4 ORDINANCE 2010-121-E 5 AN ORDINANCE REZONING APPROXIMATELY 1.725 6 ACRES LOCATED IN COUNCIL DISTRICT 10 AT 7685 7 103RD STREET BETWEEN WESTCHASE COURT AND RICKER 8 ROAD (R.E. NO(S). 013840-0000), AS DESCRIBED 9 HEREIN, OWNED BY MULTIPLE MEDICAL SPECIALIST, 10 LLC, FROM CO (COMMERCIAL OFFICE) DISTRICT TO 11 PUD (PLANNED UNIT DEVELOPMENT) DISTRICT, AS 12 DEFINED AND CLASSIFIED UNDER THE ZONING CODE, 13 TO PERMIT COMMERCIAL USES, AS DESCRIBED IN THE 14 APPROVED WRITTEN DESCRIPTION AND SITE PLAN FOR 15 THE DR. SYED HUSSAIN PUD; PROVIDING AN 16 EFFECTIVE DATE. 17

18 WHEREAS, Multiple Medical Specialist, LLC, the owner(s) of 19approximately 1.725 acres located in Council District 10 at 7685 20103rd Street between Westchase Court and Ricker Road (R.E. No(s). 21013840-0000), as more particularly described in Exhibit 1, attached 22hereto (Subject Property), has/have applied for a rezoning and 23reclassification of that property from CO (Commercial Office) 24District to PUD (Planned Unit Development) District, as described 25in Section 1 below; and 26 WHEREAS, the Planning Commission has considered the 27application and has rendered an advisory opinion; and 28 WHEREAS, the Land Use and Zoning Committee, after due notice 29and public hearing, has made its recommendation to the Council; and

1 WHEREAS, the Council finds that such rezoning is: (1) 2consistent with the 2010 Comprehensive Plan; (2) furthers the 3goals, objectives and policies of the 2010 Comprehensive Plan; and 4(3) is not in conflict with any portion of the City’s land use 5regulations; and 6 WHEREAS, the Council finds the proposed rezoning does not 7adversely affect the orderly development of the City as embodied in 8the Zoning Code; will not adversely affect the health and safety of 9residents in the area; will not be detrimental to the natural 10environment or to the use or development of the adjacent properties 11in the general neighborhood; and will accomplish the objectives and 12meet the standards of Section 656.340 (Planned Unit Development) of 13the Zoning Code; now therefore 14 BE IT ORDAINED by the Council of the City of Jacksonville: 15 Section 1. Property Rezoned. The Subject Property is 16hereby rezoned and reclassified from CO (Commercial Office) 17District to PUD (Planned Unit Development) District, as shown and 18described in the approved site plan dated January 18, 2010 and 19written description dated March 2, 2010 for the Dr. Syed Hussain 20PUD. The PUD district for the Subject Property shall generally 21permit commercial uses, as more specifically shown and described in 22the approved site plan and written description, both attached 23hereto as Revised Exhibit 2. 24 Section 2. Rezoning Approved Subject to Conditions. This 25rezoning is approved subject to the following conditions: 26 (a) Development shall proceed in accordance with the 27Development Services Division Memorandum dated February 10, 2010, 28or as otherwise approved by the Planning and Development 29Department. 30 (b) An electronic message board is permitted as part of the 31monument sign and shall not exceed 25% of the allowable sign area. 2 - 2 - 1 AMENDED 3/23/10

1The electronic message shall be displayed for a minimum of ten 2minutes. The electronic message board shall not flash or have 3animation. 4 Section 3. Owner and Description. The Subject Property 5is owned by Multiple Medical Specialits, LLC and is legally 6described in Exhibit 1. The agent is Alberta Hipps, 1650 Margaret 7Street #323, Jacksonville, Florida 32204; (904) 781-2654. 8 Section 4. Effective Date. The adoption of this 9ordinance shall be deemed to constitute a quasi-judicial action of 10the City Council and shall become effective upon signature by the 11Council President and the Council Secretary. 12
