The Economics of Commodity Market Manipulation: A Survey Craig Pirrong Bauer College of Business University of Houston February 11, 2017 1 Introduction The subject of market manipulation has bedeviled commodity markets since the dawn of futures trading. Allegations of manipulation have been extremely commonplace, but just what constitutes manipulation, and how charges of manipulation can be proven, have been the subject of intense controversy. The remark of a waggish cotton trader in testimony before a Senate Com- mittee in this regard is revealing: “the word manipulation . initsuse isso broad as to include any operation of the cotton market that does not suit the gentleman who is speaking at the moment.” The Seventh Circuit Court of Appeals echoed this sentiment, though less mordantly, in its decision in the case Cargill v. Hardin: “The methods and techniques of manipulation are limited only by the ingenuity of man.” Concerns about manipulation have driven the regulation of commodity markets: starting with the Grain Fu- tures Act of 1922, United States law has proscribed manipulation, including 1 specifically “corners” and “squeezes.” Exchanges have an affirmative duty to police manipulation, and in the United States, the Commodity Futures Trad- ing Commission and the Department of Justice can, and have exercised, the power to prosecute alleged manipulators. Nonetheless, manipulation does occur. In recent years, there have been allegations that manipulations have occurred in, inter alia, soybeans (1989), copper (1995), gold (2004-2014) nat- ural gas (2006), silver (1998, 2007-2014), refined petroleum products (2008), cocoa (2010), and cotton (2011). Manipulation is therefore both a very old problem, and a continuing one. -

These four commodity- linked currencies are the Australian dollar, Canadian dollar, New Zealand dollar, and South African rand. We fi nd that commodity/currency relation- ships exist contemporaneously, but fail to exhibit Granger- causality in either direction. We attribute our results to the informational efficiency of futures markets. That is, information is incorporated into the commodity and cur- rency futures prices rapidly and simultaneously on a daily basis. There are a few studies on the relationship between currency and com- modity prices. A recent study by Chen, Rogoff, and Rossi (2008) using quar- terly data fi nds that currency exchange rates of commodity- exporting coun- tries have strong forecasting ability for the spot prices of the commodities they export. -

Abstract: This paper addresses the issue of interconnection among major sugar markets and commodity/exchange stocks in different parts of the world using the Johansen cointegration approach and vector error correction model. Due to a high degree of sugar market fragmentation and corresponding diversity in price levels and its volatility in different regions, the results of our analysis sheds some light on the very fact of a ‘single’ global sugar market existence and can be important not just with regard to producers and buyers of sugar but for the international investors as well, both in the light of risk governance and maximizing profitability. Using the evaluation of the extent of connection among regional sugar markets, one can assess potential benefits available to investors through international diversification between the analyzed markets. -

West* INTRODUCTION Modern derivative securities - financial instruments whose value is linked to or "derived" from some other asset - are often sophisti cated, complex, and subject to a variety of rules and regulations. The same is true of the derivative instruments traded at the world's first organized futures exchange, the Dojima Rice Exchange in Osaka, Japan, where trade flourished for nearly 300 years, from the late sev enteenth century until shortly before World War II. This Article analyzes Dojima's organization, efficiency, and amalgam of legal and extralegal rules. In doing so, it contributes to a growing body of litera ture on commercial self-regulation1 while shedding new light on three areas of legal and economic theory. -

Chapter 6 of this volume is devoted to the “rhetoric of perversity”—the claim that a reform will have exactly the opposite of its intended effects and will hurt the intended beneficiaries. The second, “the rhetoric of jeopardy” is exemplified by Friedrich Hayek’s The Road to Serfdom (2007 [1944]); it is the claim that a reform will erode the freedoms we depend on. Hirschman’s third is the “rhetoric of futility”—the insistence that a reform is literally impossible because it goes against everything that we know is natural about human beings and social arrangements. This is the ploy that Malthus used in his Essay on the Principle of Population (1992 [1798]) to challenge the egalitarian ideas of William Godwin. Malthus professed to admire the beauty of Godwin’s vision, but he ultimately dismissed the vision as impossible. It was futile because Malthus declared it to be against the laws of nature—in other words, utopian. The rhetoric of futility is the main weapon that conservative intellectuals have wielded against socialists and communists for more than two centuries. They contend that an egalitarian social order would destroy any incentives for effort and creativity, which makes it utterly inconsistent with human nature. -

ISBN 978-1-78467-046-7 i December 2015: The evolution of European traded gas hubs Preface In following the process of the transition of continental European gas pricing over the past decade, research papers published by the OIES Gas Programme have increasingly observed that the move from oil-indexed to hub or market pricing is a clear secular trend, strongest in northwest Europe but spreading southwards and eastwards. Certainly at an overview level, such a statement appears to be supported by the measurable levels of trading volumes and liquidity. The annual surveys on pricing of wholesale gas undertaken by the IGU also lend quantitative evidence of these trends. So if gas hub development dynamics in Europe are analogous to ‘ripples in a pond’ spreading outwards from the UK and Dutch ‘epicentre’, what evidence do we have that national markets and planned or nascent hubs at the periphery are responding? This is more than an academic question. -

In addition to information about derivatives, Schedule RC-L includes the following selected commitments, contingencies, and other off-balance sheet items that are not reportable as part of the balance sheet of the Report of Condition (Schedule RC). Among the items not to be reported in Schedule RC-L are contingencies arising in connection with litigation. For those asset-backed commercial paper program conduits that the reporting bank consolidates onto its balance sheet (Schedule RC) in accordance with FASB Interpretation No. 46 (Revised), any credit enhancements and liquidity facilities the bank provides to the programs should not be reported in Schedule RC-L. In contrast, for conduits that the reporting bank does not consolidate, the bank should report the credit enhancements and liquidity facilities it provides to the programs in the appropriate items of Schedule RC-L. The term “derivative” is used because the price of a future or option is derived from the price (level) of an underlying asset (variable). In this chapter, we introduce derivatives as tools that companies use to reduce price risk . An action that reduces price risk is called a hedge. We will focus on hedging with derivatives. An action that increases price risk is called speculating. Speculators accept price risk in the hope of making a profi t. The derivatives markets are a place where hedgers pass their price risk off to speculators. Market Information – Glossary of Terms Centrifuge. A perforated appliance which spins inside a casing to separate sugar crystals from molasses. Sugar that has come through a centrifuge is centrifugal sugar. Chicago Board of Trade (CBOT). Established in 1848, it is the oldest financial futures and options exchange in the world and situated in Chicago, Illinois. In 2007, the Chicago Board of Trade merged with the Chicago Mercantile Exchange to form the CME Group. Some its commodity futures prices (such as wheat, soya beans and maize) form the principal world price benchmarks. Contract expiry. The date at which trading a particular futures contract ends and becomes either physically or cash settled. For the New York No. 11 raw sugar contract this is the last trading day of the month prior to the delivery month. For the London No. 5 white sugar contract it is sixteen calendar days before the first day of the delivery month. Free on Board (FOB). A term requiring the seller to deliver goods on board a vessel designated by the buyer. The seller fulfils their obligation to deliver when the goods have passed over the ship's rail. Generally, a seller has an obligation to deliver goods, and assume the costs of delivery to a named place for transfer to a carrier, such as a ship. EU sugar regime. In 2006 a major reform achieved simplification and greater market orientation of the EU's sugar policy. The total EU production quota of 13.5 million tonnes of sugar is divided between nineteen Member States, of which the UK’s share is 1.056mt.
