MINUTES OF THE TOWN COUNCIL REGULAR MEETING August 13, 2013 7:00 p.m.

Mayor Randy Barrett called the regular monthly meeting of the Winfield City Council to order on August 13, 2013 at 7:00 p.m. at Winfield City Hall, 1 Main Street, Winfield, WV.

ATTENDANCE Members Attending: Randy Barrett, Mayor; Ryan Powers, Frank Bannister, Kevin Karnes, Steve Hannah and Joe Rumbaugh, members; Jackie Hunter, Recorder.

Staff Present. Gloria Chapman, City Clerk/Treasurer; Tim LaFon, City Counsel; Laura Cox, City Planner and Police Chief, John Perrine.

Public: Dana Campbell of the Comprehensive Committee.

Approval of Minutes. Hearing no objections or questions, the minutes of the June 18, 2013 regular meeting were approved. Hearing no objections or questions, the minutes of the July 9, 2013 regular meeting were also approved. Hearing no objections or questions, the minutes of the July 25, 2013 special meeting were approved.

FINANCIAL

Bills Paid. The bills paid for the month of July 2013 in the amount of $ 49,434.77 were approved.

General Fund Financial Statements. Hearing no objections, the financial statement for the month of July, 2013 was approved.

Coal Severance Fund Financial Statement. Hearing no objections, the Coal Severance financial statement for the month of July 2013 was approved. Page 2 Minutes Winfield City Council August 13, 2013

REPORTS, QUESTIONS & DISCUSSIONS

Police and Municipal Staff Report. Police Chief John Perrine reported that the Winfield Police Department has expanded its service to include a 24 hour, seven days a week patrol service to the citizens of Winfield. To achieve this mission, the police department has hired a full time police officer, Arthur G. Jarrett, to cover the additional staffing requirements. Officer Jarrett, a graduate of the 138th Basic Police Class of the WV State Police Academy, has most recently worked with the Whitesville Police Department and also served part-time as the acting City Manager.

The Chief noted that the Police Department has received a $1,500 grant from the Governor’s Highway Safety Program for enforcement of the Seat Belt and Distracted Driving enforcement.

In response to a request from citizens of Cane Creek asking the City to upgrade their streets, the Mayor reported that S & S Engineers performed core sampling on the streets. Their findings showed thickness to be in accordance with our city ordinance requirements; but due to the amount of breakup and cracking of the streets, the Mayor stated that the developer would have to post a bond to bring the streets up to specifications in order for the city to accept the streets into the city.

Mayor Barrett stated that he had met with the Mayor of Buffalo who is seeking a grant to lay a sewer line from Buffalo to Midway. This would present another option for the City of Winfield to obtain an updated sewer system by constructing a force main down to Frazier’s Bottom to tie into the Buffalo line.

Wastewater System/Treatment Plant Report:

The Mayor reported that ammonia levels at the Sewer Plant were down to 16.5. Page 3 Minutes Winfield City Council August 13, 2013

UNFINISHED BUSINESS

Revise Cemetery Rules to Address Cremations.

Ryan Powers moved to allow two cremation remains to be buried on the same plot for the cost of one plot ($ 925), with the stipulation that there would only be one tombstone for each lot and that there would be the regular opening and closing fee of $75 for each opening and closing. Motion carried.

Second Reading & Adoption of Ord. #2013-2014-1 – Revise Annexation Article 1345.06. Ryan Powers moved to hold the second reading and adoption of Ord. #2013-2014-1. Motion carried.

Second Reading & Adoption Ord. #2013-2014-2 – Text Amendment 2009 Int’l. Property Code . Steve Hanna moved to hold the second reading & adoption of the Ord. #2013-2014-2 Text Amendment 2009 Int’l Property Code. Motion carried.

Second Reading Draft Ordinance to Adopt State Code for Cell Phone Use While Driving. Ryan Powers moved to hold the Second Reading to draft an ordinance to adopt state code for cell phone use while driving. Motion carried.

NEW BUSINESS

Review of Comprehensive Plan Current Residential/Suburban Commercial Land Use mix along Route 817. Kevin Karnes moved to change the wording in Chapter 2 – Land Use of the Comprehensive Plan to read, “Commercial Development of front portion of land along Rt. 817 is to be encouraged. Exact portions will be according to topographic restraints”. Motion carried.

Review of Comprehensive Plan and Need for Additional Medium Density (R-2) Residentially Zoned Land in the City. Steve Hanna moved to add a sentence to the land use section of the Comprehensive Plan to read; “Small scale medium density infield residential projects are to be encouraged where feasible to stimulate development in old town section of city”. Audit Findings – Last Three Years. Gloria Chapman presented to the council members copies of the city’s audits for the last three years for them to review.

Donation for the Hoge House. Steve Hanna moved to donate $3,000 to the Hoge House. Motion carried. Joe Rumbaugh abstained from voting due to conflict of interest.

Demolition of House at 19 Second Street. The Mayor stated that there was not enough information to report, so the item was tabled until September’s meeting.

GOOD OF THE ORDER Mayor Barrett reported to the Council that there was a good possibility the City would be able to purchase Dale Vance’s building that is currently being rented by PJ’s Daycare since Dale was in the process of evicting them. He stated that Mr. Vance was interested in selling us the Daycare Building and purchasing our property in front of the wastewater plant. The Mayor said he was going to speak with the Building Commission to get approval for an appraisal of the Daycare building and our property.

ADJOURNMENT Kevin Karnes moved that the meeting be adjourned at 8:25 p.m. until the next regularly scheduled meeting.
