"Grace, mercy, and peace from God the Father and Christ Jesus our Lord" (1 Tim 1:2). With fraternal affection I warmly welcome you, the Bishops of Scandinavia. Your first visit ad Limina Apostolorum in this new millennium is an occasion to renew your commitment to proclaim ever more courageously the Gospel of Jesus Christ in truth and love. As pilgrims to the tombs of the Apostles Peter and Paul, you "come to see Peter" (cf. Gal 1:18) and his collaborators in the service of the universal Church. You thus confirm your "unity in the same faith, hope and charity, and more and more recognize and treasure that immense heritage of spiritual and moral wealth that the whole Church, joined with the Bishop of Rome by the bond of communion, has spread throughout the world" (Pastor Bonus, Appendix I, 3). 2. As Bishops, you have been endowed with the authority of Christ (cf. Lumen Gentium, 25) and entrusted with the task of bearing witness to his saving Gospel. The faithful of Scandinavia, with great expectation, look to you to be steadfast teachers of the faith, selfless in your readiness to speak the truth "in season and out of season" (2 Tim 4:2). By your personal witness to the living mystery of God (cf. Catechesi Tradendae, 7), you make known the boundless love of him who has revealed himself and his plan for humanity through Jesus Christ. -

Stabile* INTRODUCTION My writing in recent years has explored the question o f what Catholic social thought and Catholic legal theory add to our considera- tion of various legal questions. That project proceeds from the premise that faith and religion are not to be relegated to church on Sunday (or temple on Saturday, or other equivalents); rather, faith and religion are relevant to our actions in the world. 148 Catholic Education / December 2008 The Catholic School According to the Code of Canon Law Zenon Cardinal Grocholewski Prefect of the Congregation for Catholic Education For close to three decades, his Eminence Zenon Cardinal Grocholeski, worked at the Supreme Tribunal of the Apostolic Signatura as notary, chancellor, secre- tary and prefect. A professor, scholar, and canonist of exceptional ability, he is considered one of the world’s most prominent experts on the Code of Canon Law. In light of his competence and experience, The Servant of God Pope John Paul II, appointed his Eminence as Prefect of the Dicastery for Catholic Education in 1999. This rare combination and manifestation of intellect, expertise, and dedication is witnessed in the oration presented for publication, The Catholic School According to the Code of Canon Law delivered by His Eminence, as Prefect of the Congregation of Catholic Education on May 28, 2008 at Fordham University, New York. Instruction The pastoral conversion of the Parish community in the service of the evangelising mission of the Church Introduction 1. The ecclesiological reflection of the Second Vatican Council, together with the considerable social and cultural changes of recent decades, has resulted in various Particular Churches having to reorganise the manner in which the pastoral care of Parish communities are assigned. This has made it possible to initiate new experiences, enhancing the dimension of communion and implementing, under the guidance of pastors, a harmonious synthesis of charisms and vocations at the service of the proclamation of the Gospel, which better corresponds to the demands of evangelisation today. Pope Francis, at the beginning of his Petrine ministry, recalled the importance of “creativity”, meaning thereby “seeking new ways”, that is “seeking how best to proclaim the Gospel”; in respect of this, the Holy Father concluded by saying, “the Church, and also the Code of Canon Law, gives us innumerable possibilities, much freedom to seek these things”[1]. 2. The situations outlined in the following Instruction, represent a valuable opportunity for pastoral conversion that is essentially missionary. Parish communities will find herein a call to go out of themselves, offering instruments for reform, even structural, in a spirit of communion and collaboration, of encounter and closeness, of mercy and solicitude for the proclamation of the Gospel. Every Sunday we profess our faith in “One, Holy, Catholic and Apostolic Church.” What is the “Apostolic Church?” If you broke the first century into thirds, the first one third had to do with the life, teaching and miracles of Jesus. The second one third had to do with the mission of the Apostles, the transmission of the teaching of Jesus. The final one third of the first century had to do with the committing of that teaching of Jesus, handed on by word of mouth by the apostles, 30 – 60 A.D., to writing. The Gospels are the written down oral teaching of the Apostles. The “Apostolic Church” was the period immediately after the Ascension of Jesus into heaven. The best day-to-day record of the Apostolic Church is contained in Luke’s Acts of the Apostles. -

Academic Freedom in Classroom Speech: A Heuristic Model for U.S. Catholic Higher Education Richard M. Jacobs, OSA, Ph.D. Abstract As the nation’s Catholic universities and colleges continually clarify their identity, this article examines academic freedom in classroom speech, offering a heuristic model for use as board members, academic administrators, and faculty leaders discuss, evaluate, and judge allegations of misconduct in classroom speech. Focusing upon the practice of academic freedom in classroom speech, this article aims to map this contested terrain for board members, academic administra- tors, and faculty leaders in U.S. Catholic higher education. More substantively, this article identifi es what forms of classroom speech are allowed and disal- lowed, and why this is so. Identifying the Terrain: Institutional Religious Mission and Academic Freedom In the decades following Vatican II, the interface of institutional mission and academic freedom has fi gured prominently in debate at all levels of U.S. Catholic higher education. What this debate has clarifi ed are two very different understandings of institutional mission and defi - nitions of academic freedom. With great joy I greet you, the Pastors of the Church in the States of Colorado, Wyoming, Utah, Arizona and New Mexico. Your ad Limina visit, by bringing you to "see Peter" (cf. Gal 1:18) is meant to be, in the life of the particular Churches over which you preside, an opportunity "to strengthen unity in the same faith, hope and charity, and more and more recognize and treasure that immense heritage of spiritual and moral wealth that the whole Church, joined with the Bishop of Rome by the bond of communion, has spread throughout the world" (Pastor Bonus, Appendix I, No. 3). In this series of meetings with the Bishops of the United States, I have emphasized that the faithful and committed implementation of the teachings of the Second Vatican Council is the path indicated by the Holy Spirit for the whole Church to prepare for the Great Jubilee of the Year 2000 and the beginning of the new Millennium. The renewal of Christian life which was at the forefront of the Council's work is the same goal which guided Pope John XXIII to advocate a revision of the Code of Canon Law (cf. Address to Roman Cardinals, January 25, 1959), a desire reaffirmed by the Council Fathers (cf. Christus Dominus, 44). After much labor this revision bore fruit in the new Code of Canon Law promulgated in 1983 and the Code of Canons of the Eastern Churches promulgated in 1990. -

The Application for Ex Corde Ecclesiae for the United States Decree of Promulgation On November 17, 1999, the Catholic Bishops of the United States, meeting in Plenary Session of the National Conference of Catholic Bishops, approved The Application of Ex corde Ecclesiae for the United States implementing the Apostolic Constitution Ex corde Ecclesiae, according to the norm of law. The action was granted recognitio by the Congregation for Bishops in accord with article 82 of the Apostolic Constitution Pastor Bonus and issued by Decree of the Congregation for Bishops signed by His Eminence Lucas Cardinal Moreira Neves, Prefect, and His Excellency Most Reverend Francisco Monterisi, Secretary, and dated May 3, 2000. As President of the National Conference of Catholic Bishops, I hereby decree that The Application of Ex corde Ecclesiae for the United States will be in force as particular law for the United States on May 3, 2001. The opening of Georgetown in 1789 and subsequent growth into 230 Catholic colleges and universities is a remarkable achievement for the Church and the United States. Catholic colleges and universities are related to the ecclesial community, to the higher education enterprise of the United States and to the broader society. Founded and developed principally by religious communities of women and men, they now involve lay administrators, professors and trustees who are Catholic and not Catholic—all committed to the vision of Catholic higher education.
