ORDER TO OPEN SAFE DEPOSIT BOX

On the petition of ______(“Petitioner”), to open safe deposit box number ______(“Safe Deposit Box’) leased or co-leased to ______, deceased (“Decedent”), by ______as lessor (“Lessor”), the Court finding that satisfactory proof of the Decedent’s death has been presented, and that Petitioner is entitled to the benefits of section 655.935, Florida Statutes, it is ADJUDGED that the Lessor shall allow Petitioner to open, and if necessary drill into, and examine the contents of the Safe Deposit Box, in the presence of Lessor’s officer, and the Lessor is directed to deliver:

1) To the court having probate jurisdiction in the county where the Lessor is located, any writing purporting to be the Decedent’s will or codicil or a writing described in section 732.515, Florida Statutes.

2) To Petitioner, any writing purporting to be a burial plot deed or to give burial instructions.

3) To the beneficiary named therein, any document purporting to be the Decedent’s life insurance policy.

4) Petitioner and bank officer shall, in each other’s presence, make an inventory of the contents of the box. Bank officer shall immediately file with the court the inventory signed by both parties.

5) Bank officer is also directed to copy any stocks and bonds found in the box and attach them to the inventory. No other contents shall be removed pursuant to this order. The Lessor’s officer shall also make a complete copy of any document removed and delivered, and place that copy, together with a memorandum of delivery identifying the officer’s name, the person to whom the document was delivered, and the date of delivery, in the Safe Deposit Box. The Lessor may charge a reasonable fee to cover costs incurred in complying with this Order. ORDERED on this _____day of ______, 20_____.
