Page 3 Georgia Sheriffs’ Association Since its beginning in 1954, the Georgia Sheriffs’ Association has engaged in a variety of activities and provided many services: • Annual training events for Georgia sheriffs and related personnel, and other valuable crime prevention programs. • Advocacy at the Georgia General Assembly for tough crime control measures and laws that promote professionalism and enhanced effectiveness of your Office of Sheriff. • Sponsor of the Georgia Sheriffs’ Youth Homes, which provides full-time residential care for the abused, abandoned, and neglected children in the state. Membership in the Georgia Sheriffs’ Association is comprised of Georgia’s 159 elected sheriffs. The Georgia Sheriffs’ Association also relies on the financial support of nearly 50,000 Honorary Members who believe in the Office of Sheriff and its mission to preserve the peace in our communities. The Georgia Sheriffs’ Youth Homes was established to give our state’s most at-risk children the love, safety, and stability needed to become mature, successful adults. During the late 1950’s, Georgia sheriffs became increasingly concerned about the growing number of abandoned, neglected, and abused children. They understood it was vital, not just for the children, but for our state, to give these disadvantaged youth the chance to grow up in a loving and secure home environment. In 1960, the sheriffs opened the Georgia Sheriffs’ Boys Ranch near Hahira where children were taught: • How to overcome adversity • Teamwork and accepting authority • Personal responsibility • Hygiene and manners The children were able to learn strong moral values and spiritual awareness, how to participate positively in a community, and how to trust themselves and one another. Over the years, four additional homes have opened across the state for both boys and girls, providing thousands of disadvantaged youth the opportunity to live stable, positive lives in full-time residential facilities. Both organizations, the Georgia Sheriffs’ Association and the Georgia Sheriffs’ Youth Homes, are governed by a Board of Directors who oversee the operations and programs of each. It is the mission of our organizations to promote public safety for the current and future citizens of the state of Georgia. Primas has sued Defendant Board of Regents of the University System of Georgia, alleging claims for employment discrimination based on her race and gender under 42 U.S.C.A §§ 1981 & 1983 (West 2003) and under Title VII of the Civil Rights Act of 1964, 42 U.S.C.A. § 2000e et seq. (West 2003). Currently before the Court is Defendant’s Motion for Summary Judgment (doc. 16). For the following reasons, Defendant’s motion is hereby granted. I. BACKGROUND Defendant Board of Regents of the University System of Georgia (“Board”) manages and controls the Medical College of Georgia, which in turn operates an entity called Georgia Correctional Healthcare (“GCHC”). GCHC, under a contract with the Georgia Department of Corrections (“GDC”), provides medical services to Georgia Case 5:04-cv-00342-DF Document 30 Filed 03/30/06 Page 2 of 27 prisoners. Plaintiff Edna Primas, a black female, was employed by GCHC at Pulaski State Prison (“Pulaski State”) in Hawkinsville, Georgia, from August 12, 2002 until her termination on December 18, 2003. Apart from recognizing each other as parties to the lawsuit, there is very little in this case about which Primas and the Board can agree. While the parties generally agree that the work environment in the medical unit at Pulaski State was tumultuous during Primas’s tenure there, they disagree as to the cause — Primas insists that the medical unit was rife with racial antagonism, while the Board maintains that an internal personnel shakeup and Primas’s lack of interpersonal and management skills were to blame.
