These decisions follow an earlier announcement by the NPC Standing Committee on October 26, 2018 authorizing the establishing of this new division of the SPC (officially translated as IP Court of the Supreme Court of SPCIP, with the Chinese name 最高人民法 院知识产权法庭). There were also indications that such a court was in the works that were previously reported in this blog in 2017. The newly established IP Court is intended to function very similarly to the US Court of Appeals for the Federal Circuit, with a national jurisdiction over technical IP cases as well as appeals of patent and trademark validity decisions. This is a much awaited, historic and potentially disruptive breakthrough in the China IP litigation system, that has been a focus of much discussion between US and Chinese experts over 20 or more years, notably between the SPC and former CAFC Chief Judge Rader, former USPTO Director Kappos , and others (including the author/owner of this blog). -

It is worth reflecting upon the progress in their relations since then, as well as the prospects of consolidating and deepening the relations in the future in the face of the new challenges and opportunities. 1. Positive changes for the development of peaceful cross-strait relations Over the past six years since May 2008, the mainland and Taiwan have made substantial progress in developing peaceful relations in the following four areas: Peaceful development has gained increasing momentum in cross-strait relations. The balance of power has apparently tilted towards the mainland, and this trend will continue for a long time. The mainland not only surpasses Taiwan in size, but has also outpaced the island in economic growth and global influence. With its growing strengths, the mainland has gradually assumed the leading role in cross-strait relations, whereas Taiwan has not found a way to stem its decline, which was publicly acknowledged by Su Chi, a key member of Ma Ying-jeou’s brain trust. -

The Executive Director welcomed participants to the Inter-sessional Working Group for the Regional Observer Programme (IWG-ROP), 24-25 September 2007. He reviewed activities that had been undertaken electronically during 2007 to support the work of the IWG-ROP using the guidance provided in Conservation and Management Measure 2006-07 adopted at the Third Regular Session of the Commission, 11-15 December 2006 at Apia, Samoa. 2. Participants included representatives from Australia, Canada, Federated States of Micronesia, Fiji, Japan, Kiribati, Republic of Korea, Marshall Islands, Nauru, New Zealand, Niue, Palau, Papua New Guinea, Philippines, Samoa, Solomon Islands, Chinese Taipei, Tokelau, Tonga, Tuvalu and the United States of America. The Secretariat of the Pacific Community Oceanic Fisheries Programme (SPC-OFP), the Pacific Islands Forum Fisheries Agency and WCPFC Secretariat also attended. In fact, candidates without prior experience in elected seats of the island’s political structures are no strangers to the LY. Moreover, in the 2016 parliamentary elections, the political novices enjoyed unprecedented support and achieved relative success. The New Power Party (NPP), which only formed in early 2015 and popular mainly due to the several debutants it fielded, including Freddy Lim, Hung Tzu-yung and Huang Kuo-chang, emerged as the LY’s third-largest party. Although it garnered only five of the 113 seats (4.4%), it was a great win for the fledgling party, ranking it third behind the Kuomintang (KMT) and the Democratic Progressive Party (DPP), which have reigned over the island’s political scene for the past several decades. This article examines the phenomenon of Taiwanese novices. It looks at them from the voters’ perspective. It surveys the demographic profiles and political preferences of Taiwanese who support the newcomers’ engagement in the political process, and compares them with citizens who express negative attitudes toward the newcomers. Since Ms. Tsai Ing-Wen's Election As President of the Republic of China
Beijing’s Policy Towards President Tsai Ying-wen and the Future of Cross-Strait Relations by Jean-Pierre Cabestan ince Ms. Tsai Ing-wen’s election as President of the Republic of China (ROC), STaiwan on January 16, 2016 and even more since her inauguration on May 20, 2016, Beijing’s policy towards the island-state has been both rigid and assertive. The People’s Republic of China’s (PRC) authorities have kept asking the new Taiwanese administration to endorse the so-called “92 consensus”—according to which there is “one China” but neither side tries to define it—that, contrary to the defeated Kuomintang (KMT), Ms. Tsai and her Party, the Democratic Progressive Party (DPP), which now controls a majority of seats in the Legislative Yuan, or Taiwan’s Parliament, are not going to do. As a result, the Chinese Communist Party (CCP) has decided to stop all high-level contacts with the Taiwanese government and instead has intensified its united front policy aimed at reaching out the segments of the Taiwanese polity and the society that disagree with the new president and her team—the KMT and their elected national and local representatives as well as the Taiwanese business community. This divide-and-rule-strategy is served by a stronger—though more slowly growing—economy, a more assertive foreign policy, especially towards the United States, and a more robust and threatening military. Beijing’s objectives are pretty clear and simple: contribute to Ms. Tsai’s failure in weakening her position and delegitimizing her policy choices, both in the eyes of Taiwan’s political, business elites and voters as well as, hopefully, the new American Administration; and, consequently, help the KMT and the “blue camp” as a whole to come back to power in 2020 in developing close relations with them and their business allies who have vested interests in or with China.
