouth’. No non-family members will be employed and customers (one or two at a time) will park in the driveway. David asked various questions about inspections of the commercial area separate from the residential area, annual inspections, meeting ADA requirements and if there is a sunset clause on the conditional use permit. This is a good example to see how we can improve our approval process, especially if we remove the “conditional” use, as anticipated. Emalie verified the salon is being built to standards for a salon. David made a motion to approve the conditional use for a home salon on the conditions it is inspected before first use and allowed to be inspected annually (at the city’s discretion). Mark Lynne seconded the motion. Mark Lynne, David Zook, Tiffany Atkinson, and Melinda Lee voted in favor.

HIGHLAND COVE PUD FINAL PLAT (Administrative) Planning Commission October 18, 2017 Dan Turner answered questions about the Final Plat of Highland Cove Senior Public Unit Development (PUD) located at 930 East 100 North, consisting of 21 lots on 5.41 acres. The retention pond is terraced as requested by Mark Lynne and serves as retention for all phases of the Juniper Ridge Subdivision along with one other pond. He answered questions about parking, road width and setbacks. David made a motion to approve the Final Plat of Highland Cove Senior Public Unit Development. Mark seconded the motion. Mark Lynne, David Zook, Tiffany Atkinson, and Melinda Lee voted in favor.

MASTER TRAILS PLAN - MAP AND ORDINANCE (Legislative) Mark Lynne met with Councilman Charles Wheeler and discussed multiple items:  Should the trail be a sidewalk in some places due to tight spaces?  What is a “quiet street”?  What size (width) should each trail be?  700 East involves an interlocal agreement of an 80 foot right of way and 10 foot sidewalk. We do not currently have that in developed areas.  Errors on the map and its legend Charles is working with the canal company. Dayton Crites proposed edits to our ordinance but they reference a national trail standard which includes too many regulations. Mark Lynne is working on cross sections for an 8 foot road and a ‘quiet street’. He will email Dayton’s edits to each of us for our review. Mark Hurd asked if current projects are subject to this plan in works. David said we can ask, but not enforce until it is law, He suggested it be used as leverage by the City Council before approving their annexation and re-zone.

ADDITIONAL USE REGULATIONS (Legislative) Looking at 12.30.020 Additional Use Regulations, it is unclear what this refers to. Does it apply to manufactured homes (which cannot be dis-allowed) or mobile homes (which are practically obsolete)? David said it may be applicable and just needs to be moved to another section of the ordinance which is not a “change” to the ordinance at all. He wonders what “it” refers to in A. and said it would be helpful to find the original ordinance. Maybe we just need to delete “additional”. Nearby sections also refer to flag lots. The whole section is ambiguous and merits further study. The item will continue onto a future agenda.

OTHER David recommended Craig Martindale (resident, architect) as a possible future Planning Commission member. He also requested checklists for each type of approval (sketch, preliminary, final) including items for self-assessment and city approval (ie. “Complies with Master Trails Plan”).
