NOTES FOR GUIDANCE

Notifying accidents or dangerous occurrences

1. The SAPO licence requires the licence holder to notify the licensing authority immediately in the event of an Accident or Dangerous Occurrence involving any of the specified animal pathogens listed in Schedule 1 of their licence. There may be situations where as well as notifying the licensing authority, HSE also requires notification under the Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 2013 (RIDDOR) (eg if a person were to require hospital treatment or the Genetically Modified Organisms (Contained Use) 2014 Regulations (eg if the specified animal pathogen is genetically modified).

What is an Accident or Dangerous Occurrence?

2. A SAPO licence defines an Accident as:

“accident” means unplanned or uncontrolled event involving the escape of a specified animal pathogen from containment

3. A SAPO licence defines a Dangerous Occurrence as:

“Dangerous Occurrence” means an unplanned or uncontrolled event involving a specified animal pathogen that has not resulted in its loss of containment, but which had the potential to do so.

4. Where specified animal pathogens have been dispatched by the licence holder and fail to arrive at their destination within the pre-planned timescale and where there are not acceptable reasons for this delay, this must be reported to the licensing authority as a Dangerous Occurrence.

Information to be provided

6. Information to be provided to the licensing authority includes the people involved in the Accident or Dangerous Occurrence (eg laboratory personnel, engineers, bystanders); the specified animal pathogen involved in the Accident or Dangerous Occurrence and an indication of the quantity of material involved; the date, time and location of the Accident or Dangerous Occurrence; the circumstances or contributing factors that gave rise to the Accident or Dangerous Occurrence; and the measures being taken to eliminate any immediate hazard to animals outside the licensed premises.

7. When providing information in the form, it is helpful to provide as much details as possible to enable HSE to determine the severity of the Accident or Dangerous Occurrence, particularly where there is an immediate risk to animal health. This will enable HSE to alert the relevant authorities where further action is required to prevent the spread of specified animal pathogens in the environment.

8. The form requests information on the immediate and underlying causes of the Accident or Dangerous Occurrence. It is understood that this may not be available immediately and where this is the case, this should be stated on the form but should not delay notification.

9. The detailed information provided on an Accident or Dangerous Occurrence notification is kept on HSE files and hence may be subject to requests for disclosure. Regulation 12 of the Environmental Information Regulations 2004 (EIR 2004) sets out the disclosure provisions for information provided on such a notification. If a request for information is received, the licensing authority will decide whether the information provided in the Accident or Dangerous Occurrence notification should be exempt from disclosure on the grounds set out in EIR2004.

10. If, on receipt of a request, the licensing authority decides to release this information in accordance with the requirements of the Freedom of Information Act 2000 and EIR 2004, it will inform the licence holder in writing before releasing the information.
