Dedrick Staff Director Democratic Staff Director September 29, 2017 SUMMARY OF SUBJECT MATTER TO: Republican Members, Subcommittee on Railroads, Pipelines, and Hazardous Materials FROM: Majority Staff, Subcommittee on Railroads, Pipelines, and Hazardous Materials RE: Subcommittee Hearing on “Building a 21st Century Infrastructure for America: Rail Stakeholders’ Perspectives” PURPOSE The Subcommittee on Railroads, Pipelines, and Hazardous Materials, will meet on Wednesday, October 4, 2017 at 10:00 a.m., in 2167 Rayburn House Office Building, to receive testimony related to “Building a 21st Century Infrastructure for America: Rail Stakeholders’ Perspectives”. The purpose of this hearing is to receive the views of the railroad industry’s stakeholders regarding infrastructure in the 21st Century. The Subcommittee will hear testimony from the railroad industry, a railroad supplier, and rail labor. BACKGROUND The railroad industry in the United States is largely comprised of private freight carriers and the National Rail Passenger Corporations, or Amtrak, which was created by Congress in 1970 to assume money-losing passenger operations from the freight railroads. Operations began on May 1, 1971. This hearing will gather opinions of rail stakeholders and seek information on infrastructure expansion opportunities, opportunities for public-private partnerships, regulatory reforms, ways to make grant programs more accessible, and ways to enhance safety through the use of performance based regulations. Freight Rail The freight rail industry consists of seven large Class I railroads, line haul freight carriers with operating revenues of $453 million or more in 2016, and approximately 600 much smaller Class II and Class III railroads, which own and operate nearly one-third of the national rail mileage. -

A multi-year program, as required under federal law, is also under development. Both of these programs are the products of extensive, ongoing participation by the state’s three metropolitan planning organizations (MPOs) and a wide variety of stakeholders. Both programs are driven by New Jersey’s transportation goals and objectives, as laid out in this “capital investment strategy” report. “Capital investment strategy” is the term used in New Jersey for a method of linking transportation investments with goals, objectives, and performance measures. New Jersey is a national leader in the development of this approach, which ensures that scarce financial resources are used as efficiently as possible to address our most important needs. This report provides an overview of NJDOT’s and NJ TRANSIT’s capital programs and concludes with a summary of the revenues which are planned to be used to finance these programs. NJDOT Smart Growth NJDOT is committed to making transportation investments that implement Governor McGreevey’s “Smart Growth” initiative. -

April , The Honorable Kamala Harris President of the Senate U.S. Capitol Washington, DC The Honorable Nancy Pelosi Speaker of the House of Representatives U.S. Capitol Washington, DC Dear Madam President and Madam Speaker: I am pleased to transmit Amtrak’s Fiscal Year (FY) General and Legislative Annual Report to Congress, which includes our FY grant request, legislative proposals, and a summary of the various actions taken by Amtrak to respond to the Coronavirus pandemic. To overcome the setbacks to service and financial performance we faced during this crisis, we seek Congress’s continued strong support in FY so that we can return to the successes and growth we accomplished in FY . Amtrak is poised to be a key part of the nation’s post-pandemic recovery and low-carbon transportation future, but to do so we require continued Federal government support, including robust investment. Despite the difficulties of the past year, Amtrak was able to achieve significant accomplishments and continue progressing vital initiatives, such as: . Safety: Completed Positive Train Control (PTC) installation and operation everywhere it was required across entire network and advanced our industry-leading Safety Management System (SMS). Moynihan Train Hall: Amtrak, in partnership with New York State and the Long Island Rail Road, opened the first modern, large-scale intercity train station built in the U.S. in over years. FY Capital Investment: Performed $. billion in infrastructure and fleet work. FY Ridership: Provided . million customer trips, which, while a decrease of . million passengers from FY owing to the pandemic-related travel reductions; reflects record performance during the five months preceding the onset of the Coronavirus. -

Northeast Corridor Capital Investment Plan Fiscal Years 2020-2024 March 2019 Congress established the Northeast Corridor Commission to develop coordinated strategies for improving the Northeast’s core rail network in recognition of the inherent challenges of planning, financing, and implementing major infrastructure improvements that cross multiple jurisdictions. The expectation is that by coming together to take collective responsibility for the NEC, these disparate stakeholders will achieve a level of success that far exceeds the potential reach of any individual organization. The Commission is governed by a board comprised of one member from each of the NEC states (Massachusetts, Rhode Island, Connecticut, New York, New Jersey, Pennsylvania, Delaware, and Maryland) and the District of Columbia; four members from Amtrak; and five members from the U.S. Department of Transportation (DOT). The Commission also includes non- voting representatives from freight railroads, states with connecting corridors and several commuter operators in the Region. U.S. Department of Transportation Federal Railroad Administration FINDING OF NO SIGNIFICANT IMPACT and SECTION 4(F) DETERMINATION Amtrak Sawtooth Bridges Replacement Project Kearny, New Jersey August 2020 1. Introduction The National Railroad Passenger Corporation (Amtrak) is proposing to undertake the Sawtooth Bridges Replacement Project (Project) to replace Amtrak Bridges No. 7.80 and No. 7.96, collectively referred to as the “Sawtooth Bridges.” The Project site is in the Town of Kearny, Hudson County, New Jersey (NJ) and includes an approximately 1.1-mile long segment of existing transportation right-of-way along Amtrak’s Northeast Corridor (NEC). The Sawtooth Bridges are located roughly between Mile Post (MP) 8.3 (“Hudson Interlocking”) on the west end and MP 7.2 (“Swift Interlocking”) on the east end. The Sawtooth Bridges do not cross any bodies of water; rather, they span over other rail tracks. Amtrak Bridge No. 7.80 carries two NEC tracks over four New Jersey Transit Corporation (NJ TRANSIT) rail tracks that serve the NJ TRANSIT Morris & Essex Line. Amtrak Bridge No. 7.96 carries two NEC tracks over one Port Authority Trans-Hudson Corporation (PATH) Newark–World Trade Center (WTC) rail track and one Consolidated Rail Corporation (Conrail) freight rail track. The Project involves the construction of two new viaducts that would carry two tracks each for a total of four tracks along this segment of the NEC. Since federal funds and federal permits are necessary for the Project, compliance with the National Environmental Policy Act of 1969 (42 USC § 4321 et seq.) (NEPA) is required. The Federal Railroad Administration (FRA) is the lead federal agency for the Environmental Assessment (EA), prepared for the Project in accordance with NEPA, the Council on Environmental Quality’s NEPA implementing regulations (40 CFR parts 1500–1508), and FRA’s Procedures for Considering Environmental Impacts (64 FR 28545, May 26, 1999).
