Due to the local state of emergency and social distancing, Commissioners participated in this meeting in a hybrid manner, via both virtual and in-person. The Board meeting was conducted under Minn. 21 -139 Approval Of Amendments To Dakota County Public Art Citizen Advisory Committee Bylaws And Selection Process And Criteria

WHEREAS, in April 2006, the Dakota County Board established a Public Art Citizen Advisory Committee; and

WHEREAS, the Dakota County Board adopted the Committee Bylaws on May 22, 2007; and

WHEREAS, the Dakota County Board revised the Committee Bylaws on January 2, 2018; and

WHEREAS, staff from Public Services and Revenue Division Administration and Committee members have reviewed the bylaws and selection criteria and recommend amendments.

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby approves such amendments.

21 -140 Adoption Of Policy 2755 Account Receivable, Nonsufficient Payment, Collecti on, And Past -Due Account Write Off

WHEREAS, debts owed to the County are collected through billing and receipting procedures; and

WHEREAS, consistent standards do not exist; and

WHEREAS, the newly drafted policy originated and developed because of a need to consistently apply debt write- off guidelines; and

WHEREAS, the Community Services has separate authority under County Resolution 97-786; and

WHEREAS, the new drafted policy sets standards for collecting money, includes definitions and statutory references, creates authority to write off debt with eight justification categories and five authorized staff levels.

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby adopts County Board policy 2755 Account Receivable, Nonsufficient Payment, Collection, and Past-Due Account Write Off.

21 -141 Authorization To Apply F or Minnesota Depa rtment Of Health Women, Infants, And Children Grant, Accept Grant Funds, And Execute Grant Agreement

WHEREAS, the Dakota County Board of Commissioners acts as the Community Health Board and has responsibility to prevent disease and disability and to promote and protect the health and safety of County residents; and

WHEREAS, the Dakota County Board of Commissioners has approved the Minnesota Department of Health Women, Infants, and Children (WIC) grant since the onset of the WIC program in Minnesota; and

WHEREAS, since 1978, Dakota County has managed the federally funded Special Supplemental Nutrition Program for the WIC Program, a voluntary program with the purpose to enhance good health care during critical periods of growth and development, prevent occurrence of health problems and improve the health status of participants; and

WHEREAS, the WIC Program has a caseload of approximately 5300 women, infants and children each month, which ensures that families with young children have access to nutrition information and education, counseling, referrals to resources available within the community and through county provided services, and food benefits

-8- 5. - Minutes.doc March 23, 2021 used to obtain health food from grocery stores who are WIC approved vendors; and

WHEREAS, the target population for the program is at risk for poorer health outcomes that impact brain and physical growth, and development and learning readiness; and

WHEREAS, the WIC grant cycle for administering a local WIC Program is for five years; however, the current grant was to end December 31,2020 but due to the pandemic, the grant cycle was extended for one more year; and

WHEREAS, the next grant cycle begins January 1, 2022, and ends December 31, 2026, and funding for the program is based on the number of participants served each month with the current rate of reimbursement being $18.00 per participant; and

WHEREAS, staff recommends that the Dakota County Board of Commissioners authorizes the Public Health department to apply for the MDH WIC grant application up to $1,300,000 per year for the period of January 1, 2022 through December 31, 2026; and

WHEREAS, Dakota County Public Health is considering using the funds to support a supervisor, two Coordinators, five Registered Dietitians (RDs), 4 part time RDs, six Nutrition Specialists and administrative staff; and

WHEREAS, staff recommends that the Dakota County Board of Commissioners authorizes the Community Services Director to accept up to $1,300,000 MDH WIC grant funds and execute the grant agreement, effective January 1, 2022 through December 31, 2026.

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the Community Services Director to apply for the Minnesota Department of Health Women, Infants, and Children grant; and

BE IT FURTHER RESOLVED, That the Dakota County Board of Commissioners authorizes the Community Services Director to accept up to $1,300,000 Minnesota Department of Health Women, Infants, and Children grant funds, and execute the grant agreement, effective January 1, 2022 through December 31, 2026; and

BE IT FURTHER RESOLVED, That unless the grant program requirements change, the Community Services Division Director is hereby authorized to amend the grant to alter the grant term, accept additional grant funds, consistent with County contracting policies and inclusion of grant funds in future yearly recommended and adopted budgets, subject to approval by the County Attorney’s office as to form.

21 -142 Authorization To Submit Grant Application To Minneso ta Department Of Health For Women, Infants, And Children Peer Mentoring, Accept Grant Funds, Execute Grant Agreement, And Add 1.25 Full-Time Equivalent Grant-Funded Staff

WHEREAS, the Dakota County Board of Commissioners acts as the Community Health Board and has responsibility to prevent disease and disability, and to promote and protect the health and safety of County residents; and

WHEREAS, breastfeeding promotion and support are a priority for the Women, Infants, and Children (WIC) Program with experts agreeing that it is the best source of nutrition for most infants, reducing the risk of certain health conditions for both infants and mothers; and

WHEREAS, the WIC Peer Breastfeeding Support Program was implemented in Minnesota in 2005 to support mothers who breastfeed and 29 counties having a Peer Breastfeeding Program currently; and

WHEREAS, Dakota County would like to launch a program where the focus is to have peer counselors

-9- 5. - Minutes.doc March 23, 2021 work with other mothers to increase breastfeeding initiation and duration; and

WHEREAS, Dakota County is looking to hire five peer counselors, who each work approximately 10 hours a week, recruited from the communities they serve, often speaking the same language and having similar life circumstances and experiences as their clients; and

WHEREAS, peer counselors are familiar with the resources available to WIC participants and the questions a new breastfeeding mother may ask, while instructed to recognize when to refer mothers to other resources when issues outside their scope of practice arise; and

WHEREAS, peer counselors are trained in the management of normal breastfeeding and in client-centered counseling skills, striving to help each mother reach her personal breastfeeding goals; and

WHEREAS, on January 27, 2021, the Minnesota Department of Health (MDH) notified the Minnesota counties of its intent to release a Request for Proposal (RFP) for application for its WIC Peer Mentoring Grant; and

WHEREAS, by April 16, 2021, Dakota County will submit its application for the MDH WIC Peer Mentoring grant RFP up to $130,000 annually with a total of up to $650,000 over the 5-year grant cycle for the period of January 1, 2022 through December 31, 2026; and

WHEREAS, Dakota County Public Health plans to use the funds to hire five peer counselors working 10 hours per week and .35 FTE WIC Coordinator time; and

WHEREAS, staff recommends that the Dakota County Board of Commissioners authorizes the Public Health Department to apply for the MDH WIC Peer Mentoring grant through the RFP process; and

WHEREAS, staff recommends that the Dakota County Board of Commissioners authorizes the Community Services Director to accept up to $130,000 annually with a total of up to $650,000 over the 5-year grant cycle for MDH WIC Peer Mentoring grant funds, effective January 1, 2022 through December 31, 2026, and execute the grant agreement.

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the Public Health Department to submit an application to the Minnesota Department of Health for Women, Infants, and Children Peer Mentoring grant through its Request for Proposal process; and

BE IT FURTHER RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the Community Services Director to accept up to $130,000 annually with a total of up to $650,000 over the 5-year grant cycle from the Minnesota Department of Health Women, Infants, and Children Peer Mentoring grant funds, effective January 1, 2022 through December 31, 2026, and execute the grant agreement; and

BE IT FURTHER RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the Community Services Director to use the grant funds of up to $130,000 annually with a total of up to $650,000 over the 5-year grant cycle to cover expenses for 1.25 full-time equivalent employees in the Public Health Department; and

BE IT FURTHER RESOLVED, That unless the grant program requirements change, the Community Services Division Director is hereby authorized to amend the grant to alter the grant term, accept additional grant funds and continue grant-funded full-time equivalents (if relevant), consistent with County contracting policies and inclusion of grant funds in future yearly recommended and adopted budgets, subject to approval by the County Attorney’s office as to form.

21 -143 Ratification Of Application For Strong Foundations Family Home Visiting Grant, And Authorization To Accept Grant Funds, Execute Grant Agreement, Add 1.0 Full-Time Equivalent Grant-Funded Employee, And Amend 2021 Public Health Budget

-10- 5. - Minutes.doc March 23, 2021 WHEREAS, the mission of the Family Health program is to prevent, promote and protect the health of mothers, infants and children, with a focus on the whole family, reaching across multiple ages, communities, settings and partners; and

WHEREAS, Public Health has a long history of providing home visiting to pregnant mothers and parenting families in the County with Public Health nurses providing assessment and intervention, and working with other home visiting staff to target specific needs of families; and

WHEREAS, family home visiting is a proven prevention strategy with measurable outcomes that should be offered to every family who meets the criteria; and

WHEREAS, the family home visiting program guides it’s work by adhering to two evidence-based models, which are The Healthy Families America (HFA) model and the new Maternal Early Childhood Sustained Home-Visiting (MECSH) model which was adopted by the Minnesota Department of Health (MDH) in 2019 and fully implemented in Dakota County on January 1, 2021; and

WHEREAS, to increase the availability of evidence-based home visiting models and to support and expand family home visiting services throughout Minnesota, MDH released a Request for Proposal for the Strong Foundations Grant of which Dakota County applied for in early February and was awarded full funding in the amount of $370,863; and

WHEREAS, the Strong Foundations Grant was competitive and is effective April 1, 2021 through December 31, 2022, with additional funding made available from the MDH to extend beyond 2022; and

WHEREAS, the goal of this grant is to support and sustain MECSH, align both the HFA and MESCH models to address the growing complexity of the family health program, and continue to show strong outcomes for families in Dakota County; and

WHEREAS, to manage the grant and provide supervision for family home visiting staff, MDH agreed to fund a 1.0 FTE Operations Manager from April 2021 through June 2021 and then a .6 FTE from July 2021 through December 2022; and

WHEREAS, the MDH will amend our current Maternal Infant Early Child Home Visiting (MIECHV) grant to fund the additional .4 FTE needed on July 1, 2021, to make the Operations Manager position whole, and staff plans to take this action to the County Board in April 2021 for authorization; and

WHEREAS, a portion of the levy funded public health nurses (PHNs) doing the work related to this grant will be offset by the Strong Foundations grant funding.

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby ratifies the application to the Minnesota Department of Health for the Strong Foundations Grant; and

BE IT FURTHER RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the Community Services Director to accept grant funds in the amount of $370,863, effective April 1, 2021 through December 31, 2022; and

BE IT FURTHER RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the Community Services Director to fund a 1.0 full-time equivalent (FTE) Operations Manager from April 1, 2021 through June 30, 2021, 1.0 FTE Operations Manager from April 2021 through June 2021 and then a .6 FTE from July 2021 through December 2022; and

BE IT FURTHER RESOLVED, That a portion of the levy funded public health nurses doing the work related to this grant and program expenses will be offset by grant funding; and

21 -144 Authorization To Amend 2021 Social Services Budget For Emergency Solutions Grant Corona virus Fu nds

WHEREAS, the Coronavirus Aid, Relief, and Economic Security (CARES) Act, enacted on March 27, 2020, appropriated $4 billion in Emergency Solutions Grant Coronavirus (ESG-CV) funds to respond to the COVID-19 pandemic; and

WHEREAS, these funds are administered by the U.S. Department of Housing and Urban Development (HUD) and must be used for activities that prevent, prepare for, and respond to the coronavirus; and

WHEREAS, because Dakota County is classified as an “urban county” (having a population over 200,000), Dakota County (the County) received a special allocation of ESG-CV funds in addition to the annual entitlement funds received by the County; and

WHEREAS, the ESG-CV funds must adhere to the original program rules in addition to addressing the impacts caused by the COVID-19 pandemic; and

WHEREAS, the Dakota County Community Development Agency (CDA) administers the entitlement ESG funds on behalf of Dakota County; and

WHEREAS, the ESG-CV funds must address the needs of individuals or families who are homeless or are at risk of homelessness because of the coronavirus and must support those eligible activities that mitigate the impacts of COVID-19; and

WHEREAS, the proposed activities include emergency shelter, rental assistance to individuals and families at-risk of homelessness, stabilization services for these same groups, costs associated with the Homeless Management Information System, and grant administration; and

WHEREAS, by Resolution No. 20-597 (December 1, 2020), the 2019 Action Plan for federal funds was amended by the Dakota County Board of Commissioners with Dakota County receiving $2,109,564 of the ESG-CV funds; and

WHEREAS, the grant agreement with HUD for the ESG-CV funds was executed on January 7, 2021, and all ESG-CV funds must be fully expended by January 6, 2023; and

WHEREAS, Dakota County Social Services will be using part of the ESG-CV allocation to fund shelter activities through 2021 and into 2022.

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby approves an

21 -145 Authorization To Respond To Request For Assessment Of Nee d/Letter Of Support From Sutton Outpatient Services

WHEREAS, under Minnesota Rule 9530.6800, the need for additional or expanded chemical dependency treatment programs must be determined, in part, based, on the recommendation of the county board of commissioners of the county in which the program will be located and the documentation submitted by the applicant at the time of application; and

WHEREAS, under Minnesota Rule 9530.6810, when an applicant for licensure for chemical dependency treatment services requests a written statement of support for a proposed chemical dependency treatment program, the county board of commissioners of the county in which the program is to be located shall submit a statement to the Minnesota Department of Human Services (DHS) Commissioner that either supports or does not support the need for the applicant’s program; and

WHEREAS, on February 3, 2021, Dakota County received a request from Robert Sutton, Owner at Sutton Outpatient Services, requesting a written statement that supports the need for the program; and

WHEREAS, local needs assessment information suggests a need for the type of chemical dependency treatment services proposed; and

WHEREAS, Dakota County is not taking any positions about Sutton Outpatient Service’s qualifications or ability to meet identified needs; and

WHEREAS, DHS will process Sutton Outpatient Service’s request for a license to provide an outpatient chemical dependency program in their location in Dakota County.

21 -146 Authorization To Amend 2021 Parks Capital Improvement Program Bu dget For Minnesota Board Of Water And Soil Resources Grant For Spring Lake Park Reserve Ravine Stabilization Project

WHEREAS, Spring Lake is a portion of Pool 2 of the Mississippi River located three miles upstream of U.S. Lock and Dam No. 2 at Hastings; and

WHEREAS, two large ravines within Dakota County’s Spring Lake Park Reserve (SLPR) are actively eroding, which has resulted in sedimentation damages to public and private property, including natural resource features within SLPR and the Mississippi River; and

WHEREAS, the Clean Water Fund is a state grant program administered by Minnesota Board of Water and Soil Resources (BWSR) and is made available to local government units annually via a competitive grant application process; and

-13- 5. - Minutes.doc March 23, 2021 WHEREAS, staff developed preliminary project plans, estimated water quality benefits and costs, and prepared a Clean Water Fund grant application to BWSR; and

WHEREAS, the proposed improvements to alleviate ravine erosion include tree removals, earthwork, riprap, storm sewer, and vegetation restoration; and

WHEREAS, by Resolution No. 20-393 (August 18, 2020), staff received authorization to submit a grant application for the Ravine Stabilization Project in the amount of $452,250; and

WHEREAS, the grant program requires a 25 percent match by Dakota County, in the amount of $113,063; and

WHEREAS, Dakota County was notified in January 2021 that the BWSR approved its grant request in the amount of $452,250; and

WHEREAS, there are sufficient funds in the 2021 Parks Capital Improvement Program budget to provide sufficient matching funds for the grant.

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby amends the 2021 Parks Capital Improvement Program Adopted Budget to reflect the anticipated revenues and expenditures associated with the Minnesota Board of Water and Soil Resources grant for Spring Lake Park Reserve Ravine Stabilization Project as follows:

WHEREAS, it is a goal of the Dakota County Board of Commissioners to maintain County ordinance regulatory authority that effectively minimizes potential negative impacts to the public’s health, safety, and welfare and the environment of Dakota County; and

WHEREAS, the Dakota County Board of Commissioners desires to amend Dakota County Ordinance No. 114, Well and Water Supply Management, for the purposes of ensuring that large groundwater appropriation requests are sustainable and limit groundwater exports in accordance with the 2020–2030 Dakota County Groundwater Plan; and

WHEREAS, Dakota County Environmental Resources Department staff, in consultation with the Dakota County Attorney’s Office and Minnesota Department of Health, have prepared amendments to Ordinance No. 114, Well and Water Supply Management; and

WHEREAS, the Dakota County Board of Commissioners wishes to make these amendments effective immediately upon adoption; and

WHEREAS, a public hearing is requested for April 20, 2021, at 9:00 a.m., to receive comments on the proposed amendments to Ordinance No. 114, Well and Water Supply Management; and

WHEREAS, meetings of the County Board are held in the Boardroom, Administration Center, 1590 Highway 55, Hastings, MN, except due to the ongoing impacts from the COVID-19 virus, the Board is conducting public

21 -148 Authorization To Execute Metro Mississi ppi East Watershed -Based Implementat ion Funding Grant Agreement And Amend Environmental Resources Department Budget

WHEREAS, watershed-based implementation funding (WBIF) is an alternative to the traditional project-by-project competitive process often used to fund water quality improvement projects; and

WHEREAS, the purpose of WBIF funding is to supplement existing funding to accelerate clean water activities (practices, projects, and programs) toward advancing Minnesota’s water resources goals through prioritized and targeted cost-effective actions with measurable water quality results; and

WHEREAS, Dakota County qualifies for this funding since it recently adopted the State-approved 2020–2030 Dakota County Groundwater Plan, authorized under Minn. Stat. § 103B.255; and

WHEREAS, Dakota County was allocated $54,274 toward executing activities identified in the implementation section of the 2020–2030 Groundwater Plan in the Metro Mississippi East Watershed; and

WHEREAS, activities funded include (1) “Smart Salt” training and certification for road maintenance, parking lots and sidewalks, and property owners and managers in collaboration with Washington County to help prevent chloride contamination and (2) cost-share grants for well sealing of unused wells; and

WHEREAS, a minimum 10 percent match is required, which is $5,428; and

WHEREAS, the grant funding expires December 31, 2023.

WHEREAS, the Dakota County Board of Commissioners adopted the Thompson County Park Master Plan and Natural Resource Management Plan by Resolution No. 20-037 (January 21, 2020); and

WHEREAS, the initial phase of Master Plan improvements is currently in final design with construction expected to begin in the Spring of 2021; and

WHEREAS, while the scope of the project intends to meet the highest priority needs, certain five-year improvements were excluded from the scope because they exceed available revenues; and

WHEREAS, among these improvements are enhancements to the park’s trail between Thompson Park Center and the River to River Greenway that would complete an accessible connection from Butler Avenue, through the park’s new central plaza and play area, to the River to River Greenway and the regional trail system beyond; and

WHEREAS, the preliminary cost estimate for the trail enhancement package is $165,000; and

WHEREAS, the Minnesota Department of Natural Resources Local Trail Connections Program provides grants to local units of government to promote short trail connections, and enhancement of the trail connection within the park aligns with the scope and funding level of the grant program; and

WHEREAS, the maximum grant award is $150,000 and would require a County match of 25 percent; and

WHEREAS, staff recommends that Dakota County apply to the Local Trail Connections Program for the enhancement of the trail connection between Thompson Park Center and the River to River Greenway.

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the submission of an application for the Minnesota Department of Natural Resources Local Trail Connections Program for an amount not to exceed $150,000 for the enhancement of the trail connection within Thompson County Park; and

BE IT FURTHER RESOLVED, That, if awarded, the Dakota County Board of Commissioners hereby authorizes the Director of Parks, Facilities, and Fleet Management to execute a grant agreement with the Department of Natural Resources, subject to approval by the County Attorney’s Office as to form; and

21 -150 Authorization For Revocation Of "Non -Existing" County State Ai d Highway 5 In City Of Burnsville

WHEREAS, By Resolution No. 11-597 (December 13, 2011), the County Board authorized execution of a joint

-16- 5. - Minutes.doc March 23, 2021 powers agreement (JPA) for County Project (CP) 5-41 with the City of Burnsville for right of way acquisition, construction, and maintenance; and

WHEREAS, in accordance with JPA No. #14633, by Resolution No. 11-597 (December 13, 2011), the City of Burnsville agreed to take possession and jurisdiction of the drainage and ponding easements, permanent right of way for city streets, and real estate interests acquired in excess of what is needed for CP 5-41 purposes; and

WHEREAS, in accordance with JPA No. #14633, the County and the City have agreed that the future connection north of Trunk Highway (TH) 13 to the Interstate 35W and County State Aid Highway (CSAH) 32 (Cliff Road) Interchange will be a local City Street; and

WHEREAS, the County must revoke a portion of Commissioners Order No. 57307 for Extension to CSAH 5; and

WHEREAS, Minn. Stat. § 162.02, subd. 10 states that CSAHs may be abandoned, changed, or revoked by joint action of the County board and the commissioner and that, if a CSAH is established or located within the limits of a city, it shall not be abandoned, changed, or revoked without the concurrence of the governing body of such city, provided that any CSAH established or located within a city may be abandoned, or revoked without concurrence if the city refuses or neglects for a period of one year after submittal to approve plans for the construction of such highway which plans conform to the construction standards provided in the commissioner’s rules; and

WHEREAS, the Transportation Director/County Engineer recommends revoking a portion of Commissioner’s Order No. 57307 for Extension to CSAH 5.

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby revokes County State Aid Status, subject to the approval of the Commissioner of Transportation of the State of Minnesota for the segments of roadway as follows:

21-151 Authorization To Execute Joint Powers Agreement With City Of Valley For County Project 99 -14, North Creek Greenway And Tunnel, County State Aid Highway 42 Multiuse Trail, In City Of Apple Valley

WHEREAS, to promote a safe and efficient transportation system throughout Dakota County, the County is the lead agency partnering with the City of Apple Valley (City) on County Project (CP) 99-14; and

WHEREAS, CP 99-14 will design and construct a segment of multiuse trail along County State Aid Highway (CSAH 42) in Apple Valley; and

WHEREAS, CP-14 will also design and construct a segment of the North Creek Greenway, including a pedestrian

WHEREAS, Dakota County is the lead agency for CP 99-14; and

WHEREAS, the City of Apple Valley is cooperating with the County on each stage of CP 99-14; and

WHEREAS, applicable elements of CP 99-14 will be shared 85 percent County funds and 15 percent City funds in accordance with adopted County Policy.

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the Physical Development Director to execute a joint powers agreement with the City of Apple Valley to identify costs and responsibilities for construction and operation of the greenway trail, pedestrian tunnel, and multiuse trail, in accordance with County policy, for County Project 99-14, in the City of Apple Valley, subject to approval by the County Attorney’s Office as to form.

21 -152 Scheduling Of Publ ic H earing For Dakota County Fiscal Year 2021 Action Pl an For Community Development Block Grant, HOME Investment Partnerships, And Emergency Solutions Grant Programs

WHEREAS, Dakota County is an Entitlement County for funds through the Community Development Block Grant (CDBG) Program and Emergency Solutions Grant (ESG) Program and a Participating Jurisdiction for the HOME Investment Partnerships (HOME) Program; and

WHEREAS, the Dakota County Community Development Agency (CDA) administers the CDBG, ESG, and HOME programs on behalf of Dakota County, thereby requiring agreements between the U.S. Department of Housing and Urban Development (HUD) and Dakota County for the CDBG, ESG, and HOME funds and between Dakota County and the Dakota County CDA for CDBG, ESG, and HOME program administration; and

WHEREAS, HUD further requires the development and submission of the Fiscal Year (FY) 2021 One-Year Action Plan that proposes allocation of the annual CDBG, HOME, and ESG funds to local governments and housing providers in the County; and

WHEREAS, CDA staff has worked with participating communities to identify CDBG, HOME, and ESG activities for FY 2021; and

WHEREAS, the proposed activities to receive HUD funds meet the housing and community development priorities identified in the approved 2020–2024 Five-Year Consolidated Plan; and

WHEREAS, the Dakota County FY 2021 CDBG allocation is $1,910,573; the Dakota County FY 2021 HOME allocation is $982,861 (Consortium total of $3,275,274) including program income; and the Dakota County FY 2021 ESG allocation is $164,454; and

WHEREAS, CDA staff recommends allocating FY 2021 CDBG funds to 25 eligible activities for the 12 cities with populations more than 10,000 with direct allocation funding, one eligible activity with competitive pool funds for cities and townships with populations less than 10,000, and five Countywide activities; and

WHEREAS, CDA staff recommends allocating FY 2021 HOME funds to three eligible activities as follows: a future affordable housing development at a site to be determined (70%), Community Housing Development Organization activities (15%), and grant administration (15%); and

WHEREAS, CDA staff recommends allocating FY 2021 ESG funds to four eligible activities as follows: rapid re- housing activities (76%), emergency shelter operations (16%), Homeless Management Information Systems (0.5%) and grant administration (7.5%); and

WHEREAS, the requested public hearing is to receive comments and inform the public on the draft Dakota County FY 2021 One-Year Action Plan that outlines the strategies and objectives for the proposed allocation of

21 -153 Authorization To Acquire Regional Greenway Corridor From Roc kport LLC

WHEREAS, by Resolution No. 11-517 (October 18, 2011), the Dakota County Board of Commissioners approved the North Creek Regional Greenway (Greenway) Master Plan; and

WHEREAS, the Greenway travels 14 miles from Lebanon Hills Regional Park in Eagan and Apple Valley south through the cities of Lakeville and Farmington to Whitetail Woods Regional Park in Township; and

WHEREAS, the Rockport LLC (Rockport) property, legally defined as “Outlot B, Orchard Place, according to the recorded plat thereof, Dakota County Minnesota,” consists of a 30-foot wide, 1,550-foot long corridor in the City of Apple Valley; and

WHEREAS, a single independent appraisal was completed by the County and Rockport for Outlot B of the Rockport LLC property and was reviewed and approved by County staff and representatives from Rockport; and

WHEREAS, Rockport is willing to sell the 1.17-acre property for the $285,000 appraised value; and

WHEREAS, the total estimated cost to acquire property from Rockport, including an estimated $5,000 for closing costs, is $290,000; and

WHEREAS, Rockport has agreed to grade the trail corridor for future paving at no cost to the County during development of the site; and

WHEREAS, it is expected that the Metropolitan Council (MC) Acquisition Opportunity Fund (AOF) program will have additional new funds available after July 1, 2021, for the County grant request; and

WHEREAS, Rockport has agreed to delay the acquisition to accommodate a County AOF reimbursement request to the MC after July 1, 2021; and

WHEREAS the Physical Development Director is required to sign the purchase agreement to acquire the Rockport property; and

WHEREAS, the 2021 Parks Capital Improvement Program (CIP) budget includes adequate fund balance for County match of MC AOF requests, and a CIP budget amendment is required; and

WHEREAS, the final acquisition costs of the Rockport property will be determined after the settlement statement is finalized and all associated acquisition expenses have been invoiced.

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the expenditure of up to $290,000, including an estimated $5,000 in closing costs, to acquire the 1.17-acre Rockport

WHEREAS, by Resolution No. 15-431 (August 25, 2015), the County Board adopted the River to River Greenway Master Plan; and

WHEREAS, by Resolution No. 16-177 (March 22, 2016), the County Board authorized a joint powers agreement (JPA) with the City of West St. Paul for a feasibility study of the River to River Greenway: Garlough/Marthaler Park segment; and

WHEREAS, by Resolution No. 20-315 (July 14, 2020), the County Board authorized a JPA with the City of West St. Paul for the final design and bid documents for the River to River Greenway: Garlough/Marthaler Park segment; and

WHEREAS, the reconstruction of the Garlough/Marthaler Park segment is a priority project along the River to River Greenway; and

WHEREAS, construction costs will be shared between Dakota County and the City; and

WHEREAS, the City of West St. Paul will provide necessary land control for Dakota County to maintain corridor as a regional greenway; and

WHEREAS, the construction bid and administration cost is $702,268; and

WHEREAS, the City of West St. Paul will contribute $150,000; and

WHEREAS, the Dakota County Board of Commissioners acts as the Community Health Board and has responsibility to prevent disease and disability and to promote and protect the health and safety of County residents; and

WHEREAS, Dakota County Public Health is managing vaccination clinic processes which include vaccine inventory and distribution, client appointment scheduling and data reporting and are providing vaccinations for priority groups identified by the Minnesota Department of Health (MDH); and

WHEREAS, the County has operated vaccination clinics at the Western Service Center and the Northern Service Center; and

WHEREAS, beginning on March 31, 2021, the clinics will be consolidated at the Metcalf Middle School (Metcalf) located at 2250 Diffley Road, Eagan, Minnesota, operating Monday, Wednesday and Thursday from 8:00 am to 4:00 pm each week thru June 30, 2021; and

WHEREAS, to provide for the safety of the public obtaining a vaccine and staff operating the vaccine clinic, the City of Eagan Police Department will provide security services during the clinics; and

WHEREAS, to provide access to a broader population in Dakota County, the County will operate a smaller vaccination clinic at the Pleasant Hill Library in Hastings on Tuesdays beginning April 13, 2021, from 9:00 am to 3:30 pm thru June 30, 2021; and

WHEREAS, to provide for the safety of the public obtaining a vaccine and staff operating the vaccine clinic, the City of Hastings Police Department will provide security services during the clinics; and

WHEREAS, depending on vaccine demand and availability the schedules for the schedules at the clinics may be adjusted; and

WHEREAS, the costs associated with security provided at the vaccination clinics are eligible for Federal Emergency Management Agency (FEMA) funding; and

WHEREAS, a service contract is necessary to establish the eligibility for FEMA fund; and

WHEREAS, the respective Police Departments will manage, control and direct the assigned law enforcement

WHEREAS, the County will pay the City of Eagan $88.50 per hour per license peace officer and the rate for the City of Hasting will be approximately $90.00 per hour per licensed peace officer; and

WHEREAS, the service contract will be in an amount not to exceed $75,000 with Eagan and $25,000 with Hastings; and

WHEREAS, the County has authority to enter into the service contracts pursuant to Minn. Stat. § 12.37.

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the County Manager to execute a service contract with the City of Eagan for provision of law enforcement services for COVID-19 vaccination clinics in an amount not to exceed $75,000, subject to approval as to form by the County Attorney’s Office; and

BE IT FURTHER RESOLVED, That the Dakota County Board of Commissioners authorizes the County Manager to execute a service contract with the City of Hastings for provision of law enforcement services for COVID-19 vaccination clinics in an amount not to exceed $40,000, subject to approval as to form by the County Attorney’s Office; and

BE IT FURTHER RESOLVED, That the service contracts shall contain a provision that allows the County to immediately terminate the contract in the event that funds from county, state, or federal sources are not appropriated at a level sufficient to allow payment of the amounts due; and

BE IT FURTHER RESOLVED, That the Dakota County Board of Commissioners authorize the County Manager to extend the service contract for either or both locations if the vaccination clinics continue to operate beyond June 30, 2021, under the same terms and conditions.

21 -161 Author ization To Execute Contract With Dakota Electric Association For Installation Of Street Lighting Along County State Aid Highway 30 For County Project 30-39 In City Of Eagan

WHEREAS, Dakota County, the City of Eagan (City), and Independent School District (ISD) 196 are partnering on County Project (CP) 30-39 (Project); and

WHEREAS, the Project includes the segment of County State Aid Highway (CSAH) 30 from approximately 1,100 feet east of CSAH 43 (Lexington Avenue) to 400 feet east of Braddock Trail; and

WHEREAS, the purpose and need for the Project is to increase pedestrian safety and connections, provide safe facilities, lower vehicle speeds, and reduce pedestrian and vehicle conflict points; and

WHEREAS, to address the purpose and need for the Project, the County is proposing to reconstruct and narrow CSAH 30 (Diffley Road) to a two-lane divided highway, construct two single-lane roundabouts at Daniel Drive and Braddock Trail, construct a new school access road, and make pedestrian improvements; and

WHEREAS, Dakota County, the City, and ISD 196 are partnering on final design for CP 30-39; and

WHEREAS, the final design includes street lighting at the proposed roundabouts along Diffley Road at Daniel Drive and Braddock Trail, two streetlights at the Diffley Marketplace crossing and pedestrian scale lighting from the Diffley Marketplace crossing to the Braddock Trail roundabout; and

WHEREAS, Dakota Electric Association has provided an estimate of $252,254.69 for installation of roundabout lighting, the lighting for the Diffley Marketplace pedestrian crossing, pedestrian scale lighting along Diffley Road in the school zone area and the necessary electrical connections (e.g., control cabinets, transformers, pedestals); and

WHEREAS, the cost participation for roundabout lighting, marked pedestrian crossing lighting, and lighting along county highway trails within school zones will be in accordance with the adopted Cost Share Policy F.17 Traffic Signal and Street Lighting Power Costs and Maintenance Responsibilities; and

WHEREAS, the County’s cost share is 85 percent ($214,416.49) and the City’s share is 15 percent ($37,838.20) of the total lighting cost; and

WHEREAS, County staff recommends executing a contract with Dakota Electric Association for installation of street lighting along CSAH 30 for CP 30-39.

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the Physical Development Director to execute a contract with Dakota Electric Association in the amount not to exceed $252,254.69 for installation of street lighting along County State Aid Highway 30 for County Project 30-39, subject to approval by the County Attorney’s Office as to form.

21 -162 Authorization To Execute Agreement With City Of Apple Valley For Traffic Signal At County State Aid Highway 31 (Pilot Knob) And 155Th Street

WHEREAS, to promote a safe and efficient operation of the highway system throughout Dakota County, the County is partnering with the City of Apple Valley for a project to install a traffic signal system at the intersection of County State Aid Highway (CSAH) 31 (Pilot Knob) and 155th Street; and

WHEREAS, installation of the traffic signal is justified and the appropriate traffic control for this intersection of CSAH 31 and 155th Street in consideration of traffic and signalized coordination along CSAH 31; and

WHEREAS, the City is the lead agency for the project to install the signal system at CSAH 31 and 155th Street; and

WHEREAS, the City will be issued a permit for CP 31-105, the installation of the traffic signal, and all other necessary geometric improvements; and

WHEREAS, the City will be responsible for all costs for design, construction, equipment, and inspection of the traffic signal installation, including County supplied materials for connection to the County fiber network; and

WHEREAS, County and City costs for power and maintenance will be in accordance with the adopted Cost Share Policy (Policy F.17 Traffic Signal and Street Lighting Power Costs and Maintenance Responsibilities), such that the County and City will each be responsible for 50 percent of the power costs of the traffic signal, including attached street lighting, and the City will be responsible for streetlight maintenance and signal painting; and

WHEREAS, in accordance with Dakota County Transportation Plan (Policy M.13), staff recommends County Board authorization to permit the City of Apple Valley to install a traffic control signal system at CSAH 31 and 155th Street for County Project 31-105; and

WHEREAS, a joint powers agreement with the City of Apple Valley is needed for signal installation and to define

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the installation of a traffic control signal system at the intersection of County State Aid Highway 31 (Pilot Knob Road) and 155th Street, in the City of Apple Valley in accordance with Dakota County Transportation Plan (Policy M.13); and

BE IT FURTHER RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the Physical Development Director to execute a joint powers agreement with the City of Apple Valley for County Project 31- 105 for the installation and maintenance of a traffic signal at the intersection of County State Aid Highway 31 (Pilot Knob Road) and 155th Street, subject to approval by the County Attorney’s Office as to form.

21 -163 Authorizati on To Award And Execute Contract With JL Theis Inc., For County Project 32 -105

WHEREAS, to provide a safe and efficient transportation system, Dakota County (County) is partnering with the City of Eagan (City) on County Project (CP) 32-105; and

WHEREAS, CP 32-105 includes traffic signal replacement and ADA improvements at the intersection of County State Aid Highway 32 and Cliff Lake / Rahn Cliff Road; and

WHEREAS, the County is lead agency for CP 32-105 with construction anticipated to begin April 2021; and

WHEREAS, the Transportation Capital Improvement Project (CIP) “Signal Project Various Locations” line item has sufficient funds for design, signal equipment and construction for CP 32-105; and

WHEREAS, the project was advertised, and four responsive bids were received and tabulated on February 23, 2021; and

WHEREAS, the bid from JL Theis Inc., in the amount of $702,961.36 was the lowest responsive and responsible bid received; and

WHEREAS, staff recommends awarding the bid to JL Theis Inc.

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby awards the bid to and authorizes the Physical Development Director to execute the contract with JL Theis Inc., for County Project 32-105, in the amount of $702,961.36 based on their low bid, subject to approval by the County Attorney’s Office as to form.

21 -164 Authorization To Execute Joint Powers Agreement With City Of Farmington For County Pro ject 50 -30, Sidewalk Improvements, In City Of Farmington

WHEREAS, to provide a safe and efficient transportation system, including intermodal transportation opportunities, Dakota County is Partnering with the City of Farmington on sidewalk improvements on County State Aid Highway (CSAH) 50 (Elm Street); and

WHEREAS, the proposed improvements include constructing new pedestrian ramps to meet American Disabilities Act (ADA) standards, removal of the direct access from CSAH 50 at the Dakota Motors building, and sidewalk removal and replacement; and

WHEREAS, the improvements are part of a larger project the City of Farmington is completing in the downtown area; and

WHEREAS, the City is the lead agency on the project; and

-25- 5. - Minutes.doc March 23, 2021 WHEREAS, the cost participation for trail and sidewalks will be in accordance with the adopted Cost Share Policy F8, Multi-Use Trails and Sidewalk Maintenance; and

WHEREAS, the County is responsible for 100 percent of the costs associated with the repair and replacement of the sidewalk; and

WHEREAS, the estimated cost of County Project 50-30 is $140,000; and

WHEREAS, staff recommends entering into a joint powers agreement (JPA) with the City of Farmington for costs associated with sidewalk improvement on CSAH 50.

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the Physical Development Director to enter into a joint powers agreement with the City of Farmington for County Project 50-30, for sidewalk construction and replacement in accordance with Dakota County’s adopted cost-share policy, subject to approval by the County Attorney’s Office as to form.

21 -165 Authorization To Execute Agreement No. 1045337 With Minnesota Department Of Transportation For Trunk Highway 316 Detour

WHEREAS, to provide a safe and efficient transportation system, Dakota County is partnering with the Minnesota Department of Transportation (MnDOT) on State Project (SP) No. 1926-22; and

WHEREAS, construction work will begin in 2021 on Trunk Highway (TH) 316, constructing three roundabouts, adding pedestrian facilities, and installing medians between the junction of TH 61 and Michael Avenue; and

WHEREAS, detours will divert TH 316 traffic onto CSAH 54 (Ravenna Trail) and CSAH 91 (Nicolai Avenue) during construction; and

WHEREAS, Minn. Stat. § 161.25 authorizes the Commissioner of Transportation to designate any public street or highway as a temporary TH detour when it is determined that such detour is necessary for the construction or maintenance of any TH; and

WHEREAS, MnDOT Agreement No. 1045337 allows the State to reimburse the County approximately $16,264 for the road life consumed by the detour based on the income determined by the “Gas Tax Method” in accordance with the Detour Management Study Final Report; and

WHEREAS, executing this agreement is necessary for the State to reimburse the County for road consumption from the detour and for the project to continue; and

WHEREAS, the $16,264 will be deposited in the Transportation Capital Improvement Program fund; and

WHEREAS, staff recommends entering into Agreement No. 1045337 with MnDOT to accept reimbursement for SP 1921-102 TH 3 detour on CSAHs 54 and 91.

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the Physical Development Director to execute Agreement No. 1045337 with the Commissioner of Transportation of the State of Minnesota for the County to receive the State’s reimbursement of $16,264 for the road life consumed by the Trunk Highway 316 detour through State Project 1926-22, subject to approval by the County Attorney’s Office as to form.

21 -167 Authorization To Execute 2021 Lease Agreement For Agricultural Use Of County Property

WHEREAS, Dakota County has historically leased portions of unimproved County-owned parkland for interim agricultural purposes until such time that it can be converted to its highest and best use according to approved master plans; and

WHEREAS, by Resolution No. 12-526 (October 23, 2012), the County Board directed staff to use a competitive sealed-bid process for leasing County-owned property for agricultural use; and

WHEREAS, the resolution authorized one-year lease terms for the initial leases and a sealed-bid leasing process, and subsequent leases may have terms up to three years; and

WHEREAS, the resolution further directed that, if the County receives no bids or receives unacceptable bids, staff was to negotiate with current tenants or others to develop one-year agricultural use leases for those sites without an acceptable bid; and

WHEREAS, all successful bids and negotiated agricultural use leases must be presented to the County Board for review and consideration; and

WHEREAS, on February 16, 2021, two bids were received for leasing County-owned property for agricultural use; and

WHEREAS, staff recommends executing a contract with the high bidder in the amount of $8,232 for the 2021 growing season.

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the Physical Development Director to execute an agricultural lease agreement with the following individual for use of specified County land at the rates, durations, and terms described, subject to approval by the County Attorney's Office, as to form: Tim Braun, for a lease on no more than 42 acres of cropland near the Empire Composting Facility (Site 6) at a rate of $196.00 per acre for a total amount of $8,232 from April 1, 2020, through December 31, 2021, with two annual options to extend in 2022 and 2023.

21 -168 Authorization To Ex ec ut e Lease Agreement With City Of Inver Grove Heights For Criminal Justice Network Office

WHEREAS, the Dakota County Criminal Justice Network (CJN) provides applications and services to integrate

WHEREAS, the Dakota County CJN Office requires secure and adequate space for CJN staff, meetings of the CJN Steering Committee, Dakota County Law Enforcement Agency Joint Powers Board, various workgroups and training activities; and

WHEREAS, since 2015, CJN has lease office space in the Inver Grove Heights City Hall; and

WHEREAS, the initial term of the current lease expired in May 2020, at which time the City and County began discussing leasing space that was formerly occupied by the Fire Department; and

WHEREAS, during this negotiation period, the City has agreed to continue the rates in the initial lease on a month-to-month basis through December 2020; and

WHEREAS, this separate suite provides secure space for CJN staff; and

WHEREAS, Dakota County desires to execute a lease with the City of Inver Grove Heights for office space for the CJN Office for a five-year term beginning on January 1, 2021; and

WHEREAS, the annual lease payment for 2021 is $12,270, which escalates 4.3 percent annually; and

WHEREAS, the initial lease payment also includes an amount of $12,336.23 for electrical and network cabling improvements required to customize the space for the CJN Office; and

WHEREAS, there are sufficient funds in the 2021 Adopted CJN budget to pay for the annual lease, and CJN funds for the electrical, and network cabling improvements.

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the Dakota County Board Chair to execute a lease agreement, substantially as presented, with the City of Inver Grove Heights for space in the Inver Grove Heights City Hall with a term beginning on January 1, 2021, for a five- year term for an annual amount of $12,270 plus a one-time payment of $12,336.23 for electrical and network cabling, subject to approval by the County Attorney’s Office as to form.

21 -169 Authorization To Execute Contract With Minnesota Department Of Public Safety For 2020 Emergency Management Performance Grant

WHEREAS, the Federal Emergency Management Agency (FEMA) and the Minnesota Department of Public Safety, Division of Homeland Security and Emergency Management (HSEM), have awarded Dakota County the sum of $171,057 in grant funding for the 2020 Emergency Management Performance Grant; and

WHEREAS, the grant period runs from January 1, 2020, through December 31, 2020; and

WHEREAS, the grant provides for 50 percent matching funds from Dakota County and those funds are included in the Sheriff’s Office Emergency Preparedness budget; and

WHEREAS, funds received from this grant reimburse Dakota for 50 percent of the salary and benefits for the Emergency Preparedness Coordinator, Emergency Operations Plan requirements, Domestic Preparedness Committee annual fees, required emergency management conference per grant requirements, and equipment and supplies.

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the Sheriff to execute a grant agreement with the Federal Emergency Management Agency (FEMA) and the

WHEREAS, the Sheriff’s Office and Minnesota State Colleges and Universities wish to enter into a joint powers agreement for the purpose of providing educational programs to jail inmates; and

WHEREAS, the Minnesota State Colleges and Universities, Dakota County Technical College will provide one two-credit course at the cost of $401.34 per enrolled student up to the total amount not to exceed $6,020.10 through the term of the contract May 31,2021.

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby authorizes the Dakota County Sheriff to execute a joint powers agreement with Minnesota State Colleges and Universities to provide educational programs to Dakota County jail inmates through May 31, 2021, subject to approval by the County Attorney’s Office as to form.

WHEREAS, by Resolution No. 21-107 (February 16, 2021), the County Board authorized the Director of Employee Relations to seek candidates for appointment to the office of County Attorney by advertising in appropriate locations for a three week period, a job posting providing the minimum qualifications, a general description of the statutory duties of the County Attorney and summary of the expected knowledge, skill and

WHEREAS, the application period closed on March 8, 2021; and

WHEREAS, the Lawshe Museum was built in 1976 and needs renovation; and

WHEREAS, the replacement of the building roof and windows is currently underway, and this work has been funded outside of the $1,200,000 provided for 2020 within the 2020–2024 Buildings Capital Improvement Program (CIP) Adopted Budget; and

WHEREAS, the building renovation would address numerous accessibility issues and adjacent construction; and

WHEREAS, County staff has proposed a balanced scope for the original $1,200,000 approved budget; and

WHEREAS, the approved budget contains $900,000 for direct accessibility requirements and then splits the remaining $300,000 equally for improvement in the office areas upstairs and the exhibit spaces on the main level affected by the new bathroom construction; and

WHEREAS, this apportionment of funds has been reviewed with and agreed to by the Museum’s Executive Director; and

WHEREAS, it has been agreed that no project funds will be spent on exhibit installation elements, but rather only building infrastructure support.

WHEREAS, County Project 26-54 will expand approximately two miles of County State Aid Highway (CSAH) 26 (Lone Oak Road in Eagan, 70th Street in Inver Grove Heights) from Trunk Highway (TH) 55 to TH 3 from an existing two-lane roadway rural section to a four-lane divided urban roadway; and

WHEREAS, County Project 63-27 will construct on a new alignment CSAH 63 (Argenta Trail) from CSAH 28 (Amana Trail) north to 65th Street and from 65th Street to old Argenta Trail (CSAH 63) to the north of CSAH 26; and

WHEREAS, the County is the lead agency for the design and right of way acquisition for County Projects 26-54 and County Project 63-27; and

WHEREAS, to construct the recommended improvements, Dakota County must acquire property from Jeremy J. Illg and Kelly Illg (“Landowners”), identified in Dakota County Right of Way Map 471 as Parcel 52; and WHEREAS, the County offered the Landowners compensation based on the County’s approved appraised value for the parcel; and

WHEREAS, the Landowners rejected the offer seeking additional damages for costs related to the acquisition; and

WHEREAS, the parties in this action have agreed to settle all damages caused by the taking whereby the County will pay Landowners $110,000.00; and

WHEREAS, the County Attorney and Transportation Department staff recommend approval of the settlement agreement as being a fair and equitable settlement of the claims in view of the impacts to the property, real estate market data, the time, additional expense and risk involved in continued litigation and belief that the settlement represents an appropriate allocation of the prospects for success if the matter is allowed to proceed to a commissioners’ hearing.

NOW, THEREFORE, BE IT RESOLVED, that the Dakota County Board of Commissioners approves the acquisition of property from Jeremy J. WHEREAS, the Veterans Memorial Greenway is a new five-mile greenway that would include five to seven veteran memorials along the route; and

WHEREAS, at least one of the memorials will accommodate large group gatherings and community events; and

WHEREAS, the greenway trail would contiguously connect to the Mississippi River Regional and Mendota- Lebanon Regional Greenways as part of Dakota County’s 200-mile-long planned greenway system; and

WHEREAS, the greenway system serves over 665,000 visitor per year, connecting rural and suburban communities together, and provides equitable access to people of diverse backgrounds, interests and abilities exceeding the Americans with Disabilities Act; and

WHEREAS, the greenway safely separates the public from high speed roads and railroads; and

WHEREAS, the greenway has further connectivity to rich cultural resources including historic Dodd Military Road, near-by connection to Fort Snelling, plus is located on Dakota Tribe Homeland; and

WHEREAS, Dakota County is working in partnership with surrounding cities, veteran’s organizations and related organizations in the development of the greenway; and

WHEREAS, there are over 23,000 veterans who have served in the armed forces from the 34 cities and townships in Dakota County; and

WHEREAS, Dakota County does not have a regional facility to recognize and commemorate the services of its veterans; and

WHEREAS, the memorials along the trail are being planned and will be constructed in partnership with veterans’ groups; and

WHEREAS, the total cost of the project is $10 million, and Dakota County would match federal funding with non- federal funds; and

WHEREAS, the State of Minnesota has committed $5,000,000 in State bonding in support of this project.

WHEREAS, this section of the I-35 corridor, that extends from Minnesota to Texas, has national significance and facilitates 8,500-9,500 heavy commercial vehicle trips in this area daily; and

WHEREAS, the interchange of I-35 and County State Aid Highway (CSAH) 50 in Lakeville, Minnesota is deficient in capacity and geometry; and

WHEREAS, the I-35 bridge over CSAH 50 creates a bottleneck with only one travel lane in the westbound direction of CSAH 50; and

WHEREAS, CSAH 50 carries 26,500 (2019 annual average) at the Interchange and is projected to grow to 32,000 by 2040; and

WHEREAS, I-35 is identified as a future MNPASS corridor and both Federal Highway Administration and Minnesota Department of Transportation have identified the need for auxiliary lanes south of CSAH 50 to be constructed when the CSAH 50 Interchange is built; and

WHEREAS, preliminary engineering funds are needed to determine safety and capacity needs for the corridor, and to build consensus on the needed improvements; and

WHEREAS, a corridor and Interchange footprint is needed to advance design engineering and the environmental processes.

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby requests $700,000 for Interstate 35 (I-35) in Minnesota, preliminary engineering activities to determine corridor mobility and safety improvement need from the County State Aid Highway (CSAH) 50 Interchange in Lakeville to CSAH 42 in Burnsville, work to determine project scope and cost for corridor improvements for this section of I-35, the redesign of the Interchange at CSAH 50, and the development of a geometric layout and environmental documentation for the corridor.

PURPOSE/ACTION REQUESTED Authorize execution of contracts with the Cities of Burnsville, Eagan and Hastings for the provision of Emergency Medical Services (EMS) personnel for COVID-19 Vaccination clinics in an amount up to $50,000 for each contract, effective upon execution of the contract through August 31, 2021.

SUMMARY By Resolution No. 20-139 (March 20, 2020), the Dakota County Board of Commissioners approved the continuation of the declared local state of emergency as required by Minn. Stat. § 12.29 regarding COVID-19.

The Dakota County Board of Commissioners acts as the Community Health Board and has responsibility to prevent disease and disability and to promote and protect the health and safety of County residents. Dakota County Public Health is working with organizations at the local, state, and national levels to protect residents and prevent the spread of disease. Public Health staff are providing vaccinations for priority groups identified by the Minnesota Department of Health.

The County has provided vaccination clinics at the Western Service Center and the Northern Service Center. Beginning on March 31, 2021, the clinics will be consolidated at Metcalf Middle School located in the City Eagan, which has the following Burnsville address: 2250 Diffley Road, Burnsville, Minnesota. The clinic operates Monday, Wednesday and Thursday from 8:30 am to 3:30 pm, and Friday 8:30 am to 11:30 am, each week through August 31, 2021.

To provide access to a broader population in Dakota County, the County will operate a smaller vaccination clinic at the Pleasant Hill Library in Hastings on Tuesdays beginning April 13, 2021, from 9:30 am to 3:30 pm through August 31, 2021. In addition to County staff and medical reserve corps volunteers, the Cities of Burnsville, Eagan and Hastings will provide EMS personnel to vaccinate and provide first aid at both clinic sites. Depending on vaccine demand and availability, the schedules for the clinics may be adjusted.

The costs associated with EMS personnel provided at the vaccination clinics are eligible for Federal Emergency Management Agency (FEMA) funding. A service contract is necessary to establish the eligibility for FEMA reimbursement. The County will pay the City of Burnsville $65-$75 per hour, the City of Eagan $72 per hour, and the City of Hastings $38.72-$51.02 per hour dependent on seniority. The service contract will be in an amount not to exceed $50,000 for each city. The County has authority to enter into the service contracts pursuant to Minn. Stat. §12.37.

In the event it does not qualify, staff will return to the County Board to request utilization of other departmental or County funds. The contracts shall contain a provision that allows the County to immediately terminate the contracts in the event that funds from county, state, or federal sources are not appropriated at a level sufficient to allow payment of the amounts due.

PURPOSE/ACTION REQUESTED Authorize the execution of a contract with the Minnesota Department of Public Safety for $409,500 in 2020 Urban Area Security Initiative Homeland Security Grant funding.

SUMMARY The Minnesota Department of Public Safety has awarded $409,500 of Homeland Security Grant funding to Dakota County under the Urban Area Security Initiative (UASI) of the Federal Department of Homeland Security (DHS). The period of the grant is from January 1, 2021 to June 30, 2022.

The spending plan for this grant includes items identified by Dakota County for internal preparedness efforts and the Dakota County Domestic Preparedness Committee for improving Countywide emergency response. The grant includes $195,500 for equipment, $118,000 for homeland security planning activities, $26,000 for exercises, $25,000 for organization and $45,000 for training.

The primary projects in the equipment category are to continue to fund 800 MHz radio ($74,500), maintaining emergency operations center (EOC) equipment and software ($37,000) and equipment to support first responders and the Dakota County Special Operations Team (SOT) ($80,000). The SOT (36 people) is comprised of members from the County and all 11 cities with members from fire, law enforcement, and emergency medical services agencies. The team has responded to incidents involving hazardous materials, technical rescues and collapsed structures at locations throughout the County.

The primary project in the planning category is the funding of contracted homeland security planners for assisting in the implementation of homeland security initiatives. The grant planning activities will include updating the Countywide Emergency Operation Plan, implementation of the All Hazard Mitigation Plan and planning for improved cyber security. It will also include providing support for cyber security exercises for County Departments.

Funding for exercises is targeted towards multijurisdictional exercises regarding terrorism and natural disaster scenarios. A Countywide Exercise Design Team is coordinating exercise planning and facilitating the drills needed to enhance first responder skills. One of the exercises will be the coordination of communications between the County and City EOC’s during an emergency response. A grant category called “organization” includes $25,000 for the participation of the Sheriff’s Office in the Minnesota Fusion Center where participants work collaboratively to gather, analyze and share information to improve the ability to fight crime and terrorism. Training funds will be used to offset costs for multi-jurisdictional training, including SOT training activities.

RECOMMENDATION Staff recommends that the Dakota County Board of Commissioners authorize the execution of the contract with the Minnesota Department of Public Safety for $409,500 in 2020 UASI Homeland Security Grant funding to support homeland security activities during the grant period.

EXPLANATION OF FISCAL/FTE IMPACTS There is a $0 net County cost as a result of this action. Authorization is requested to amend the 2021 Office of Risk Management budget by $409,500 to reflect the revenues and expenses associated with the grant. The expenses are allocated between Capital Equipment Program in the amount of $195,500 and the operations budget in the amount of $214,000. All remaining funds, at the end of 2021, will be requested to be carried over to the 2022 budget.

PURPOSE/ACTION REQUESTED Approve substantial amendments to the City of Lakeville’s 2017 and 2020 Community Development Block Grant (CDBG) Programs.

SUMMARY Three types of substantial amendments to the CDBG Program are permissible by the U.S. Department of Housing and Urban Development (HUD): creation of a new activity or cancellation of an activity; increase or decrease of an activity budget by $100,000 or more at one time, and change to the location and/or national objective of an activity.

The City of Lakeville (City) is requesting the following substantial amendments: 1. Cancel the City’s Acquisition and Clearance activity in the Dakota County 2017 Action Plan and move $38,939 in CDBG funds to the Home Improvement Loan program. 2. Create the City’s Americans with Disabilities Act (ADA) Compliance Plan activity in the Dakota County 2020 Action Plan (2020 Action Plan) and fund it with a budget of $22,000; these funds will come from the City’s ADA Compliance Improvements activity, which is also in the 2020 Action Plan. The budget for the ADA Compliance Improvements activity will be reduced to $13,000.

The Dakota County Community Development Agency (CDA) Citizen Participation Plan requires public notification of substantial amendments. The public notice for the substantial amendment to the City’s 2017 CDBG Program described above was placed in the Dakota Tribune on February 26, 2021. The public notice for the substantial amendment to the City’s 2020 CDBG Program described above was placed in the Dakota Tribune on March 5, 2021. Both notices are included in Attachment A. The notices were also published on the CDA, Dakota County, and City of Lakeville websites. No comments were received.

RECOMMENDATION County and CDA staff recommend approval of the substantial amendments to the City of Lakeville’s 2017 and 2020 CDBG Programs.

PURPOSE/ACTION REQUESTED Authorize the execution of Joint Powers Agreements (JPAs) with the Cities of Farmington and Hastings to ensure that mixed municipal solid waste from these Cities continues to be processed at a resource recovery facility.

SUMMARY The Cities of Hastings and Farmington are the only communities in Dakota County that either directly provides solid waste services (Farmington) or contract for solid waste services (Hastings) for their residents. This practice makes the waste they collect “Public Entity Waste,” requiring it to be processed at a waste-to-energy facility unless there is no available capacity in the Twin Cities Metropolitan Area.

Together, the two Cities deliver approximately 13,100 tons of Mixed Municipal Solid Waste (MMSW) to the Red Wing Resource Recovery Facility each year, ensuring that the facility operates at capacity.

The Metropolitan Solid Waste Management Policy Plan 2016–2036 provides that the Minnesota Pollution Control Agency will not review any request for additional land disposal capacity for a landfill located in the Metropolitan Area unless MMSW resource recovery facilities servicing the Twin Cities Metropolitan Area are operating at capacity and waste has been certified as unprocessable by metro counties. The Dakota County Solid Waste Master plan includes a strategy to support efforts to maximize the use of existing resource recovery facility capacity servicing the Twin Cities Metropolitan Area while reconsidering geography and environmental impacts. Ensuring that Twin Cities Metropolitan Area resource recovery facilities operate at capacity will allow the Minnesota Pollution Control Agency to consider additional land disposal capacity at the two Mixed Municipal Solid Waste Landfills in Dakota County (Burnsville Sanitary Landfill and Pine Bend Sanitary Landfill). Closure of those landfills would result in higher solid waste fees for residents due to longer transportation distances and would result in a loss of future Host Fee revenue to support environmental programming throughout the Dakota County.

Both Hastings and Farmington have expressed an interest in continuing to provide solid waste services to their residents and process their solid waste. However, waste processing currently costs approximately $49 more per ton than landfilling, making continued waste processing without assistance cost-prohibitive. In response, the County Board approved a 2021 budget request of up to $370,000 to reimburse Public Entities for waste processing at the Red Wing Resource Recovery Facility at a rate of $25 per ton.

RECOMMENDATION Staff recommends the County Board of Commissioners authorize the Environmental Resources Department Director to execute individual JPAs with the Cities of Farmington and Hastings to support solid waste processing, as substantially presented in Attachment A and approved by the County Attorney’s Office as to form.

EXPLANATION OF FISCAL/FTE IMPACTS Funding to support this initiative is included in the adopted 2021 Environmental Resources Department budget.

JOINT POWERS AGREEMENT BETWEEN THE COUNTY OF DAKOTA AND THE CITY OF ______FOR SOLID WASTE PROCESSING

WHEREAS , Minnesota Stat. § 471.59 authorizes local governmental units to jointly or cooperatively exercise any power common to the parties; and

WHEREAS , Dakota County (County) is a political subdivision of the State of Minnesota; and

WHEREAS , the City of ______(City) is a governmental and political subdivision of the State of Minnesota; and

WHEREAS , the City has a solid waste abatement program in compliance with state and County requirements; and

WHEREAS , Minnesota Sate. § 115A.471 requires that waste processing facilities that serve the metropolitan area be at capacity before waste can be landfilled; and

WHEREAS , the Metropolitan Solid Waste Management Policy Plan, 2016-2036 provides: that the Minnesota Pollution Control Agency will not review any request for additional land disposal capacity for a landfill located in the Metropolitan Area unless Mixed Municipal Solid Waste (MMSW) resource recovery facilities servicing the Twin Cities Metropolitan Area are operating at capacity and waste has been certified as unprocessible by metro counties; and

WHEREAS, the City collects MMSW or has a contract with a single waste hauler to collect MMSW from all residential generators within the City; and

WHEREAS, the cities of Hastings and Farmington divert MMSW to the Red Wing Resource Recovery Facility (RRF) contributing to the MMSW loads needed for it to operate at full capacity; and

WHEREAS , the parties desire to work cooperatively to ensure the Red Wing Resource Recovery Facility continues to operate at capacity.

NOW, THEREFORE , in consideration of the mutual promises and benefits that the County and City shall derive from this Agreement, the Count and City hereby enter into this Agreement for the purposes stated herein.

SECTION 1 PURPOSE

The purpose of this Agreement is to provide for cooperation and funding between the County and the City to ensure MMSW from the City is processed at a resource recovery facility.

SECTION 2 PARTIES

The parties to this Agreement are the County of Dakota, Minnesota and the City, collectively referred to as the “parties”.

SECTION 3 TERM

Notwithstanding the dates of the signatures of the parties, this Agreement shall be in effect January 1, 2021, and shall continue in effect until December 31, 2022, or until termination in accordance with the provisions herein.

SECTION 4 COOPERATION

The County and the City agree to cooperate and use their reasonable efforts to ensure prompt implementation of the various provisions of this Agreement and to, in good faith, undertake resolution of any dispute in an equitable and timely manner.

SECTION 5 RESPONSIBILITIES OF THE CITY

5.1 The City shall have a solid waste abatement program in compliance with state and County requirements.

5.2 The City shall collect MMSW or shall have a contract with a waste hauler to collect MMSW from all residential generators within the City.

5.3 The City shall maintain records of the weight, in tons, of all the MMSW collected within the City that is processed at the Red Wing Resource Recovery Facility. On a quarterly basis, the City shall submit, a quarterly reimbursement request on a form provided by the County attached as Exhibit 1 and supporting documentation to the County for reimbursement.

5.4 Funds received from the County under the provisions of this Agreement shall only be used to offset the costs of waste processing to the City’s customers or to implement the solid waste strategies and tactics in the Dakota County Solid Waste Master Plan, or both. Funding can be used to supplement, but not supplant, the funding obligations of the Dakota County Community Waste Abatement Grant Program.

5.5 The City shall submit an annual report, on a form provided by the County attached as Exhibit 2, detailing how funds provided under this Agreement offset the costs of waste processing to the City’s customers. The City shall also detail how funds not directly used to reduce costs to payers of solid waste collection services in the city were used. The report shall clearly identify the activities conducted and link them to the relevant strategies and tactics identified in the Dakota County Solid Waste Master Plan. The City shall submit an annual report to the County Liaison not later than February 15, 2022, for funds expended under this Agreement in 2021. The City shall submit an annual report to the County Liaison no later than February 15, 2023 for funds expended under this Agreement in 2022.

SECTION 6 PAYMENT

6.1 Payment. The County will pay on a reimbursement basis, $25.00 per ton of MMSW verifiably processed at the Red Wing resource recovery facility up to a total of no more than $______. All requests for payment shall be supported by documentation verifying the total weight in tons of MMSW processed at the Red Wing resource recovery facility. The County may refuse to pay any claim that is not specifically authorized by this Agreement. Payment of a claim shall not preclude the County from questioning the propriety of the claim. The County reserves the right to be repaid for any overpayment or disallowed claim.

6.2 Timing. The City shall submit reimbursement requests on the appropriate County-approved form (Exhibit 1) on a quarterly basis. Payment will be provided by the County within 45 days of receipt of a reimbursement request.

SECTION 7 INDEMNIFICATION

7.1 IN GENERAL . Each party to this Agreement shall be liable for the acts of its officers, employees or agents and the results thereof to the extent authorized by law and shall not be responsible for the acts of the other party, its officers, employees or agents.

7.2 LIMITATIONS . The provisions of Minn. Stat. § 471.59, the Municipal Tort Claims Act, Minn. Stat. ch. 466 and other applicable laws govern liability of the County and the Municipality

7.3 SURVIVORSHIP . The provisions of this Section shall survive the expiration or termination of this Agreement.

SECTION 8 AUTHORIZED REPRESENTATIVES AND LIAISONS

8.1 AUTHORIZED REPRESENTATIVES : The following named persons are designated the Authorized Representatives of the parties for purposes of this Agreement. These persons have authority to bind the party they represent and to consent to modifications, except that the authorized representative shall have only the authority specifically or generally granted by their respective governing boards. Notice required to be provided pursuant to this Agreement shall be provided to the following named persons and addresses unless otherwise stated in this Agreement, or in a modification of this Agreement.

8.2 LIAISONS . SECTION 9 TERMINATION

9.1 IN GENERAL . Either party may terminate this Agreement for cause by giving seven days’ written notice or without cause by giving thirty (30) days’ written notice, of its intent to terminate, to the other party. Such notice to terminate for cause shall specify the circumstances warranting termination of the Agreement. Cause shall mean a material breach of this Agreement and any supplemental agreements or amendments thereto. Notice of Termination shall be made by certified mail or personal delivery to the authorized representative of the other party. Termination of this Agreement shall not discharge any liability, responsibility or right of any party, which arises from the performance of or failure to adequately perform the terms of this Agreement prior to the effective date of termination.

9.2 TERMINATION BY COUNTY FOR LACK OF FUNDING . Notwithstanding any provision of this Agreement to the contrary, the County may immediately terminate this Agreement if it does not obtain funding from the Minnesota Legislature, Minnesota Agencies, or other funding source, or if its funding cannot be continued at a level sufficient to allow payment of the amounts due under this Agreement. Written notice of termination sent by the County to the Municipality by email or facsimile is sufficient notice under this section. The County is not obligated to pay for any services that are provided after written notice of termination for lack of funding. The County will not be assessed any penalty or damages if the Agreement is terminated due to lack of funding.

SECTION 10 MODIFICATIONS

Any alterations, variations, modifications, or waivers of the provisions of this Agreement shall only be valid when they have been reduced to writing, approved by the parties’ respective Boards, and signed by the Authorized Representatives of the County and the Municipality.

SECTION 11 MINNESOTA LAW TO GOVERN

This Agreement shall be governed by and construed in accordance with the substantive and procedural laws of the State of Minnesota, without giving effect to the principles of conflict of laws. All proceedings related to this Agreement shall be venued in the County of Dakota, State of Minnesota.

SECTION 12 MERGER

This Agreement is the final expression of the Agreement of the parties and the complete and exclusive statement of the terms agreed upon and shall supersede all prior negotiations, understandings, or agreements.

SECTION 13 SEVERABILITY

The provisions of this Agreement shall be deemed severable. If any part of this Agreement is rendered void, invalid, or unenforceable, such rendering shall not affect the validity and enforceability of the remainder of this Agreement unless the part or parts that are void, invalid or otherwise unenforceable shall substantially impair the value of the entire Agreement with respect to either party.

SECTION 14 GOVERNMENT DATA PRACTICES

The City and the County must comply with the Minnesota Government Data Practices Act, Minn. Sat. Ch. 13, as it applies to all data provided, created, collected, received, stored, used, maintained, or disseminated under this Agreement. The civil remedies of Minn. Stat. § 13.08 apply to the release of the data referred to in this clause by either the City or the County. This section survives the expiration of this Agreement.

PURPOSE/ACTION REQUESTED Authorize rescission of Resolution No. 20-633; authorize expenditure of up to $399,312 to acquire and continue restoring a 122.4-acre permanent natural area conservation easement (Easement) from Audrey and Jerry Wicklund (Wicklunds); authorize the Physical Development Director (PDD) to sign the purchase agreement (PA); authorize the County Board Chair to execute the Easement and sign a Notice of Funding Restriction (NOFR) required for use of state Minnesota Law 2018 (ML18) Outdoor Heritage (OH) funds, and authorize amendment of the 2021 Environmental Resources (ER) Capital Improvement Program (CIP) budget.

SUMMARY The Wicklunds own 151 acres, including 4,100 feet of Chub Creek in Waterford Township. The west edge of the property is a mapped Minnesota County Biological Survey (MCBS) site of Moderate Biodiversity Significance, including a mix of wetlands, restored grasslands, and forests. The Wicklunds planted many native trees and prairie species over their lifetime of ownership, in addition to investing extensive effort into controlling invasive species, such as buckthorn.

County staff has worked with the Wicklunds since 2009 to permanently protect a portion of their property. Staff completed an appraisal of the Wicklund property in November 2020. The Wicklunds accepted the County’s offer based on the appraised value and value deductions related to the donation of a building site and continued payment through the federal Conservation Reserve Program (CRP). By Resolution 20-633 (December 8, 2020), the County Board of Commissioners approved the expenditure of up to $351,912 to acquire a 121.6-acre Easement and to restore the property within the Easement area. However, based on further discussions among family members, the Wicklunds have since requested a reduction in the amount of initial donated value from $55,000 to $7,500, thereby increasing the total acquisition and initial restoration project costs to $399,312. There is a slight increase in the Easement area from 121.6 to 122.4 acres. However, the proposed natural resource management and restoration costs remain unchanged.

RECOMMENDATION Staff recommends rescission of Resolution 20-633; approval of the acquisition of the Easement on the Wicklund property; authorization for the PDD to execute the PA; authorization for the County Board Chair to execute the Easement and a NOFR required by state ML18 OH funding; and authorization to amend the 2021 ER CIP budget.

EXPLANATION OF FISCAL/FTE IMPACTS There are adequate ML18 OH funds and County match funds in the 2021 ER CIP for this acquisition. A budget amendment is requested to move the funding from the grant to the Wicklund Acquisition and Restoration projects.

RESOLUTION WHEREAS, the Chub Creek watershed, located in the southwestern portion of the County, consists of nearly 54,000 acres, and the main stem of the creek flows 22 miles from Chub Lake to the west end of Lake Byllesby; and

WHEREAS, the water quality of Chub Creek has been characterized as “fair” to “good” with an unusually high diversity of fish species, and the creek and surrounding lands are included in one of the Preliminary Conservation Focus Areas included in the recently approved Land Conservation Plan for Dakota County; and

WHEREAS, Jerry and Audrey Wicklund (Wicklund) own 151 acres, including 4,100 feet of Chub Creek in Waterford Township; and

WHEREAS, the revised total estimated cost to acquire a 122.4-acre Easement from the Wicklunds, including an estimated $4,000 for closing costs, is $339,412; and

WHEREAS, the estimated first phase of natural resource management and restoration of the Easement is $59,900, which remained unchanged from the original estimate; and

WHEREAS, the Wicklunds have accepted the County’s acquisition offer based on the appraised value and value deductions related to the donation of a building site and continued payments through the federal Conservation Reserve Program (CRP); and

WHEREAS, the Wicklunds have reviewed and approved the Natural Resource Management Plan for the Easement and shared Phase I restoration costs; and

WHEREAS, the Easement and restoration are eligible for state Outdoor Heritage (OH) funding appropriated to the County by the Minnesota Legislature in 2018 (ML18); and

WHEREAS, the 2021 Environmental Resources (ER) CIP budget includes adequate fund balance for ML18 OH funds and County grant-match funds; and

WHEREAS, expenditure of OH funds by the County requires the County Board Chair sign and the County record a Notice of Funding Restriction (NOFR) for the Easement on the Wicklund property funded with OH funds, prior to funding reimbursement by the State of Minnesota; and

WHEREAS, the Physical Development Director (PDD) is required to sign the purchase agreement (PA) to acquire the Easement on the Wicklund property; and

WHEREAS, the final acquisition costs of the Wicklund property will be determined after the settlement statement is finalized and all associated acquisition expenses have been invoiced.

PURPOSE/ACTION REQUESTED Appoint a Dakota County representative to the Lower Minnesota River Watershed District (LMRWD) Board of Managers.

SUMMARY The LMRWD is located just south of the Twin Cities along the Minnesota River. Portions of the communities of Mendota Heights, Mendota, Lilydale, Eagan, and Burnsville are located within the LMRWD boundaries in Dakota County (Attachment A). The LMRWD is a Special Purpose Unit of government formed under Minn. Stat. § 103D. Upon establishment, the LMRWD became a legal entity for providing local participation to the U.S. Army Corps of Engineers to construct a navigational channel. With this purpose in mind, a nine-foot navigation channel was developed from the mouth of the Minnesota River to mile 14.7 at Savage, Minnesota. Construction of the project began in 1966 and was completed in 1968. The LMRWD is still actively involved today with the maintenance of the channel and also works with local units of government, private citizens, and local organizations to provide strategic resource evaluation and management.

Yvonne Shirk, the former Dakota County representative on the LMRWD Board of Managers, resigned her position due to a change of residence outside the LMRWD. Yvonne Shirk’s resignation created a vacancy on the LMRWD Board of Managers for a Dakota County representative. The LMRWD and Dakota County collaborated in the recruitment of candidates for appointment. Four candidates applied and were determined eligible. The eligible candidate applications were reviewed by Dakota County Commissioners Workman and Halverson, who represent the area within the LMRWD.

Minn. Stat. § 103D.311 maintains that “person may not be appointed as a manager who: (1) is not a voting resident of the watershed district; and (2) is a public officer of the county, state, or federal government, except that a soil and water conservation supervisor may be a manager.” Patricia Mraz applied to be appointed as Dakota County representative on the Board of Managers of the LMRWD and meets the eligibility requirements set forth in statute. After review by Commissioner Workman and Commissioner Halverson and discussion with Dakota County staff, Patricia Mraz was selected as the recommended candidate.

Members of the LMRWD Board of Managers serve three-year terms. The current term for the Dakota County Manager began February 28, 2021.

RECOMMENDATION Staff recommends appointment of Patricia Mraz as the Dakota County Member of the Board of Managers for the LMRWD for the remainder of the incumbent term ending February 29, 2024.

PURPOSE/ACTION REQUESTED Authorize the execution of a contract amendment with SEH, Inc., (SEH) to provide additional design and environmental services for the River to River Greenway: Robert Street Crossing (Project) in the City of West St. Paul (City).

SUMMARY To provide a safe and efficient transportation system, Dakota County and the City are proceeding with the Project. The Project will consist of preliminary and final engineering designs, surveying, and related services for the required improvements to build a pedestrian underpass and trail connections underneath Robert Street between County State Aid Highway (CSAH) 6 (Thompson Avenue) and CSAH 8 (Wentworth Avenue) in the City (Attachment A).

Following former Thompson Oaks Golf Course wetland delineations consultation with Board of Water and Soil Resources, staff revealed additional resource investigation was required due to disturbed nature of the site. Due to this, the former golf course required its own separate wetland delineation report in lieu of it being included with the Robert Street Underpass project area.

During the final design phase of the project, it was determined that incorporation of a security camera system was needed, which included coordination with Dakota County IT, LOGIS, City of West St. Paul, and County engineering staff. Subsequently, design, plan preparation, and preparation of specifications were required. During security camera system development, SEH was asked by the County to redesign trail lighting in the box culvert and provide a structural modification of box culvert lintel beam to incorporate a standardized portal sign configuration that included a surface mounted light outside of the box culvert.

Finally, during the bidding process, it was determined necessary that Dakota County coordinate to incorporate two separate plazas, including plan and specification preparation that included specific County pay items, amenities, and standards. Also, SEH was asked to incorporate three add alternates into the bid documents and cost estimates, including multiple iterations to the construction cost estimate due to County budget limitations. This task required multiple meetings with County and City management staff.

RECOMMENDATION Staff recommends authorizing an amendment to the contract with SEH in the amount of $17,974, increasing the total amount to $441,822.

EXPLANATION OF FISCAL/FTE IMPACTS The amended Parks Capital Improvement Program Adopted Budget includes total funding in the amount of $5,718,152 for the project, including funding from previous years (Attachment B). There is sufficient budget for the contract increase.

Short Elliott Hendrickson Inc. (SEH®) respectfully requests approval of this Supplemental Agreement for Engineering Services (agreement) for the above referenced project. The agreement is needed to address several additional project task items that were unforeseen during the final engineering phase of the project. This agreement assumes County staff will coordinate and conduct a public meeting following opening of project bids, if one is deemed necessary.

The following is a summary of the additional task items and the additional fee incurred to complete them.

SUMMARY The Heritage Library and License Center is served by one chiller that provides cooling to the primary spaces in the facility. This unit was installed when the building was constructed in 2000 and has reached the end of its useful life. The replacement of the existing 77-ton chiller is part of the planned upkeep and maintenance at the Heritage Library and License Center. The new unit will be non-propriety and may be serviced and maintained by multiple vendors.

MG Solutions LLC and county staff prepared bid documents. The project was formally advertised, and competitive bids were received on March 9, 2021. The following six bids were received:

PURPOSE/ACTION REQUESTED Authorize execution of a joint powers agreement with the City of Burnsville (City) for City utility repairs on County Project (CP) 42-149.

SUMMARY To provide a safe and efficient transportation system, Dakota County is proceeding with CP 42-149, a resurfacing of County State Aid Highway (CSAH) 42 from the west County line to CSAH 11 in Burnsville. Construction is planned for the spring of 2022.

As part of the project, the City has reviewed their utilities on this roadway and has determined that repairs are needed to drainage, sanitary sewer, and water main structures. By Resolution No. 13-445 (August 27, 2013), the County and all Cities over 5,000 population entered into agreements for storm sewer (drainage) system repairs in County overlay projects. That agreement defined the roles and responsibilities of each agency for the repair of storm sewer systems but did not address sanitary sewer or water systems. A separate joint powers agreement with each City is necessary to define project cost shares and responsibilities regarding sanitary and water system repairs in County pavement preservation projects. The work in Burnsville includes storm sewer, sanitary sewer, and water main repairs.

By Resolution No. 21-123 (March 9, 2021), the County Board authorized execution of a contract with Bolton & Menk, Inc., to design the improvements for CP 42-149. Bolton & Menk allotted hours in their contract to design the improvements requested by the City and prepare plans and specifications for the utility repairs. The cost participation for storm sewer repairs will be in accordance with the adopted Cost Share Policy F.8 Storm Sewer Maintenance. The County’s cost-share is 80 percent, and the City’s share is 20 percent of the storm sewer cost. The City is responsible for the sanitary sewer and water system repair costs. The County is responsible for the costs associated with the milling, bituminous paving, striping, and pedestrian ramps on CSAH 42.

RECOMMENDATION Staff recommends execution of a joint powers agreement with the City of Burnsville for storm sewer, sanitary sewer, and water main repairs in County Project 42-149.

EXPLANATION OF FISCAL/FTE IMPACTS None at this time. The 2021–2025 Transportation Capital Improvement Program Adopted Budget includes $3,535,000 in funding for CP 42-149.

PURPOSE/ACTION REQUESTED Authorize conveyance of right of way acquired as part of County Project (CP) 30-39 to the City of Eagan (City).

SUMMARY To provide safe and efficient transportation, Dakota County is partnering with the City and Independent School District (ISD) 196 on CP 30-39: Diffley Road School Area Improvements. The project includes the reconstruction of Diffley Road (County State Aid Highway [CSAH] 30) from a four-lane to two-lane divided section from 1,100 feet east of Lexington Avenue (CSAH 43) to 400 feet east of Braddock Trail, construction of single-lane roundabouts at Daniel Drive and Braddock Trail, Braddock Trail and school entrance intersection modifications, school parking lot modifications, a new access roadway from the south parking lot to the Diffley Road and Daniel Drive intersection, pedestrian crossing devices, and corridor street lighting (Attachment A).

By Resolution No. 20-545 (November 3, 2020), the County Board authorized staff to enter into a joint powers agreement (JPA) for CP 30-39 with the City of Eagan and ISD 196 for right of way acquisition, construction, and maintenance. The JPA defined cost participation and responsibilities for right of way and construction, defined maintenance responsibilities, and outlined project management responsibilities and conveyance of public property for the project.

In October 2020, the State Legislature approved a bonding bill that included $4 million for the construction of the Diffley Road project. As part of the state bonding requirements, each agency must be in ownership of their respective infrastructure. The County acquired a permanent easement along Braddock Trail for intersection improvements at the south entrance to the school complex off of Braddock Trail (Attachment B), and it will ultimately be the City’s infrastructure.

Based on terms of the JPA, the County agreed upon completion of the project to transfer ownership of any applicable drainage and pond easements and real estate interests for city streets to the City. To allow for distribution of the state bonds prior to start of construction, the County shall transfer ownership to the City prior to execution of the state bond funds agreement, anticipated to be late April 2021.

RECOMMENDATION Staff recommends transferring ownership of the permanent easement along Braddock Trail from County to the City of Eagan to meet the requirements of the state bond funding for CP 30-39.

PURPOSE/ACTION REQUESTED Authorize execution of a contract with SRF Consulting Group for preliminary design consulting services for County Project (CP) 66-15 in Vermillion Township (Attachment A).

SUMMARY To provide a safe and efficient transportation system, Dakota County is proceeding with County Project (CP) 66-15, for planning and design of a new interchange between County State Aid Highway (CSAH) 66 and US Trunk Highway (TH) 52 in Vermillion Township. The requested contract includes studies to document the need for the project, determine the interchange location, address environmental impacts, develop the preliminary engineering design, and to work with others including Vermillion Township, the Minnesota Department of Transportation, other agencies, and property owners. Dakota County is the lead agency.

Scope of Work and Issues to be Addressed. The scope of work for the CP 66-15 preliminary design phase includes public and agency coordination, survey and data collection, traffic studies, project feasibility and alternative studies, environmental documentation, utilities coordination, drainage design, and a preliminary layout for the preferred alternative. The studies of alternatives and design details will consider alternative locations for the interchange, including the intersection of CSAH 62 and TH 52 (one mile north of CSAH 66). Other issues will include impacts to the Vermillion River, farms, and natural resources.

Consultant Selection. The Dakota County Transportation Department issued a Request for Proposal (RFP) for transportation planning services, including reference to the Capital Improvement Program (CIP) budget of $500,000. The cost participation for the study and preliminary engineering will be in accordance with the adopted Cost Share Policy F.1, Cost Participation-Roadway. The County’s cost share is 100 percent of the consultant contract. Six proposals were received and evaluated by staff representing the County. SRF Consulting Group was selected as the preferred professional engineering consultant based on the following criteria: project understanding, project approach, public involvement, project team expertise, quality control, performance on similar projects, and best-value cost. The proposals were evaluated to determine whether the work plan, hours, and rate structure were sufficient and reasonable to complete all of the work. The proposal from SRF provided the best value in balancing the services needed with estimated costs. A Consultant Evaluation Summary detailing the proposal process, review team, evaluation criteria and results, and best-value cost evaluation is included in Attachment B.

RECOMMENDATION The County Engineer recommends execution of a contract with SRF Consulting Group, for the professional design services for CP 66-15 for actual costs not to exceed $499,974.

EXPLANATION OF FISCAL/FTE IMPACTS The 2021-2025 Transportation CIP Adopted Budget includes $500,000 for planning and preliminary engineering of CP 66-15. The total County cost of the contract will be $499,974. Sufficient funds are available for the engineering study contract (Attachment C).

Consulting Services Information

Deliverables: The contract’s technical deliverables include technical/environmental reports and preliminary design layouts as follows: (1) survey and environmental data; (2) a Traffic Report; (3) a Feasibility and Location- Study Report; (4) an Environmental Assessment Worksheet/Report; (5) alternative interchange layouts and comparisons; (6) a Drainage Report; and (7) a MnDOT-Approved Preliminary Layout for the preferred alternative. The contract deliverables will also include project management services and public/agency engagement as outlined below.

Public and Agency Engagement: Public outreach and work with agencies will include three rounds of public-information, including in- person and online meeting opportunities, web page content, and opportunities to review and comment on project documents. Dakota County staff and SRF have prepared plans to work closely with the Minnesota Department of Transportation (MnDOT), the Minnesota Department of Natural Resources (MnDNR), and land owners – including residents, businesses, farmers and public agencies (see more details in the Evaluation Results section, page 2).

Schedule: The contract schedule is planned from April 2021 through December 2022 (up to 20 months).

Consultant Selection Summary: The Request for Proposals (RFP) for the required consultant services was released on January 28, 2021, and was sent to the following six (6) consultant firms: HDR, Kimley-Horn, KLJ, SEH, SRF, and WSB. These six firms were invited to submit proposals because of proven expertise and ability to complete complex transportation planning and design studies. The County’s Capital Improvement Program (CIP) budget of $500,000 was noted in the RFP with the explanation that the proposed cost for services could fall outside of this budget range if explained by the proposer. Six (6) proposals were submitted to the County by the due date of February 19, 2021; the six proposals were led by the firms invited to propose: HDR, Kimley-Horn, KLJ, SEH, SRF, and WSB.

Review Team and Process: The six (6) proposals were reviewed by staff from Dakota County, including staff representing expertise in transportation planning, roadway design, and environmental/water resources. Proposals were

reviewed and ranked independently by review team members. The review team members met on March 2, 2021, to discuss the proposals, share information regarding individual member evaluations, and reach consensus on a recommended consultant. The consensus reached by the proposal reviewers supported negotiating the contract with SRF Consulting Group (SRF).

Evaluation Criteria: The proposals were evaluated and ranked based on the following 6 criteria: 1. Project Understanding and Approach (20%): Based on conceptual understanding of the required scope/deliverables and the consultant’s general approach. 2. Scope of Work, Deliverables, and Schedule (30%): Based on detailed approach and organization of the work to be completed, scheduling of the work, and approach to managing resources to successfully complete all tasks. 3. Public Involvement Approach (25%): Approach to facilitate acceptance of the project and design within the project schedule, including approaches for the best use of budgeted meetings and techniques to engage with the right stakeholders. 4. Project Team and Expertise of Key Personnel (15%): Based on the project management team, technical specialists, roles/organization, and qualifications based on similar experience. 5. Quality Control (10%): Based on methods to ensure quality products delivered on schedule. 6. Best Value Cost Proposal: Considered the quality and feasibility of the proposal and services for fee; the cost proposed vs. value to be provided; and the approach to complete the work within budget and schedule

Evaluation Results: Dakota County staff selected SRF based on the detailed work plan provided in the firm’s proposal, which presented a strong understanding of the project and an integrated approach to delivering all tasks by a qualified team. The SRF proposal emphasized approaches to address the need for the project in early steps, in parallel with studies of a wide-ranging alternatives. The SRF proposal provided the best balancing of the tasks to be completed with the project-area issues and stakeholders to be addressed. These will include coordination with MnDOT, MnDNR, and other agencies concerning the project’s purpose and need (including TH 52 needs), the Vermillion River Aquatic Management Areas (AMAs), and prime agricultural lands and farms, including 155 acres of unique community farming at the junction of CSAH 66 and TH 52 by the Hmong American Farming Association (HAFA).

Dakota County staff in the Transportation and Environmental Departments have ongoing relationships with MnDOT, MnDNR, and HAFA representatives, as well as with other land owners. SRF’s proposal was the best value because it addressed and balanced the unique relationships, issues, and needs of the study area while presenting appropriate budgets in each task. As shown below (next page), the SRF total cost of $499,974 is in the same range of costs submitted by the other consultants; however, it provided the best-fit distribution of labor hours to tasks, including important technical tasks addressing survey, traffic, design, and water resources. The SRF proposal also estimated the lowest average per-hour labor cost among the six proposals.

SRF also suggested optional tasks, to anticipate changes and other needs – for example, to address federal funding opportunities/requirements and possible technical issues related to the Vermillion River. The proposed optional tasks would have added up to $42,141 (326 hours) to the contact. However, County Staff decided to not include the optional tasks in the contract recommendation because the need for specific optional services or other changes is not easy to evaluate at the outset, and the services proposed by SRF or other adjustments can be addressed with more confidence later in the planning and design process.

SUMMARY To provide a safe and efficient transportation system, Dakota County maintains over 440 miles of County highways, including County Road 48 in the City of Coates. County Road 48 was originally constructed as a two-lane, east- west road in 1942. A highway easement, which includes prescriptive rights, was obtained for this. County Road 48 was later realigned to intersect a curved section of County State Aid Highway (CSAH) 46. Additional highway easements were acquired to accommodate this realignment. The old highway easement for the curve section remains on record.

The same property owner owns parcels north of County Road 48. The owner is proposing to redevelop their parcels north of County Road 48 and expressed interest in the excess property the County owns (Attachment A). Any future reconstruction of County Road 48 would require an intersection similar to what exists today, given CSAH 46 has higher traffic volumes and provides better east-west continuity. Future reconstruction of County Road 48 will require additional highway easement in a different location at County cost. The existing highway easement has no value other than for highway purposes. Pursuant to Minn. Stat. § 163.11, subdivision 4, the County can vacate this easement by resolution from the County Board.

RECOMMENDATION The County Engineer has determined that the existing highway easement, described as Parcel 5A on Dakota County Right of Way Map No. 246, is excess to the County’s needs. The County Engineer recommends the vacation of Parcel 5A, as described and depicted in Dakota County Right of Way Map No. 246, to reduce the County’s future liability and maintenance responsibilities.

PURPOSE/ACTION REQUESTED Update on coronavirus (COVID-19) Public Health response, vaccinations, and County operational impacts.

SUMMARY Staff from the County’s Public Health Department and the Operations, Management and Budget Division will provide an update at the meeting.

Dakota County is working with local, state and federal health officials in response to the novel coronavirus (COVID- 19) outbreak.

Dakota County Public Health has activated a system that assigns emergency roles to staff and involves regular meetings to share COVID-19 updates. County staff is also communicating with the Minnesota Department of Health (MDH) and the federal Centers for Disease Control and Prevention (CDC). This information is being communicated to hospitals, schools, city emergency managers, and other community partners. In addition, the Public Health Department has a COVID-19 hotline for County residents to call with questions and concerns. Health care providers in the County are screening patients for signs and symptoms of the virus. Public Health staff continues to work with the Dakota Child and Family Clinic to provide COVID-19 drive-up testing that is accessible and affordable for Dakota County residents. Vaccination clinics have started, and there are several phases outlined by MDH for the vaccination process with the first phase including vaccinations for healthcare providers, Long Term Care (LTC) residents, people with underlying health conditions and mission critical staff. Public Health has a role in vaccine distribution and has contracted with two health care agencies to provide vaccinations for the targeted groups included in the first phase.

County staff are also actively responding to expanded community needs brought about by COVID-19. Through Dakota County’s Emergency Operations Center (EOC), County staff distribute personal protective equipment (PPE) to cities and first responders, operate a centralized resource hotline, conduct outreach to long term care facilities, promote mental health resources available to the community during a time of increased need and work with state staff on coordination and outreach efforts for testing within the County.

The County’s Continuity of Operations Plan continues to be actively implemented. The Operations Team meets regularly. The team focuses on delivery of essential services while protecting the health and safety of the public and staff. Long term plans are developed as this event continues to evolve. Plans consider staff availability, possible changes to policies/procedures, and changes to common spaces in order to serve residents in person or through remote technology. Strategies to support a remote workforce have been put in place. Expenditures associated with the response are being tracked. Plans have been implemented for vaccinating staff consistent with the priorities and guidelines developed by the Minnesota Health and the Dakota County Public Health Departments. As the vaccination rate increases, efforts to define the Workplace of the Future are underway.

SUMMARY Under Minn. Stat. § 145A, the Dakota County Board of Commissioners acts as the community health board and has responsibility to prevent disease and disability and to promote and protect the health and safety of county citizens.

In early 2020, COVID-19 spread around the world, impacting the lives of every Dakota County community member. A year later, the disease has infected over 38,000 residents, hospitalized over 2,000, and killed over 400. While some loss is irreplaceable, there is no doubt that the efforts of public health organizations saved lives and helped to restore hope and strength. Many diseases, including COVID-19, can be slowed and prevented through the work of public health and strong community partnerships. Together we can address the social and economic factors that affect people’s health and continue to align with the County Board goal of creating ‘A Great Place to Live’ for all our residents.

In the first full week of April, individuals, families, organizations, and government agencies will celebrate National Public Health Week. The goal is to recognize and promote the vital work public health plays, along with the behavior of individuals and families, in creating a healthy community. This year the theme is Building Bridges to Better Health. The daily themes recognize health and social strategies like rebuilding, strengthening community, galvanizing climate justice, constructing COVID-19 resilience, uplifting mental health and wellness, and elevating the essential health workforce. During the week, we will celebrate the power of prevention, advocate for healthy and fair policies, share strategies for increasing equity and the role of a strong public health system.

OUTCOMES The Dakota County Public Health Department works to build healthy individuals, families, and communities in Dakota County through partnerships to prevent disease, disability, and injury; promote physical and mental wellbeing and safety; and protect health and the environment. In 2020: • Our public health department led the county’s initiative to better understand, control, and prevent the spread of COVID-19. • Our department partnered with local and state health organizations to set up COVID-19 testing facilities. Together with these organizations, tens of thousands of residents were tested for free. • Public health staff developed and laid out plans for community vaccination clinics in 2021, including creating partnerships to vaccinate our most vulnerable residents in long-term care facilities. • The public health department partnered with other county departments to ensure that residents received food, medicine, transportation, and other essential services so that they could continue to live healthy lives. • Our public health nurses and staff continued to visit families (virtually) during pregnancy and after delivery to provide information on healthy physical, social, and emotional child development.

RECOMMENDATION In order to encourage residents to take action to promote their health, the health of their families, and health of their community, staff recommends the Dakota County Board of Commissioners recognizes Public Health Week in Dakota County, April 5-11, 2021.

SUMMARY Under Minn. The first full week in April is officially designated as National Public Health Week. This year the theme is “Building Better Bridges Together.” Making communities safe and healthy is public health’s top priority, clearly evidenced by the lead role and work of Public Health during the current COVID-19 pandemic. We all have a role to help our county be a healthy place to live, learn, work, and play.

By Resolution No. 00-175 (March 21, 2000), the Dakota County Board of Commissioners established an annual Public Health Achievement Award to recognize and honor the contributions of citizens in Dakota County who devote their time, energy, and talents in their communities. The award is presented in conjunction with National Public Health Week. Awards are made in the following three categories:

• Youth Award – an individual or group, 18 years or younger at the time of nomination • Individual Award – an individual, 19 years or older at time of nomination • Community Group Award – an individual group, 19 years or older (community coalitions, partnerships, or organizations)

An announcement of the award, including its categories, criteria, and nomination instructions, was distributed to individuals and groups in the community. Nominations were due on March 10, 2021. The review committee was made up of Public Health staff who reviewed the applications and made recommendations for award recipients.

The award recipients will be announced on April 6, 2021. The award presentation will be done virtually due to the COVID-19 pandemic. See Attachment A for a description of each recipient.

WHEREAS, the first full week in April is officially designated as National Public Health Week, which recognizes the importance of ensuring conditions where everyone has the opportunity to be healthy and we all have a role to play in healthy places to live, learn, work, and play; and

WHEREAS, many people in Dakota County contribute time, energy, and talent in their communities to build a healthy Dakota County; and

WHEREAS, by Resolution No. 00-175 (March 21, 2000), the Dakota County Board of Commissioners, desiring to recognize and honor these contributions, established a Public Health Achievement Award to recognize three categories of contributions: youth, individual and community; and

WHEREAS, nominees were evaluated according to and met criteria for leadership, public health contributions, collaboration, advocacy, role model, and evidence of impact.

NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby presents the 2021 Public Health Achievement Award to the following individuals and organizations:

2021 PH Achievement Awards

Youth All Dakota County Youth

“All Dakota County Youth” are being awarded the 2021 Public Health Achievement Award for rising to the occasion during a difficult year—filled with lockdowns, distance and remote learning, trying to stay active and connected while spending extra time at home with their families, and for keeping each other safe and healthy by wearing masks and social distancing in the community and in the classroom. Thank you, Dakota County Youth, for your perseverance and resilience in 2020 and beyond!

Individual Bianca Virnig, Metro ECSU

Bianca Virnig works for Metro Educational Cooperative Service Unit ECSU, a nonprofit group established to provide high quality education services for public, private, and non-profit programs in the Twin Cities Metro area. She is also a resident of Eagan. Since August, Bianca has been instrumental in her role as a Regional Support Coordinator on the Dakota County Public Health Consultation Team.

Over the past year, Bianca has guided and assisted schools in providing a safe learning environment for students and staff, while implementing mitigation strategies amid the global COVID-19 pandemic. She has helped school members better understand COVID guidance around contact tracing, personal protective equipment (PPE), and building safety. She has gone above and beyond to meet one-on-one with school nurses in the evenings, and over the weekends, to address personal needs as well as to better understand how to assist schools. Through her presentations, she has given consistent information to school health staff which has reduced confusion during a time of many changes and role responsibilities within school systems. Moving out of this pandemic is difficult, but with individuals like Bianca involved, the transition is not only easier, but safer for all.

Community Deerwood Elementary School’s Virtual Safe Place

Merging team member’s creativity, ingenuity, and forward thinking, the staff at Deerwood Elementary have supported students coping with mental health needs during the COVID-19 pandemic. When schools abruptly went to full-time online education due to the pandemic, Deerwood Elementary School Social Worker Abby Chmiel created a virtual social work office to help students cope with stress and anxiety. Her virtual office includes a “virtual safe place” for students based on the Conscious Discipline Model. This virtual office and model was made easily replicable/usable so that other Deerwood Elementary staff and students could benefit from it. Conscious Discipline is a research-based model that heavily focuses on creating a sense of safety and connection within the “School Family”, so students are better able to self-regulate and achieve a brain state most conducive for learning. One of the Conscious Discipline strategies to help students self- regulate is the Safe Place. Deerwood Elementary School’s virtual Safe Place provides students access to

breathing techniques and coping skills to help them self-regulate while distance learning. The Safe Place is a five-step process that teaches students how to use calming techniques so they can self-regulate. Deerwood Elementary students reported that the virtual tools are helpful in teaching them how to self- regulate and empowers them to be successful in school. A survey administered by Principal Sorenson, found “85 percent of Deerwood kids are utilizing their digital safe place and 90 percent of the teachers that responded to the survey shared that their students are utilizing Abby Chmiel’s virtual office.” Overall, this creative tool has made students feel calm, excited, empowered, and ready to learn.
