Jack McCaffrie 23 April 2014 iii iv ABSTRACT For thousands of years, navies have been used primarily for military purposes; battling against opposing naval forces, protecting trade and supporting land forces. They have other roles, which have evolved over time, and are now commonly categorized as the diplomatic and constabulary functions of navies. The diplomatic function relies on the ability of navies to operate freely at sea and to exert influence through their presence. The constabulary function of navies involves law enforcement at sea and relates to the protection of borders, natural resources and the marine environment. Not all navies have become equally involved in the constabulary function. For some smaller navies it marks the limit of their capability, while for others it is only a very small part of their total responsibility. For example, the United States Navy undertakes relatively few constabulary functions; leaving most to the United States Coast Guard which has been established specifically for law enforcement duties. On the other hand, the Royal Navy has played a larger role in the constabulary function, alongside several civilian law enforcement agencies. This thesis examines Australia’s approach to law enforcement at sea, from the time of Federation until the end of 2012, and what it has meant for the Royal Australian Navy. The examination covers the nature and evolution of the law enforcement challenges, noting that illegal immigration and resources protection have been recurring issues from the beginning. In considering government responses to illegal activities at sea the thesis identifies the slow, tentative and relatively informal approach that characterized action until the extension of resource zones, and the arrival of large numbers of asylum seekers by boat, demanded a more effective approach. The thesis also tracks the evolution of supporting legislation, from an early trickle to a growing flood, reflecting the increasing internationalization and complexity of law enforcement at sea. Despite the longstanding involvement of navies in the constabulary function the Royal Australian Navy was slow to engage in it, with wars, funding restrictions and government ambivalence contributing factors. This thesis demonstrates, however, that since the Navy took on the constabulary function, formally from 1967, it has become integral to the Navy’s operations. As a part-time student my time was divided between paid employment and the opportunities to progress the thesis - and paid employment always came first. As well as studying part-time, living in Canberra meant only infrequent visits to the University campus. Consequently I was unable to share the camaraderie in the group of ANCORS students engaged in post-graduate study. Nevertheless, I owe thanks to several people who have guided me through the entire process and who have exhibited great patience with my often very slow progress to eventual completion. Foremost among those I wish to acknowledge are my supervisors, Professor Martin Tsamenyi and Dr Chris Rahman. It was Professor Martin who said to me in late 2004 that it was time to start my PhD. He also said to me in late 2013 that it was time to finish my PhD. In between he caused me to think uncomfortably deeply about my topic and my arguments and always provided encouragement, when it was needed. I am especially grateful to Chris for his unerring ability to find weaknesses in my arguments and especially for his assistance in the final stages of thesis preparation. Even though I was unable to spend much time on campus, I have really valued the opportunity to study at Wollongong. Being on the main campus especially and then the Innovation Campus, when visiting ANCORS, always provided the spark that comes from mixing with others who are engaged in study.     THE VIETNAM WAR AN AUSTRALIAN PERSPECTIVE [Compiled from records and historical articles by R Freshfield] Introduction What is referred to as the Vietnam War began for the US in the early 1950s when it deployed military advisors to support South Vietnam forces. Australian advisors joined the war in 1962. South Korea, New Zealand, The Philippines, Taiwan and Thailand also sent troops. The war ended for Australian forces on 11 January 1973, in a proclamation by Governor General Sir Paul Hasluck. 12 days before the Paris Peace Accord was signed, although it was another 2 years later in May 1975, that North Vietnam troops overran Saigon, (Now Ho Chi Minh City), and declared victory. But this was only the most recent chapter of an era spanning many decades, indeed centuries, of conflict in the region now known as Vietnam. This story begins during the Second World War when the Japanese invaded Vietnam, then a colony of France. 1. French Indochina – Vietnam Prior to WW2, Vietnam was part of the colony of French Indochina that included Laos, Cambodia, and Vietnam. Vietnam was divided into the 3 governances of Tonkin, Annam, and Cochinchina. (See Map1). In 1940, the Japanese military invaded Vietnam and took control from the Vichy-French government stationing some 30,000 troops securing ports and airfields. Vietnam became one of the main staging areas for Japanese military operations in South East Asia for the next five years. During WW2 a movement for a national liberation of Vietnam from both the French and the Japanese developed in amongst Vietnamese exiles in southern China.

    51 Chapter 4 The Report of Children Overboard: Dissemination and Early Doubts Introduction 4.1 As discussed in the previous chapter, the report that a child or children had been thrown overboard from SIEV 4 originated in the telephone conversation between Commander Banks and Brigadier Silverstone on the morning of Sunday 7 October 2001. 4.2 At about 11.15am (AEST) on the same day, that report was made public by Mr Philip Ruddock, Minister for Immigration and Multicultural Affairs, during the course of a press conference.1 As Ms Jennifer Bryant remarked in her report: In total, only around four hours elapsed between the commencement of boarding [of SIEV 04 by HMAS Adelaide] and reports [of children thrown overboard] being made public in the media.2 4.3 In this chapter, the Committee first discusses how an oral and uncorroborated report made in the midst of a complex tactical operation came to be disseminated so quickly and so widely. The Committee then outlines how doubts concerning the veracity of the report arose in the Defence chain of command, and the point at which different elements in that chain reached the conclusion that the incident had not occurred. Finally, the Committee discusses how photographs taken of the sinking of SIEV 4 on 8 October came to be publicly misrepresented as being photographs of the ‘children overboard’ event. 4.4 In the following chapter, the Committee will consider the role played by a range of agencies and individuals in relation to attempts to correct the original and mistaken report that children had been thrown overboard.

During the course of our 80 Year history only one of our Alumni has died in the service of our country – Trooper Jason Brown (Class of 1999). In 2013 Jason was made an Alumni of Distinction (posthumously) in memorial of his life. Many hundreds of our Alumni have served or are still serving in our defence forces. As we pay tribute to all those many Australian men and women who have died in conflicts around the world over the past 100 years we would also like to recognise the achievements and on-going commitment to the service of this country by our Alumni. One such person is Colonel Kahlil Fegan. Kahlil Fegan graduated from Oakhill College in 1988 after commencing at the school eight years earlier in Grade 5. He studied for a Bachelor of Arts Degree at Newcastle University prior to graduating from the Royal Military College - Duntroon in 1993, to the Royal Australian Infantry Corps. He has served in a wide variety of roles in Australia, Canada, East Timor, Iraq and Afghanistan. Kahlil is currently serving as the Chief of Staff of the 1st Division/Deployable Joint Forces Headquarters. He is married to Ilona, an Organisational Development Manager and has two daughters, Caitlin and Lauren and a young son Elijah.

Occasional Paper 91 provides detailed insight into strategic and operational level decisions concerning the employment of the Royal Australian Navy and the Royal Navy’s China Fleet and South Atlantic Squadron in pursuit of the German East Asia Squadron during the early months of World War One. It is a story of bungled and poor strategic decision making on the part of the First Sea Lord and Admiralty. The consequences of this disjointed strategy, wasted time and not allowing Admiral Sir George Patey freedom of action in his flagship HMAS Australia, to pursue the German Squadron were significant.
