It is a meeting of two souls: physically, mentally, and sexually. But here question arises whether this also gives right to husband to do sex without consent of wife or to do it forcefully. When husband do sex without consent of wife or forcefully it refers to word marital rape. It is forcible and non- consensual sexual acts between spouses. The term rape is well defined under section 375 of IPC. But it is covered by its exception ( 2 ) being husband, if you have a forcible or non-consensual sexual act with your wife it is not illegal in India. India is still enlisted among 36 countries across the globe who not yet criminalised marital rape. The government of India itself says that criminalising marital rape, may destabilize institution of marriage and may act as easy tool to harass the husband as section 498(A) of IPC , is usually used on a false pretext to harass the husband and his relatives.     ‘MARITAL RAPE’ IN MARRIAGE: THE NEED FOR REFORM IN BANGLADESH Md Mustakimur Rahman* ABSTRACT The notion of marital rape is not new and came from Hale’s theory. Although it is an old concept, but still some of the state parties of the United Nations are using this option as immunity. However, there are quite a few modern justifications that can actually defeat the Hale’s theory. Hence, the notion of Hale’s theory is not valid anymore in the 21st century. Currently, more than 100 countries have incorporated ‘marital rape’ as a criminal offence and punishing the offenders. Unfortunately, marital rape is not an offence under the Penal Law of Bangladesh unless the wife is under 13 years old. This article analysed the current Bangladeshi laws regarding rape, which is substandard to protect the marital rape victims. In addition, it also argues how current law is violating several international laws and the rights guaranteed under the Constitution of Bangladesh. The existing laws of rape under the Penal Law of Bangladesh are outdated and therefore, reform is the demand of time. I. INTRODUCTION Rape is a sexual offence, an unwanted act that executes in an unlawful manner. It is recognised as the most severe form of sexual violence all over the world. In rape, the perpetrator can be anyone, a stranger or even a family member. However, it is a common tendency to think that an offender of rape is usually a stranger, a malicious person. 1 Nevertheless, people do not think of rape in case of marriage. 2 However, rape could actually take place in marriage, and this form of rape is called “marital rape”.

    Indiana Law Review Volume 52 2019 Number 2 ARTICLES EPISTEMIC EXCEPTIONALISM JAMES R. STEINER-DILLON* Although most rules of evidence and procedure are not limited by their terms to jury proceedings, courts often apply more permissive standards in proceedings involving judges rather than juries as factfinders. They do so, often explicitly, on the basis of “epistemic exceptionalism”—the claim that judges’ cognitive processes can be trusted to operate with greater competence and objectivity than those of laypersons even in the absence of evidentiary and procedural constraints. This Article describes two areas of law in which epistemic exceptionalism manifests: first, a tendency among courts to exempt pretrial and bench trial proceedings from rules of evidence intended to guard against the effects of cognitive biases and fallacies to which human cognition is susceptible; and second, a tendency to displace the jury in favor of judicial factfinding where judges conclude that the factfinding task is too difficult for the jury to perform competently. Surveying the empirical literature on human cognition generally and judicial cognition specifically, it argues that the claims of epistemic exceptionalism are, at best, exaggerated—while judges are less susceptible to some kinds of cognitive error, the cognitive differences between judges and laypersons are generally small in magnitude and insignificant in comparison to the extent to which both groups show similar susceptibility to cognitive illusions, implicit bias, and motivated reasoning. Moreover, generalist judges have little advantage over lay jurors in interpreting complex evidence in domains outside judges’ legal expertise. Thus, doctrines grounded in epistemic exceptionalism risk increasing the influence of cognitive error in judicial decisions, and they preempt the jury’s factfinding prerogatives in favor of generalist judges for no corresponding benefit.

Although the ICTY expanded criminal liability for sexually violent acts committed during the Yugoslav Wars to an unprecedented extent, the conviction rate for sexually violent crimes was much lower than the conviction rate for other crime. This Comment will explore the dissonance between the expansion of criminal liability for sexually violent crimes and the low conviction rate for these crimes. Cases, eyewitness reports, and interviews with ICTY prosecutors provide insight on the possible causes of this dissonance.
