TOWN OF MILLBURY BOARD OF SELECTMEN MINUTES MUNICIPAL OFFICE BUILDING- SELECTMEN’S MEETING ROOM June 11, 2013 7:00 p.m. ______Present: Board of Selectmen: E. Bernard Plante; Francis B. King; Brian M. Ashmankas; Sandra J. Cristo; Mary Krumsiek; Town Manager, Bob Spain; DPW Director Robert McNeil; Chief Kenny Howell; Officer Dan Daly; Tom Reilly, The Millbury-Sutton Chronicle; Susan Spencer, The Telegram & Gazette; Edd Cote and other concerned citizens. Absent: Chairman E. Bernard Plante

Pledge, Acting Chairman King wanted to wish a Happy Birthday to Millbury and turned to Kevin Krassopoulos to play a citation that was read by Congressman McGovern in the House of Representatives. This weekend is the birthday party and the parade is on the 23rd.

DPW Director Rob McNeil spoke regarding the new Transfer Station Rules and Regulations- stickers are on sale on Saturday’s this June. Registrations must be in the resident’s name, not a business, trust or other name. There is a suggested new charge for furniture of $50.00. He researched this fee with area furniture stores, Rotman’s takes old furniture away, Bernie and Phyl’s charges $50.00, and Jordan’s does not take old furniture away. We would still like to take this furniture but we need to charge a fee because we do not want to encourage excess use. We have clarified our recycling identifying what is able to be recycled and have highlighted textile recycling. We have divided brush chipping into the spring and fall and have posted the dates on the regulations and have listed items that we do not accept. Unused or expired prescriptions can be dropped off at the police station 24/7 and soon they will also have a sharps container. The Board of Health will have a list of private haulers that will do house cleanouts. New stickers are yellow and on sale now. Selectman Cristo said that zero sort is a great idea; having been educated they recycle a lot more. Mr. McNeil said that the past two months we have continued trending down with tonnage, which means recycling is up. We will be introducing compactors for the recycling and a new traffic flow will be in place hopefully within the year. Selectman Cristo asked about the fee for furniture: She would like one piece of furniture for free for each household per year. Acting Chairman King is concerned about the high fee to start- he understands it is needed but is worried about the amount. Selectman Krumsiek said that they can donate furniture to Big Brother or Salvation Army for free. Mr. McNeil agreed that there are alternatives citizens can use. Selectman King asked about other appliances. Mr. McNeil said that they have expanded their crt collection. Refrigerators are still not accepted as they require the freon being disposed of and we are not equipped for that. Selectman Ashmankas asked what is going up top where the existing roll offs are now. Textile recycling, Boy Scouts bottles/cans and steel will be up top. The other recycling will be down. There is a concept plan in his office if you would like to look at it.

Motion to approve the Transfer Station Rules and Regulations for FY14 with the exception of a charge of $25/ per each piece of furniture made by Selectman Ashmankas, seconded by Selectman Krumsiek. Motion carried unanimously.

Public Hearing notice read into record by Selectman Ashmankas seconded by Selectman Krumsiek. Transfer of License of Roberts Package Store to Steve Tran Steve Tran is looking to purchase Roberts Package Store, 123 Main Street. He currently has convenience store in Whitinsville. He has recommendation letters from Northbridge Police. Selectman Cristo asked about the purchase price of the License on the Purchase & Sale Agreement. Mr. Tran explained that the license is an asset that is part of the agreement. The ABCC does allow this. Motion to approve the transfer of license made by Selectman Ashmankas, seconded by Selectman Krumsiek. Motion carried unanimously. Motion to close public hearing made by Selectman Cristo, seconded by Selectman Ashmankas. Motion carried unanimously.

Chief Kenny Howell announced the Stanton Foundation granted Millbury $25,000 for startup of the K-9 unit. He would like to thank Officer Daly for doing the work. The dog will be trained as a drug sniffing dog; we will see him on the streets in October/November time frame. Selectman Ashmankas read a letter for a donation to the k-9 program of $1000 from Gorettis. Motion to accept the donation made by Selectman Ashmankas, seconded by Selectman Cristo. Motion carried unanimously. Selectman Ashmankas read a letter from Chief Howell regarding the $25,000 from the grant Stanton Foundation asking for acceptance. Motion to accept the grant made by Selectman Ashmankas, seconded by Selectman Cristo. Motion carried unanimously.

Letter from Chief Howell regarding NO Parking on streets listed for July 3, 4 and raindate of 5.*see attached list. Motion to approve the NO parking made by Selectman Ashmankas, seconded by Selectman Cristo. Motion carried unanimously.

Chief Howell is hoping that by the end of the month he should be appointing someone as Sergeant to fill Sgt. Hall’s position and a new officer lateral transfer.

New Drainlayer- Mitch Gill he represents Boucher Construction Corp. They have been in business since 1959. They are doing work on the former Millbury Savings Bank site for Tractor Supply Company. They built Tractor Supply in Leominster and have done many residential, commercial, industrial and retail sites; they employ 45 people. Everything is done in house. Motion to approve the new drainlayer license made by Selectman Cristo, seconded by Selectman Krumsiek. Motion carried unanimously.

One Day Liquor License- Struck Catering at Fidelity Bank on June 12, 2013 Motion to approve the One Day License made by Selectman Cristo, seconded by Selectman Krumsiek. Motion carried unanimously.

BOARD OF SELECTMAN APPOINTMENTS

Town Counsel- Hold by Selectman Ashmankas

Board of Appeals Motion to reappoint Glen Hand and appoint Gary Schold and appoint Anna Lewandowski as an Alternate for the Board of Appeals made by Selectman Ashmankas, seconded by Selectman Krumsiek. Motion carried unanimously. Mr. Valentino spoke to thank Dan Mezinski for his years on the Board. He would like Gary Schold be appointed as a member and Anna Lewandowski as Alternate 2. Robert Simminaro is Alternate 1.

Conservation Commission Motion to reappoint Donald R. Flynn and Paul T. DiCicco to the Conservation Commission made by Selectman Ashmankas, seconded by Selectman Krumsiek. Motion carried unanimously.

Historical Commission Motion to reappoint Cynthia K. Burr to the Historical Commission made by Selectman Ashmankas, seconded by Selectman Cristo. Motion carried unanimously.

Liquor License Agents Motion to appoint Chief Kenny A. Howell, Sgt. Donald Desorcy, Sgt. Stephen McFaul, Sgt. Brian Lewos as Liquor License Agents made by Selectman Ashmankas, seconded by Selectman Cristo. Motion carried unanimously.

Blackstone Valley Regional Economic Development Council Motion to appoint Robert Spain to the BVREDC made by Selectman Ashmankas, seconded by Selectman Krumsiek. Motion carried unanimously.

Central Mass Metropolitan Planning Organization (MPO) From Central Mass. Regional Planning Commission - Southeast Sub Region Motion to appoint Francis King, Alternate Representative made by Selectman Ashmankas, seconded by Selectman Cristo. Motion carried unanimously.

Central Mass Regional Planning Commission CMRPC Motion to appoint as 2nd Delegate – Sandy Cristo and Alternate Delegate – Brian Ashmankas, made by Selectman Krumsiek, seconded by Selectman Ashmankas. Motion carried unanimously.

Board of Fire Engineers Motion to reappoint David Rudge, Jeffrey A. Dore, Richard Hamilton, Raymond E. Hobin, Jr., and Brian K. Gasco as Fire Engineers made by Selectman Ashmankas, seconded by Selectman Cristo. Motion carried unanimously.

Motion to appoint Steven Piscitelli as a Fire Engineer effective July 1, 2013 made by Selectman Ashmankas, seconded by Selectman Cristo. Motion carried unanimously.

Forest Fire Warden Motion to reappoint David Rudge as Forest Fire Warden made by Selectman Ashmankas, seconded by Selectman Krumsiek. Motion carried unanimously.

Deputy Forest Fire Wardens Motion to reappoint Raymond Hobin Jr., Richard Hamilton, Brian Gasco as Deputy Forest Fire Wardens made by Selectman Ashmankas, seconded by Selectman Cristo. Motion carried unanimously.

Council on Aging Motion to reappoint Steve Walinsky, Richard Townsend, Stuart Mulhane, Margaret Masmanian, and Marie Kosiba to the Council on Aging made by Selectman Ashmankas, seconded by Selectman Cristo. Motion carried 3-0-1 (Selectman King abstained)

Earth Removal Board Motion to appoint Mary Krumsiek to the Earth Removal Board made by Selectman Ashmankas, seconded by Selectman Cristo. Motion carried unanimously.

Roadway Advisory Committee Motion to reappoint Barry Lorion, Vinod Kalikiri and Frederick A. Moseley to the Roadway Advisory Committee made by Selectman Ashmankas, seconded by Selectman Krumsiek. Motion carried unanimously. Selectman Ashmankas mentioned that there are two openings on the Roadway Advisory Committee.

4 Selectmen Meeting 6/11/2013

Selectman Ashmankas asked to be 2nd alternate to Youth Commission- Mr. Spain appointed Selectman Ashmankas as the 2nd alternate to the Youth Commission Motion to concur with appointment by Selectman Krumsiek, seconded by Selectman Cristo. Motion carried unanimously.

Selectman Ashmankas said that the Worcester County Selectmen Association had their first meeting where they amended the bylaws and they would like to have an alternate delegate. Selectman Ashmankas does not foresee anyone else needing to attend as he is on the Board and will attend all meetings. Selectman King appointed E. Bernard Plante as alternate delegate to the Worcester County Selectmen Association, seconded by Selectman Krumsiek. Motion carried unanimously. Selectman Ashmankas would like to invite the Board to next meeting on June 20th at the Sturbridge Town Hall.

A letter from Amy Peterson regarding a 61A Right of First Refusal for a piece of land on Stowe Road for a buildable lot of approximately 2 acres. This is an agricultural piece of land and the land would be of no use to the town. Motion to refuse the land made by Selectman Ashmankas, seconded by Selectman Krumsiek. Motion carried unanimously.

Previous Minutes: Motion to approve minutes of the meeting for May 28, 2013 made by Selectman Ashmankas, seconded by Selectman Krumsiek. Motion carried unanimously.

Town Manager Report: Mr. Spain is appointing Jose Castillo as a friend visitor/outreach worker for the Senior Center. Motion to concur with the appointment made by Selectman Cristo, seconded by Selectman Krumsiek. Motion carried unanimously.

Mr. Spain is appointing Brian Iadarola as head custodian to fill Phil Day’s position. He is currently the custodian at the Senior Center. Motion to concur with the appointment made by Selectman Cristo, seconded by Selectman Krumsiek. Motion carried unanimously.

TOWN MANAGER APPOINTMENTS Mr. Spain is reappointing Assistant Town Accountant, Katie Lavallee. Motion to concur with the appointment made by Selectman Krumsiek, seconded by Selectman Ashmankas. Motion carried unanimously.

Mr. Spain is reappointing Wayne Nadeau to the Parks Commission. Motion to concur with the appointment made by Selectman Krumsiek, seconded by Selectman Ashmankas. Motion carried unanimously.

Mr. Spain is reappointing Gilbert Picard to the Cemetery Commission. Motion to concur with the appointment made by Selectman Krumsiek, seconded by Selectman Cristo. Motion carried unanimously.

Mr. Spain is reappointing Stewart L. Barden, Todd E. Army and Jude T. Cristo as Constables. Motion to concur with the appointment made by Selectman Krumsiek, seconded by Selectman Ashmankas. Motion carried 3-0-1 (Selectman Cristo abstained).

Mr. Spain is reappointing Jeffrey Murawski as a Sewer Commissioner. Motion to concur with the appointment made by Selectman Krumsiek, seconded by Selectman Ashmankas. Motion carried unanimously.

Mr. Spain is reappointing Daniel Chauvin as Animal Control Officer/Inspector of Animals. We will be doing an IMA with Sutton regarding this position. Motion to concur with the appointment made by Selectman Krumsiek, seconded by Selectman Ashmankas. Motion carried unanimously.

Mr. Spain is reappointing Sandra J. Cristo and Armand White to the Asa Waters Task Force. Motion to concur with the appointment made by Selectman Krumsiek, seconded by Selectman Ashmankas. Motion carried 3-0-1 (Selectman Cristo abstained)

Mr. Spain is reappointing Roger Sabourin of Wheelabrator Certified Weigher. Motion to concur with the appointment made by Selectman Krumsiek, seconded by Selectman Cristo. Motion carried unanimously.

Mr. Spain is reappointing Ronald Valinski as the Sealer of Weights and Measures. Motion to concur with the appointment made by Selectman Krumsiek, seconded by Selectman Ashmankas. Motion carried unanimously.

Mr. Spain is reappointing Mark Palin and Jay Massei to the Dorothy Pond Restoration Committee. Motion to concur with the appointments made by Selectman Krumsiek, seconded by Selectman Ashmankas. Motion carried unanimously.

Mr. Spain is appointing Edward A. Cote as the Fire Department Photographer. Motion to concur with the appointment made by Selectman Ashmankas, seconded by Selectman Cristo. Motion carried unanimously.

Mr. Spain is reappointing Gregory Gauthier as the Plumbing and Gas Inspector and Brian Gasco as the Assistant Plumbing and Gas Inspector. Motion to concur with the appointment made by Selectman Krumsiek, seconded by Selectman Ashmankas. Motion carried unanimously.

Mr. Spain is reappointing Paul DiCicco and Robert D. Sullivan to the Cable TV Committee. Motion to concur with the appointment made by Selectman Krumsiek, seconded by Selectman Ashmankas. Motion carried unanimously.

Mr. Spain would like to thank all of his department heads-he is very blessed with his staff.

On June 18th is the Special Town Meeting- we had to make some extremely difficult cuts this year. The economy is not getting better- costs going up and revenue is not. We tried to maintain the great service but it is getting extremely difficult. There was a cut in the Town Manager/BOS office-Joyce will be moved to assist Kevin in Cable Access. He tries to cut empty positions, and was able to in the Senior Center, DPW and Police. The school department had to make similar cuts; they had to cut over $200,000. Our employees stepped to the plate again and made changes

8 Selectmen Meeting 6/11/2013 to the health insurance plan. There will be higher co-pays but it saved $109,000. He would like to thank employees for stepping to the plate, again.

Please come to town meeting at 7:00 on June 18th. It should be a fairly quick meeting, there are only 7 articles.

Congratulations to our Assessor- Sandy Genna who got certified from the MA Association of Assessing Officers.

Negotiations are moving right along- teachers is done and police we already have a tentative agreement; the police was probably one of the fastest agreements completed. DPW is almost done.

We received a call from Colleen Gardner of National Grid and they are working on fixing the double poles in town, they are working with the other utilities to get them all removed. National grid fixed the light poles at Washington Park, Thank you to them.

Selectman Krumsiek asked Mr. Spain to explain why the dog, Gino, is still in the custody of the owners. It is the law that if appealed they get to keep the dog until the hearing is determined. The hearing at the Worcester District Court is set for June 26, 2013.

New/Old Business: Selectman Krumsiek spoke regarding new selectman training that she and Selectman Cristo went to through the MMA on Saturday and it was very informative.

Acting Chairman King read DATES TO REMEMBER; Bicentennial B-Day at Asa Waters Mansion on June 15, 2013 12 pm – 7 pm Special Town Meeting at High School on June 18, 2013 – 7:00 pm Bicentennial Parade on Sunday June 23, 2013 1 pm Special State Election June 25, 2013 Vote 7 am – 8 pm Annual Carnival hosted by Millbury Lions Club at Windle Field June 28 - July 4 July 3 & July 4 Annual Fireworks display @ Windle Field @ 9:45 PM

Selectman Ashmankas explained the goings on for the Bicentennial Birthday Party. He read a proclamation from Millbury Ohio and a letter from President Barack Obama which will be kept in the Town Clerk’s office.

On a Good Note: The Bicentennial Film Festival; there were 7 entries. It was a great show! Thanks to Jim Perry of the Elm Theater who hosted the festival.

Congratulations to Officer Matt McGrath and his wife Katie to their new addition- Lochlan James McGrath!

9 Selectmen Meeting 6/11/2013

Mail: Letter from Laurie Connors, Town Planner regarding a Woolie World donation from the Women’s Club in the amount of $2,000. Motion to approve the donation made by Selectman Krumsiek, seconded by Selectman Ashmankas. Motion carried unanimously.

Mr. Spain has to commend Laurie on the job that she is doing on Woolie World. She still needs volunteers. It is coming along great!

Donation to Fire Department of $250 from Robert and Cheryl Simmler. Motion to approve the donation made by Selectman Krumsiek, seconded by Selectman Ashmankas. Motion carried unanimously. BA Mk

Letter from the Parks Commission regarding the 4th of July Road Race. Motion to approve the race made by Selectman Krumsiek, seconded by Selectman Ashmankas. Motion carried unanimously.

Don’t forget the Special Town Meeting June 18th.

Citizen Speak: John Bergeron- 12 Elmwood Street. He spoke regarding the beaver problems that are taking over the 146 area and causing flooding to his yard. Mosquitos will be plentiful.

Mr. Spain explained that the town unfortunately cannot do anything for him. The landowner has to fix the problem as they are responsible. Mr. Bergeron said that one side is owned by the State and the other side is private property. The State has looked but looked at the wrong side. IT was suggested that he try to petition to the Conservation Commission to trap the beavers and break up the damn.

Selectman King said that Chairman sends his regrets to the b-day party! Please everyone enjoy the 200th birthday! Enjoy the parade! Happy Birthday Millbury!

Mr. Spain said that Joyce Sampson will be moving over to help Kevin at Public Access and he would like to publically thank her for all the hard work and efforts.

He also said that he is changing the title of the municipal secretary to executive assistant to the Town Manager and Board of Selectmen to more reflect her duties.
