ORDINANCE NO. 20, 2015

AN ORDINANCE ENACTING CHAPTER 10.36 OF THE POWELL CITY CODE BY PROVIDING REGULATIONS AND RESTRICTIONS REGARDING PARKING OF RECREATIONAL AND UTILITY VEHICLES ON PUBLIC STREETS.

IT IS HEREBY ORDAINED by the governing body of the City of Powell, Park County, Wyoming, as follows:

Section 1. Chapter 10.36 of the Powell City Code is hereby enacted to provide as follows:

Chapter 10.36 PARKING OF RECREATIONAL AND UTILITY VEHICLES AND TRAILERS ON PUBLIC STREETS

10.36.010 Parking of Recreational Vehicles, Trailers and Buses on Public Streets.

The purpose of this Chapter is to address health, safety and welfare concerns as it relates to traffic and pedestrian movements, as well as ingress and egress from private property onto public streets and rights of way. The following Sections also help to preserve the integrity of property values by enhancing infrastructure integrity and character of the public rights of way through enhanced sweeping, snow removal, street repairs, police observation and abandoned vehicle removals.

The following words and phrases when used in this chapter shall, for the purposes of this chapter, have the meaning respectively ascribed, as follows:

“Recreational Vehicle” means a motorized vehicle, or a non-motorized vehicle which can be driven or towed by a motorized vehicle, which is primarily designed for temporary living accommodations for recreational, camping and/or travel use including but not limited to motorized motorhomes, motorized camping vans, camp/travel trailers, pop-up camp trailers, and slide-in pick-up box campers (but not pick-up box toppers).

“Trailer” means a non-motorized vehicle which can be towed by a motorized vehicle and can be used to transport animals, snowmobiles, motorcycles, boats, all-terrain vehicles (ATV), other vehicles, equipment, machinery, construction materials, firewood and other items and things, but does not include non-motorized recreational vehicles designed to be towed which are defined as a “Recreational Vehicle”.

“Livestock Trailer” means a trailer designed for hauling/transporting livestock.

“Bus” means a motorized vehicle designed to transport more than sixteen persons.

“Commercial Trailer” means a trailer designed and used by a commercial business.

“Vehicle” means any motorized or non-motorized vehicle including, but not limited to: cars, pick-ups, vans, motorcycles, all-terrain vehicles (ATV), motorized recreational vehicles, buses, trailers and motorized or non- motorized recreational vehicles.

“Motorized” means self-propelled by a motor under the control of a driver.

“Public Street” means the entire width of every public right-of-way.

“Front Yard Setback” means the area between the “Public Street” and the dwelling or building closest to the “Public Street”.

“Residential Dwelling” means a building used primarily for residential occupancy.

Section 10.36.020 Unlawful Parking.

A. It shall be unlawful for any person to park, place, or let stand on any public street within the City or any municipal parking area any Vehicle, Recreational Vehicle, Trailer, Livestock Trailer or Bus which is not currently licensed to be operated or towed on public streets or which is inoperable, or which cannot be safely operated or towed. B. Out of state licensed or registered Recreational Vehicles, Trailers, Livestock Trailers or Buses will be treated as non-permanent residence status vehicles with a maximum per year of two weeks parking on abutted permitted property for the purposes of family visitations, gatherings or attending or participating in a locally sponsored meeting, event or activity. C. It will be unlawful to park any Recreational Vehicles, Trailers, Livestock Trailers or Bus upon the following public streets with the exception of loading or unloading for a period not to exceed forty- eight (48) hours throughout the year:

1. Division Street; 2. Absaroka Street; 3. Avenues A, B, C, D between Edmonds Street and Division Street; 4. Abutting any City Park (with the exception of allowed School Programs and permitted events within the City); and 5. Abutting any Public School (with the exception of School District owned Recreational Vehicles, Trailers, Livestock Trailers or Buses where permitted).

D. It shall be unlawful for any person to park, place or let stand, any Recreational Vehicles, Trailers, Livestock Trailers or Bus on any public street within the City abutting the lot of a residential dwelling, other than that property owned or rented by the owner of the Recreational Vehicle, Trailer, Livestock Trailer or Bus, or without the written permission of one or more of the owners of the abutting residential dwelling. E. It shall be unlawful for any person to live in any Recreational Vehicle, Trailer, Livestock Trailer or Bus on any public street or municipal parking area, except for permitted City owned camping areas for the time allowed. F. It shall be unlawful for any person to park, place or let stand on any public street or residential driveway within the City any vehicle if any part of the vehicle extends onto or over any public sidewalk or onto or over the travel lane of any public street. G. During the period of Memorial Day through Labor Day, parking of Recreational Vehicles, Trailers (excluding Livestock Trailers) or Buses will be allowed to park on public streets upon the following conditions:

1. No more than one Recreational Vehicle, Trailer, or Bus will be allowed to park on public streets within the City abutting the lot of a residential dwelling owned or rented by the owner of the Recreational Vehicle, Trailer or Bus, or with the written permission of one or more of the owners of a residential dwelling not owned, provided however that parking is prohibited on streets designated in paragraph C of this section. 2. It shall be unlawful for any person to permit a Livestock Trailer to remain parked for a continuous period of more than forty-eight (48) hours. Moving such a vehicle from one location to another shall not exclude a violation of this section, nor toll the forty-eight (48) hour limit if both locations are on a City street or municipal parking area within City boundaries. 3. All other code sections are still in effect and must be complied with.

H. During the period of Labor Day through Memorial Day, it shall be unlawful for any operator to permit a Recreational Vehicle, Trailer, Livestock Trailer or Bus to remain parked for a continuous period of more than forty-eight (48) hours on any City street or municipal parking area within City boundaries. Moving such a vehicle from one location to another shall not exclude a violation of this section nor toll the forty-eight (48) hour limit if both locations are on a City street or municipal parking area within City boundaries. I. It shall be unlawful for any person to connect any water hose or line from any residential dwelling, building or business to any Recreational Vehicle, Trailer, Bus or other vehicle which is parked on any public street within the City of Powell for any period of time where the connected water hose or line does not lie flat on the surface of the ground, sidewalk or other surface of the public right- of-way on which it lies so it does not constitute a tripping hazard to pedestrians. J. It shall be unlawful for any person to connect any electric cord or line from any residential dwelling, building or business to any Recreational Vehicle, Trailer, Bus or other vehicle which is parked on any public street within the City of Powell for any period of time where the connected electric cord or line does not lie flat on the surface of the ground, sidewalk or other surface of the public right- of-way on which it lies so it does not constitute a tripping hazard to pedestrians.

Section 10.36.030 Parking of Recreational and Utility Vehicles and Trailers on Front Yard Setback areas.

Vehicle parking in the front yard setback area will be on a surface driveway of concrete, asphalt, pavers or gravel.

No more than one Recreational Vehicle or Trailer will be allowed to park on the front yard setback of any residential dwelling provided that they are parked upon an approved driveway surface. No Buses or Stock Trailers are allowed to park in the front yard setback of any residential dwelling. Section 10.36.040 Storage on premises by owner.

Nothing in this chapter shall be deemed to prohibit the storage of Recreational Vehicles, Trailers, Livestock Trailers or Buses on the home premises of its owner for any length of time, provided that they are in compliance with this section and all other zoning and City of Powell code sections.

Section 10.36.050 Exceptions.

This ordinance shall not apply in a manner so as to prevent the storage of Recreational Vehicles, Trailers, Livestock Trailers or Buses upon private property where such property is used for repair or maintenance or for a commercial purpose, provided that they are in compliance with all other zoning and City of Powell code sections.

This ordinance shall not apply in a manner so as to prevent the use of a Commercial Trailer while working on projects that require the trailer to be parked along the abutting property while completing the permitted Commercial project, provide that they are in compliance with this section and all other zoning and City of Powell code sections.

Section 2. This ordinance shall be in full force and effect upon January 1, 2016, following its adoption and publication as required by law.
