FALLET LILJA En Studie Om Diskurs Och Medierepresentation Av Våld Inom Ishockey FALLET LILJA En studie om diskurs och medierepresentation av våld inom ishockey Författare: Felix Pettersson Handledare: Merja Ellefson Examensarbete, 15 hp Masterprogrammet i kultur-och medievetenskap 120 hp Vt 2019 Abstract Title: The Lilja case – a study about discourse and media representations of violence within ice hockey The purpose of this study is to examine the discourses that influenced the debate in Swedish sport media around the professional ice hockey player Jakob Liljas 10-game suspension and subsequent assault conviction by the Swedish legal system. The aim is to see how Lilja’s violence was defined and what voices were the most prominent in the debate. The study is based on a theoretical framework consisting of Laclau and Mouffe’s discourse theory and Agamben’s ideas of the Homo Sacer and the State of Exception. Using Laclau and Mouffe, an analytical toolbox was assembled to deconstruct the discourses present in the debate. The analysis found two dominant discourses within the debate: a sports discourse and a law discourse. The study found two nodal points that defined how the discourses treated Lilja’s violence; the nodal point “crime” within the law discourse, and the nodal point “rule violation” within the sports one. The sports discourse argued against the legal process maintained that Lilja had already received a sufficient punishment through his suspension. The law one was centred around the premise that legal action was required to properly punish Lilja. The analysis found that the sports discourse unsuccessfully tried to position the sport of ice hockey as a State of Exception where the laws of regular society should not apply. There were also similarities between the underlying masculine norms that informed how the sports discourse treated player health and Agambens Homo Sacer, how people’s life worth is reduced in order to justify certain conditions imposed on them. While a true State of Exception or Homo Sacer does not exist in this scenario, as Lilja was ultimately convicted according to the rules of the law discourse, it is interesting that ideas that align with these concepts were well represented in the medial debate. Inledning Den femte mars 2015, i en ishockeymatch mellan Rögle BK och Malmö Redhawks, utdelade dåvarande Röglespelaren Jakob Lilja en regelvidrig tackling på motståndarlagets Jens Olsson. Lilja tryckte sin hockeyklubba i nacken på Olsson i vad som i ishockeytermer betecknas som ”crosschecking”. Malmöspelaren fördes till akuten och var enligt läkare bara ”en centimeter från att kanske ha blivit förlamad”, men kunde återhämta sig helt tids nog.1 Lilja fick lämna matchen och dömdes av Hockeyallsvenskans disciplinnämnd till tio matchers avstängning, varav fyra av matcherna omvandlades till böter.2 Straffet var ett av de hårdaste ligan någonsin delat ut, men än mer utmärkande för händelsen var den rättsprocess som inleddes nästan två år senare. I januari 2017 åtalades Lilja för misshandel, och två månader senare dömdes han till dagsböter och villkorlig dom i Malmö tingsrätt.3 Lilja överklagade domen först till hovrätten och sedan även till Högsta Domstolen (HD) som i juli 2018 till sist fastställde den ursprungliga misshandelsdomen, men ändrade påföljden till att enbart innebära villkorlig dom.4 Turerna kring Jakob Lilja är ett av de mest uppmärksammade rättsfall med en svensk professionell idrottare i modern tid. Fallet utgör dessutom en av få gånger i Sverige som ett våldsamt övertramp inom sportens ramar fått rättsliga påföljder. Detta har i sig skapat medial debatt kring vilken roll det svenska rättssystemet bör spela i idrotten, samt var gränsen ska gå för våldsamt beteende som utövats på den idrottsliga spelplanen. Inom idrotter som ishockey har våldet traditionellt alltid haft en plats; det har varit undantagsgiltigt från resten av samhällets lagar och regler. Men som domen i HD exemplifierar så finns det undantag till undantaget och den gråzon som uppstår i debatten medför ett intressant område för analys. 1 Expressen, 2018-11-02 2 Hockeyallsvenskan.se, 2015-03-07 3 Svenska Dagbladet, 2017-03-31 4 Sveriges Radio, 2018-07-10 4 Fallet representerar även ett tillfälle där två starka tankeströmningar i samhället drabbar samman. Idrottens och juridikens regler har traditionellt skilts isär men på det finns flera exempel på när dessa korsats och juridiken kommit att definiera hur idrotten praktiseras. I december 1995 beslutade EG-domstolen att fotbollsspelare inom EU fick rätt att byta fritt mellan europeiska klubbar efter att kontrakt avslutats utan att tidigare klubb kompenseras.5 I maj 2019 bestämde idrottens skiljedomstol att den sydafrikanska idrottaren Caster Semenya var tvungen att medicinera sina testosteronnivåer för att få tävla mot kvinnor.6 Utöver detta finns det även tillfällen där rättsväsendet kolliderat med andra diskurser, som när den ställdes mot den medicinska i barnläkarfallet där en narkosläkare vid Astrid Lindgrens barnsjukhus åtalades för dråp.7 Men till skillnad från dessa exempel rör fallet Lilja en idrottsincident där just våld stått i centrum. Denna studie ämnar därmed att genom den mediala diskursen undersöka hur våldet som samhällsfenomen tar sig uttryck inom idrottsliga strukturer. Retoriken kring våldets betydelse, dels inom ishockeyn men även utanför, är värd att granska av samma anledningar som våldet i sig måste synas. Detta medför en del frågor om var gränsen för våldet ska dras och om vilka diskurser som blir framstående i denna debatt. Studien menar dock emellertid inte att analysera de överhängande politiska idéströmningarna som influerar debatten, utan är enbart fokuserad till den kontext som presenteras medialt. 1.1 Syfte och frågeställningar Syftet med denna studie är att identifiera och diskutera de diskurser som genomsyrat den nyhetsmediala debatten kring den misshandelsdömda professionella ishockeyspelaren Jakob Lilja, först i samband med att incidenten inträffade i mars 2015 och sedan även 5 Aftonbladet, 2015-05-12 6 Östgöta Correspondenten, 2019-05-01 7 SVT Nyheter, 2010-02-01 5 under den rättsprocess som avslutades i juli 2018. För att undersöka detta kommer denna studie att svara på följande frågeställningar: 1. Hur beskrivs Jakob Liljas våld i svenska nyhetsmedier? 2. Vilka diskurser går att urskilja i den mediala bevakningen av incidenten och den efterföljande rättsprocessen? 3. Vilka röster kommer till tals i de olika diskurserna? 6 2. The New Albany, Ohio native was signed by the Blue Jackets to a three-year, entry level contract on July 7, 2015. The 6-1, 212-pound winger played three seasons with the Ohio AAA Blue Jackets organization from 2012-15. Lilja, 26, made his NHL debut in the Blue Jackets’ 2019-20 season opener on October 4 against Toronto and has collected 0-2-2 and 11 shots, while averaging 8:45 of ice time in 10 appearances.
