AN ACT TO AMEND SECTION 59-112-50, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO IN-STATE TUITION AT PUBLIC COLLEGES AND UNIVERSITIES FOR MILITARY PERSONNEL AND THEIR DEPENDENTS, SO AS TO FURTHER PROVIDE FOR THE MANNER IN WHICH AND CONDITIONS UNDER WHICH THESE PERSONNEL AND THEIR DEPENDENTS ARE ELIGIBLE TO RECEIVE AND RETAIN IN-STATE TUITION RATES; AND BY ADDING SECTION 40-1-75 SO AS TO PROVIDE THAT A PERSON WHOSE PROFESSION OR OCCUPATION IS REGULATED BY TITLE 40 IS EXEMPT FROM COMPLETING CONTINUING EDUCATION REQUIREMENTS FOR HIS PROFESSION OR OCCUPATION WHILE SERVING ON ACTIVE MILITARY DUTY.

Be it enacted by the General Assembly of the State of South Carolina:

Tuition rates

SECTION 1. Section 59-112-50 of the 1976 Code is amended to read:

“Section 59-112-50. Notwithstanding other provisions of this chapter, during the period of their assignment to duty in South Carolina, members of the armed services of the United States stationed in South Carolina and their dependents are eligible for in-state rates. When such armed service personnel are ordered away from the State, their dependents are eligible for in-state tuition rates so long as they remain continuously enrolled at the state institution where they are enrolled at the time the assignment ends. These persons and their dependents are eligible for in-state rates after their discharge from the armed services even though they were not enrolled at a state institution at the time of their discharge, if they have evidenced an intent to establish domicile in South Carolina and if they have resided in South Carolina for a period of at least twelve months immediately preceding their discharge.”

Continuing education requirements

SECTION 2. Chapter 1, Title 40 of the 1976 Code is amended by adding: “Section 40-1-75. A person whose profession or occupation is regulated by this title is exempt from completing continuing education requirements for his profession or occupation while serving on active military duty.”

Time effective

SECTION 3. This act takes effect upon approval by the Governor.
