NOTA DE LA DIRECTORA El Doctor Alfredo García Cevallos fue un excelente estudiante dentro de la carrera de Derecho de nuestra Facultad de Jurisprudencia y Ciencias Sociales y Políticas de la Universidad Católica de Santiago de Guayaquil, llegando a ser ayudante de cátedra en la materia de Lengua Española. Esta experiencia hizo que su redacción sea muy clara y ello se ve reflejado en su investigación que se tradujo en su tesis para alcanzar el grado doctoral, cuyo título es “Sergio Cotta y su análisis del derecho”, y que hoy lo tenemos como una obra publicada en la biblioteca de Autores de nuestra Facultad. Cabe señalar que el autor de la obra es un sacerdote de la Iglesia católica. Esta obra se distingue de las otras obras publicadas en esta Biblioteca, pues realiza un estudio de Filosofía del Derecho, especialidad que muy pocos llegan a dominar como lo hace el Doctor García, quien ostenta el título de PHD. Esperamos que esta obra que se pone a disposición del público en general contribuya a ampliar el conocimiento del Derecho, desde un punto de vista más filosófico. (San Agustín) INTRODUCCIÓN Sergio Cotta, en su producción intelectual, ha tenido un objetivo claro: adentrarse en la fenomenicidad de la vida para encontrar la verdad. Ha buscado y ha incursionado en diversos ámbitos de la realidad (el derecho, la política, la historia, etc.), para encontrar aquellas estructuras que están en el fondo de la existencia y que constituyen el centro del ser humano. Este trabajo pretende ser una introducción sintético-histórica al pensamiento de este autor, especialmente en lo referente al derecho. Queremos que las siguientes páginas den una pauta, unos puntos claros, de modo que cualquier persona que quiera acercarse a la obra de Cotta, pueda utilizarlos como fundamento de su labor. Esto es así, porque en definitiva, pretendemos mostrar el hilo conductor de todo el iter intelectual de Cotta, un camino en algunas ocasiones escabroso; en otras, llano; aunque siempre con un fin preciso: encontrar con honestidad el prístino ser de las cosas. Éste es el motivo por el que nos atrevernos a pensar que Cotta ha sido uno de aquellos profetas de la verdad y del sentido que ha tenido Italia en el siglo XX, especialmente en el campo de la filosofía jurídica y la filosofía política. En el capítulo I hemos decidido comenzar presentando, en orden cronológico, la biografía de Sergio Cotta, siguiendo los acontecimientos más significativos de su vida. En el capítulo II desarrollaremos el método de estudio creado por Cotta: la ontofenomenología. Expondremos su camino de elaboración, su composición y su presentación definitiva. La ontofenomenología repre- senta la cumbre donde llegó nuestro autor después de haber bruñido las dos ideas básicas que han estado en él siempre presentes: el ser y la historia. Este método es una feliz solución para poder acercarse al verdadero ser de las cosas desde la perspectiva del aquí y del ahora. A continuación, dedicamos el capítulo III al estudio de las conclusiones a las que llega Cotta en una primera aproximación fenomenológica: el hombre como ser-con-los-otros, la socionomía, las formas coexistenciales, etc. Al llegar al capítulo IV damos un paso más. Veremos el resultado del análisis ontológico respecto al sujeto: dualidad sintético-relacional, el problema de la libertad, el hecho de que existimos-con-los-otros o coexistencialidad ontológica, etc. Cotta divide la realidad en zonas o regiones ontológicas: el derecho, la amistad, la política, la familia, el juego y la caridad. Cada una de ellas tiene su principio constitutivo, su dirección difusiva, su ámbito humano de extensión y su principio regulador o deber-ser. Pues bien, en el último capítulo (V) mostraremos de qué manera nuestro autor aplica el método ontofenomenológico a una de estas realidades: a la dimensión jurídica. Estudiaremos el deber-ser del derecho, la justicia; analizaremos su principio constitutivo, la norma; y examinaremos la vida del derecho que proviene de su fuerza intrínseca de difusividad universal. En lo que se refiere al fundamento ontológico, veremos por qué existe el derecho en la existencia humana y qué lugar ocupa. Al final podremos decir que la dimensión jurídica es, con palabras del autor, «una segunda naturaleza» en el hombre. Nevertheless, the political nuances of his thought have barely been explored by English-speaking scholars, and even among his Italian followers these have not been fully appre- ciated. This article attempts to present an overview of Rosmini’s political philoso- phy, focusing on his concern for the protection of private property rights and arguing that it is precisely his advocacy of private property that determines his attitude toward the general organization of associated life, government, and democracy. The organization of this investigation consists of four parts. The first pro- vides a brief biographical sketch of Antonio Rosmini. The second tentatively enlists the main influences in the development of Rosmini’s thought as far as politics and economics are concerned. The third is devoted to examining his approach toward property. The fourth examines his definition of social justice in the light of his justification of property. Introduction In this article, I introduce the reader to the figure of Antonio Rosmini, provide a biographical sketch, and subsequently approach his thought on private prop- erty. As a priest and a devout Catholic, religious faith was central to every aspect of Rosmini’s philosophy.

    DRAFT NATURAL LAW THEORY IN ITALY Francesco Viola To explore the history of natural law theory in 20th-century Italy (see Fassò 1964a, 109–128; Pérez Luño 1971; Marini 1987; Lorenzi 1990) there is no need to make reference to political unification of the country in the second half of the 19th century: We can refer to a much older tradition of thought that rather marks the persistence of a cultural approach, despite chequered political and social vicissitudes. The fact is that the cultural unification of Italy came long before its political unification. Since every culture can be considered as an interpretation of human nature, it is legitimate to wonder whether there is a propensity of Italian culture towards a specific doctrine of natural law. I will limit this exploration especially to the period that goes from the years after World War II, down to our own day, and I will entirely neglect studies on the history of natural law, even though they have had major importance in Italy. Does a natural law doctrine exist that is dominant in Italy in the second half of the 20th century? I will say straightaway that the answer to this question will be a negative one. Rather than of a unitary doctrine it will be necessary to talk of some typical approaches to the problems of natural law that are persistent in Italian culture and derive from its tradition of thought. 1. The Italian Tradition In this tradition the common fabric of society is represented by Catholic ethics, whose principles and values, until a few decades after World War II, were amply shared, though not always adequately practiced.

NATURAL LAW IN ITALY IN THE PAST TEN YEARS IN 1947 GIOROSO DEL VECCHIO, the best known and leading figure among the Italian philosophers of law, took up again the publication of the Rivista Inter- nazionale di Filosofia del Diritto, a periodical which the Fascist anti-Semitic laws had taken from him in 1938. On reassuming the direction of the periodical he wrote: "We would like to appeal for a return to the eternal idea of natural law, to that pure principle of justice which rises above the contingent vicissitudes of positive legislation as a permanent criterion, and which alone, if it is respected, can lead men to a true and lasting peace."' The old master of Italian juridical philosophy was interpreting in these words a widely diffused state of mind easily explainable in the aftermath of the world conflict and of the civil war which in Italy accompanied the final phases of the war. The sources investigated are fifteen war writings: seven letter collections and seven private records (diaries, notebooks, a memoir). Focusing on officers who shared a similar social background and level of culture and literacy enabled a comparative and contrastive analysis of the communicative aspects presented by war writings. Of the private records, five were written by officers who went on to become important literary authors (Carlo Emilio Gadda, Giani Stuparich, Paolo Monelli, Piero Jahier and Emilio Lussu); the last is a novel based on an existing war notebook. The direct experience of combat is central to all the sources considered, as the thesis explores war’s impact on writing activity, narrative attitudes and stylistic features. Particular attention is paid to the ways in which the huge transformation caused by war is recorded not solely in the content of these writings, but also signalled by their frequency, form, style, and narrative strategies (both conscious and unconscious).

    SERGIO COTTA Y LA FILOSOFIA DEL DERFCHO FSPANOLA Jose Antonio Santos Abstract: This paper discusses the repercussions of the legal thought of Ser- gio Cotta on Spanish legal philosophy. After a general overview of the legal philosophy of Cotta, we will focus on the study of his writings, localizing their presence in the most representative works of different Spanish authors. It is obvious that the present analysis will be limited, and that some Spanish thinkers will not be mentioned. La historia de la filosofia juridica italiana y espanola se nu- tre de influencias y convergencias mutuas en el modo de operar; toda vez que ambas parten de concepciones del mundo similares, con todas las matizaciones que quepan. Son dos maneras de hacer filosofia del derecho cuyo nexo comiin, entre otros, es el estar siempre pendientes de las nuevas corrientes imperantes en Europa y fuera de ella. En el ambito espanol se ha producido un fructifero dialogo con dos relevantes filosofos del derecho italianos: Sergio Cotta y Nor- berto Bobbio. To speak of "Italian natural law" is a contradiction in terms. Pos- itive law has a national character, while natural law, if it exists, does not depend on any particular context and concerns mankind of all times in all places. Indeed, one of the strongest arguments against the existence of natural law has always been the number of different ways of defining it. One must not however confuse natural law with the natural law doctrine. This is our way of considering natural law, the fruit of our reflecting upon it, the pro- cess of its conceptualization. All this must necessarily depend to a certain extent on cultural conditioning. The controversies about natural law are substantially due to the confrontation of different theories of natural law. In this sense it is not at all contradictory to speak of an "Italian way" in natural law, an Italian natural law doctrine. But does such a unitary tendency in fact exist in Italian culture? It may seem strange, at a time when the unity of the Italian state is being debated, to seek to establish the existence of an Italian way in natural law (Fasso 1964; Perez Luno 1971; Lorenzi 1990; Marini 1987). However this is a question of relating the natural law doctrine not so much to political or national unity as to the mentality or genius of a culture.
