Mail Code: 1101A Washington, DC 20460 Re: Docket ID number EPA-HQ-OPP-2010-0541, Petition to Suspend and Cancel All Registrations for the Soil Fumigant Iodomethane (Methyl Iodide) Dear Administrator Jackson, We are pleased to see that US EPA has decided to reconsider the registration of methyl iodide for its use as a soil fumigant pesticide. We remain concerned about the wisdom of widespread dispersion of methyl iodide into the environment and support the petition to cancel all uses of this chemical as a pesticide. It is one of the more hazardous chemicals used in research labs and in the chemical industry, and it seems counterintuitive that EPA would work on one hand to prevent and document relatively small releases of methyl iodide used in research and chemical manufacturing, while permitting what will likely be millions of pounds to be used annually in agriculture near homes, schools and workplaces. In our letter to EPA of September 24, 2007, (which we sent a copy of to you in February of 2009), we strongly recommended that EPA not register methyl iodide, but if the Agency chose to do so, we recommended that US EPA obtain an external scientific peer review of the risk assessment. While EPA did not commission such a review, the state of California has conducted its own risk assessment and did commission a Scientific Review Committee (SRC) to evaluate US EPA’s and the California Department of Pesticide Regulation’s (DPR’s) risk assessments. -

SARVER STRATEGIES Jenifer Sarver Principal, Sarver Strategies Jenifer has nearly two decades of experience in media relations, crisis communications, speechwriting, coalition building, and media and presentation skills training. Her career has spanned the corporate, nonprofit and political worlds, helping clients develop messages that will resonate with their core audiences and create strategies for effectively delivering those messages through the appropriate communications channels. In launching Sarver Strategies, Jenifer focused her skills on training and storytelling, helping clients develop a narrative that effectively conveys their core values, and then preparing them to effectively deliver that message. Jenifer has extensive experience in media and presentation skills training, having conducted workshop and one-on-one trainings for a wide range of public figures including CEOs, foreign leaders, local and state political candidates and office holders, and nonprofit leaders. Jenifer teaches courses on public speaking, advocacy communications, speechwriting, storytelling and confidence in communication, among other topics. She has been a guest lecturer at UT Austin, Concordia University, American University and UT Dallas, among other institutions. She has taught at the Yale Women’s Campaign School. She regularly presents at conferences and delivers keynotes remarks. She has conducted international trainings in Kenya, Tunisia, Kazakhstan and Australia. Jenifer spent nearly six years as Chief of Staff to Ambassador Karen Hughes, the Worldwide Vice Chair of Burson-Marsteller. The Origins (and Fragility) of Judicial Independence Tara Leigh Grove* The federal judiciary today takes certain things for granted. Political actors will not attempt to remove Article II judges outside the impeachment process; they will not obstruct federal court orders; and they will not tinker with the Supreme Court's size in order to pack it with like-minded Justices. And yet a closer look reveals that these "self- evident truths" of judicial independence are neither self-evident nor necessary implications of our constitutional text, structure, and history. This Article demonstrates that many government officials once viewed these court-curbing measures as not only constitutionally permissible but also desirable (and politically viable) methods of "checking" the judiciary. The Article tells the story of how political actors came to treat each measure as "out of bounds" and thus built what the Article calls "conventions of judicial independence." But implicit in this story is a cautionary tale about the fragility of judicial independence. -
