    1 9.3 PISGAH 2 3 4 9.3.1 Background and Summary of Impacts 5 6 7 9.3.1.1 General Information 8 9 The proposed Pisgah SEZ has a total area of 23,950 acres (97 km2) and is located in 10 San Bernardino County in southeastern California, about 100 mi (160 km) northeast of Los 11 Angeles (Figure 9.3.1.1-1). In 2008, the county population was 2,086,465. The nearest 12 population center to the SEZ is the City of Barstow, which is located about 25 mi (40 km) to 13 the west of the SEZ and had a 2008 population of 24,596. Interstate 40 (I-40) runs east–west 14 through the proposed Pisgah SEZ, bisecting it into a northern portion that contains about two- 15 thirds of the SEZ acreage and a southern portion with the remainder of the acreage. Access to the 16 SEZ from I-40 is available from exits at Fort Cady Road (to the west of the SEZ), Hector Road 17 (midway through the SEZ), and Pisgah Crater Road (at the eastern end of the SEZ). Hector Road 18 runs north–south through the middle of the SEZ, and a number of other local dirt roads cross the 19 SEZ. The National Trails Highway (historic U.S. 66) also passes through the SEZ as it runs 20 south of and parallel to I-40. The BNSF Railroad serves the area and traverses the SEZ from the 21 northwest to the southeast, running approximately parallel to and about 0.8 mi (1.3 km) north of 22 I-40.

The trails are lines of direct diffusion and culture may spread rapidly along these routes. Charting of material traded betworeen particular tribes as obtained from etihnograohic and historical sources may help the archaeologist analyze sources of artifact materials found in sites. Trade as described in this paper represents the situation as it existed at the time of Caucasian discovery and during the early period of contact. This means a different time period for northern, central-, southern, and sierral California, each explored at different times. Some of -,;he trade mentioned is undoubtedly very old. It is possible, also, that some was stimulated by the presence of white traders and highly valued white mants goods. Wherever the circmastances point to its being a late development, these facts are pointed out.

Environmental Analysis 5.17 TRIBAL CULTURAL RESOURCES This section of the Draft Program Environmental Impact Report (PEIR) evaluates the potential for implementation of the Countywide Plan to impact tribal cultural resources in the County of San Bernardino (County). Tribal cultural resources include landscapes, sacred places, or objects with cultural value to a California Native American tribe. Potential impacts to other cultural resources (i.e., historic, archaeological, and paleontological) are evaluated in Section 5.3, Cultural Resources. The analysis in this section is based in part on the following information: . Cultural Resources Technical Report for the San Bernardino Countywide Plan, San Bernardino County, California, SWCA Environmental Consultants, February 2019. Responses to notifications regarding the Countywide Plan from six Native American tribal representatives. Complete copies of these documents are in the technical appendices of this PEIR (Appendices E and M). 5.17.1 Environmental Setting 5.17.1.1 REGULATORY BACKGROUND Federal Archaeological Resources Protection Act The Archaeological Resources Protection Act of 1979 regulates the protection of archaeological resources and sites on federal and Indian lands (see further description in Section 5.5, Cultural Resources). Native American Graves Protection and Repatriation Act (NAGPRA) NAGPRA is a federal law passed in 1990 that mandates museums and federal agencies to return certain Native American cultural items—such as human remains, funerary objects, sacred objects, or objects of cultural patrimony—to lineal descendants or culturally affiliated Indian tribes. State Public Resources Code Archaeological resources are protected pursuant to a wide variety of state policies and regulations enumerated under the California Public Resources Code (PRC).
