MINUTES OF COMBINED COMMISSION WORKING AND REGULAR SESSION MEETING HELD MARCH 10, 2014 BEGINNING AT 9:00 A.M. IN CONFERENCE ROOM #1, IN DUCHESNE, UTAH

Present Commission Chairman Ronald Winterton; Commissioner Kent R. Peatross, Commissioner Kirk J. Wood, Public Works Director Glen Murphy, Deputy County Attorney Jared Tingey, Deputy County Attorney Tyler Allred and BobbiJo Casper taking minutes of the meeting.

Public Works/Road Department Update Director Murphy reported that the Road Department is working on the Roseanne Ellis Road (CR 343) north of Duchesne. Once they are done, they will put it out for bid to have it oiled. After that, they will go back to Mortensen Lane.

Director Murphy also reported that UDOT is concerned about potholes on the North Fork Road so Mike Casper and Clint Curtis are going to look at that road today. There is a meeting with the Forest Service tomorrow and Dallas Perank with the Bureau of Indian Affairs will be in attendance. Chairman Winterton stated that on the Yellowstone and Rock Creek Roads, all of the bad spots are Tribal. He also stated that Mr. Perank is willing to work together to get these roads fixed and he is willing to contribute 40 truckloads of gravel towards these projects.

Discussion Of Invoices From Moon Lake Electric Association Director Murphy stated that the bill on the Dye Dugway will be paid by SSD #2. Chairman Winterton stated that the other bill is a result after a part was changed in a transformer at the Administration Building that was out and now they are billing us for the past three years. Commissioner Peatross stated that we paid for the transformer up front when it was put in, but it appears that the correct usage wasn’t billed. Chairman Winterton requested Director Murphy to discuss this with Moon Lake, because they aren’t sure this is the county’s responsibility.

Consideration Of An Application For Grant Of Easement For Right-Of-Way For The Facility Corridor On BIA-Administered Government Land South And East Of Lake Boreham/Midview Reservoir Chairman Winterton stated he attended a meeting last week and this was discussed. This needs to be signed before they can move forward with the application. The easement shows that we have a right of way for that road. It has been identified as a facilities corridor and they will give us fifty (50) years. Commissioner Wood motioned to authorize Chairman Winterton to sign these documents. Commissioner Peatross seconded the motion. All commissioners voted aye and the motion passed.

Discussion Of Property Taxes Treasurer Colene Nelson & Brandy Murray joined the meeting at 9:34 A.M… Mrs. Murray stated that her husband Cleveland is a member of the Ute Tribe who had a loan through the tribe, but didn’t know he had to pay the taxes once he paid the house off. She is asking for some time to get the taxes paid. Treasurer Nelson stated that there were houses that were paid in lieu of for low income tribal members that paid the taxes until the homeowner paid the debt and then it’s their responsibility. All commissioners agreed to allow more time and asked Treasurer Nelson to give Mrs. Murray payment coupons.

Ruth Roberson joined the meeting via telephone at 9:43 A.M…

Ms. Roberson stated that she attended a commission meeting last year and was given a twelve (12) month deferral so her property didn’t go on last year’s tax sale. There were renters in the home who destroyed it and she now has a full time job and is trying to get ahead. Chairman Winterton stated that we were able to give you a deferral last year and unless this is paid before the tax sale, it will be auctioned.

Consideration Of A Draft Letter Regarding The Big Springs Road Paving Project County/Community Planning Administrator joined the meeting at 9:51 A.M… Administrator Hyde stated that this letter is in regards to the Big Springs Road in Uintah

Combined Working & Regular Commission Meeting March 10, 2014 Page 1 of 3 Canyon. Our letter to the Forest Service supports the project being done by the Ute Indian Tribe. This project will reduce dust in the area and have little disturbance to the surface; this will be very beneficial. All commissioners approved to send the letter.

Consideration Of Vouchers The commission reviewed vouchers # 127517 through 127653 dated March 10, 2014 in the amount four hundred thirty eight thousand eight hundred two dollars and twenty eight cents ($438,802.28). Commissioner Peatross motioned to approve the vouchers. Commissioner Wood seconded the motion. All commissioners voted aye and the motion passed.

Consideration Of A Business License Application For Central Utah Welding & Fabrication Commissioner Wood motioned to approve the business license application as presented. Commissioner Peatross seconded the motion. All commissioners voted aye and the motion passed.

Consideration Of A Business License Application For Marshall’s Tires Deputy Clerk Sweat stated that this application hasn’t been approved by the Planning and Zoning Department and requested that it be postponed. This business license was postponed by general consent.

Consideration Of A Request For A Water Pipeline Easement And Surface Damage Right Of Way Settlement Agreement For Duchesne County Water Conservancy District Chairman Winterton stated that we discussed this a few weeks ago, but we were waiting for a map prior to approval which we now have. Commissioner Wood motioned to approve the request from Duchesne County Water Conservancy District. Commissioner Peatross seconded the motion. All commissioners voted aye and the motion passed.

Consideration Of Minutes For Combined Commission Meeting Held February 24, 2014 Commissioner Wood motioned to approve the minutes with the necessary amendments. Commissioner Peatross seconded the motion. All commissioners voted aye and the motion passed.

Discussion With S Works Regarding A Camera Contract At The County Fairgrounds IS Department Director Kent Ogletree & Frank Linthorst owner of S Works joined the meeting at 10:36 A.M… Mr. Linthorst stated that the last time he met with the commission he talked about the challenges that he had at the fairgrounds. The problem is with where Duchesne City’s connection is and he has a plan to keep the connections separate. He would like to offer a proposal that he has tested and is confident that it will work.

Commissioner Peatross stated that we have a history of Mr. Linthorst being non responsive to emails and phone calls and postponing other meetings with the commission. He recalls that the last thing Mr. Linthorst was going to do was submit a proposal to them months ago and never did. His bottom line is that he is not happy with how things have gone and is not comfortable with entering into another agreement with S Works based on the past performance.

Mr. Linthorst stated that he understands that Director Ogletree has a job to do and so does the commission and that some of Director Ogletree’s delay on this was his caution of entering into the same connection with Duchesne City. He hasn’t taken anything off of the pole and he worked on it during the County Fair and prior, but he kept getting told different things to do than what was in the contract. We all need to work together. He presented the attached map of where the connection will be from the fairgrounds which will be a direct connection that he has tested and is very strong. He could set it up so you could try it and test it and Director Ogletree could maintain it with his coordinated effort, but we need to share the

Combined Working & Regular Commission Meeting March 10, 2014 Page 2 of 3 frequencies in this area. There are frequencies that are reserved for government entities and emergency services. There are restrictions that he has to comply with and it takes coordination with Duchesne City.

Commissioner Peatross stated that we need to work with the city so we don’t interrupt them. Our uses will quadruple in the future due to the fact that we plan to build an event center at the fairgrounds and suggested that they go into closed session and ask Mr. Linthorst to wait in the hall to discuss this further.

Mr. Linthorst gave a brief explanation of what he proposes and suggested having a point to point connection to the livestock barn from the Library which would be 24 gigahertz of frequencies that aren’t being used. This would be a discreet connection that would fill internet and camera needs. The red triangles on the proposed map are where the cameras are. The challenge is with the pink triangles which are city cameras that shoot radios from the ballpark restroom to the water tank where the lighting had caused problems with the frequency. The green lines are where we would reconfigure the radios. The blue connection is 1.4 gigahertz of bandwidth that he has tested. He is willing to do this to see if you like it and can have done within four weeks or less. Thirty to forty megabytes is all you would need for what you are doing now. Director Ogletree would be able to maintain it or he is willing to do so. Mr. Linthorst is willing to enter into a maintenance agreement.

Closed Meeting – Commissioner Peatross moved to go into and out of closed session for the purpose of discussing pending or reasonably imminent litigation issues at 11:07 A.M. Commissioner Wood seconded the motion. All commissioners voted aye and the motion passed.
