BYOB RESTAURANT LICENSE APPLICATION. DATE: ______PERMIT #:______Pennsburg Borough Council, through Ordinance # 1-2010 has required the licensing of BYOB establishments that advertise, encourage and promote their business as a BYOB establishment. This Application is required to be submitted on an annual basis, along with a fee in the amount of $100.00. Return completed application and fee to the Pennsburg Borough Office on an annual basis before January 31st of each year.

Please attach a copy of the general liability insurance declaration sheet which should provide the minimum requirements: (a) General aggregate: One Million Dollars ($1,000,000.00); (b) Products and completed operations aggregate: ($1,000,000.00); (c) Each occurrence: One Million Dollars ($1,000,000.00); (d) Fire damage: Fifty Thousand Dollars ($50,000.00); (e) Worker’s compensation: statutory requirements.

By signing this Application, the parties are verifying that the information contained in this Application is true and correct; and further verifies that he Applicant has received a copy of the Rules and Regulations associated with BYOB Restaurants. By signing this Application, Applicant will agree to all terms and conditions set forth in this Ordinance and further will advise and educate the employees, waiters, waitresses and all other staff of these requirements.

BYOB RESTAURANT RULES & REGULATIONS

1. The hours of operation that permit the consumption of alcoholic beverages shall be limited between the hours of 4:00 p.m. and 10:00 p.m.

2. Areas where patrons may consume alcoholic beverages shall be restricted to the interior of the portion of the subject property and specifically on areas that are designated on the sketch plan of the BYOB Restaurant. No BYOB will be permitted to the exterior of the subject property.

3. All BYOB Restaurants shall be annually inspected to ensure that all code requirements are satisfied, which will include, but not be limited to lighting, accessibility.

4. No server, waiter, or waitress under the age of eighteen (18) shall be permitted to provide service to patrons that are consuming alcoholic beverages.

5. The owner of the property shall specifically authorize or permit the use as a BYOB Restaurant.

6. A valid license must be displayed at all times on the premises.

7. There shall be no excessive noise or other nuisances and the conduct within the BYOB Restaurant will otherwise comply with all applicable ordinances.

8. Consumption of alcoholic beverages shall take place only in the areas permitted under the license.

9. The operation of the BYOB Restaurant shall comply with all other ordinances of Pennsburg Borough and Commonwealth of Pennsylvania.

10. There shall not be more that two (2) police calls for disturbance violation calls generated from the BYOB Restaurant within any six (6) month period.
