RESOLVED that:-

(i) determination of planning application P/98/0696 be deferred for up to six months from the date of this meeting for the completion of a Section 106 Agreement to achieve the following;

• upon completion of the works to the listed building identified in the commercial appraisal dated 15th October 1998 and an agreed detailed schedule of works in accordance with such listed building consent as may be granted, ten houses, at locations to be agreed with the Local Planning Authority, shall be released for occupation; such houses having been constructed either concurrently with or after the completion of the listed building work.

• no works shall commence on the remaining twelve houses until a Listed Building Consent has been obtained in respect of the substantial completion of the listed building (including the internal planning, detailing of internal panelling, painting, stairs, skirtings, coving, doors, etc) and sunken garden.

• upon completion of the works approved under the Listed Building Consent above, the twelve houses shall be released for occupation; such having been constructed either concurrently with or after the completion of the listed building works.

• the development shall be restricted to no more than 22 new dwellings. These dwellings, or their plots, shall not be sub divided.

(ii) upon completion of this Agreement officers be authorised to issue planning permission in respect of application no. P/98/0696 subject to the conditions contained in the officer’s report and the following additional condition;

Condition:-

“Sound insulation between units in a manner to be agreed, in writing, with the Local Planning Authority shall be provided before the occupancy of any of the apartments and thereafter maintained such that a minimum attenuation of 48 dB (Airborne) and Grade I (Impact) for floors and 49 dB (Airborne) for walls is achieved”.

Reason:-

“To secure reasonable privacy and enjoyment for the occupiers of the proposed apartments”.

(vi) provided no adverse observations are received from Cadw officers be authorised to grant Listed Building Consent for the application upon the completion of the Section 106 Agreement subject to the conditions contained in the officer’s report and the following additional condition;

Having regard to highway conditions, it was resolved that consideration of this application be deferred for a site visit by the Chairman and Vice Chairman and ward members.

An objector Mrs V. Hatton was present to address the committee. The applicant was not present. Both sides would be invited to the next meeting.

1816 Code No. P/98/1084 - Change Use from A1 Retail to A3 at Ground Floor at First Floor levels to Form a Traditional Real Ale Bar Selling Wine and Food at 61-63 High Street, Blackwood

RESOLVED that:-

(i) subject to the conditions contained in the officer’s report and the following additional conditions, application no. P/98/1084 be granted;

(a) there shall be no storage of refuse outside the building except in a manner to be first agreed in writing with the Local Planning Authority;

Reason: To ensure that refuse is stored satisfactorily in the interests of the amenities of the locality.

(b) Prior to the commencement of the use hereby approved an odour filtration and control system shall be installed in accordance with details (which shall include details of any external stacks or vents) which shall be first agreed in writing with the Local Planning Authority.

Reason: To ensure that odour is satisfactorily controlled in the interests of the amenities of the area.

RESOLVED that subject to the prior completion of a Section 106 Agreement under the Town and Country Planning Act 1990 to secure non implementation of planning consent of 5/5/95/0359, officers be authorised to grant consent subject to the conditions contained in the report;

RESOLVED that:-

(i) subject to the conditions contained in the officer’s report, but with Condition (1) and Reason (1) being amended as follows, application no. P/98/1090 be granted;

1822 Code No. P/98/1095 - Regrade and Full Reinstatement to Agricultural Field on Land at Kendon Farm, Trinant Road, Crumlin

RESOLVED that:-

(i) subject to the conditions contained in the officer’s report, and the following additional conditions, application no. P/98/1095 be granted;

Extra Conditions:-

5. The landfill hereby approved shall only operate between the hours of 07.30 and 1800 on Monday to Friday, 08.00 and 1300 on Saturday, and shall not operate at all on Sunday or on bank holidays.

Reason: In the interests of the amenities of the area.

6. There shall be no vehicular access to the landfill directly to or from the public highway that runs along the eastern side of the site.

Reason: In the interests of highway safety.

7. Prior to the commencement of the landfill, details of the means of access to the site shall be agreed in writing with the Llocal Planning Authority. Thereafter the access to the landfill shall be carried out in accordance with the agreed details.

8. Prior to the commencement of work on site, details of the phasing of the landfill and of surface water drainage shall be submitted to and agreed in writing with the Local Planning Authority. The landfill shall be carried out in accordance with the agreed details.

RESOLVED that subject to the conditions contained in the officer’s report, but with Condition 4 being amended as follows, application No. P/98/1097 be granted.

(4) The premises that fall within the use classes A3 (hot food retail) and D1 (training and prayer/worship), of the Town and Country Planning (Use Classes) Order 1987 (or any order revoking or re-enacting that Order), shall not be open for use between 22.30 hours to 08.30 hours daily. The areas indicated in the submitted details for those uses shall be cleared of customers except during the hours hereby permitted.

RESOLVED that subject to the conditions contained in the officer’s report, application no. P/98/1112 be granted.

1826 Code No. P/98/1115 - Erect Nursing Home, 44 Beds and 20 Parking Spaces on Land at North View Terrace, Caerphilly

RESOLVED that:-

(i) subject to the conditions contained in the officer’s report, and the following additional conditions, application no. P/98/1115 be granted;

(5) The access to the site shall be provided with vision splays of 3 x 33 metres, which shall be maintained free of any obstruction or planting when mature which exceeds 0.6 metres in height.

(6) The junction of Southern Street with North View Terrace shall be provided with a vision splay of 3 x 33 metres measured from the centre line of Southern Street in the north east direction, which shall be maintained free of any obstruction or planting when mature which exceeds 0.6 metres in height.

(7) Notwithstanding the submitted details there shall be no pedestrian or vehicular access to Southern Street.

(8) Prior to any development commencing on site, details of a scheme for vehicular access for deliveries and service to the kitchen and cleaning areas shall be submitted to the Local Planning Authority for approval and shall thereafter be carried out in accordance with the approved details prior to beneficial occupation of the development hereby approved. That scheme shall also include provisions for refuse storage and collection.

(9) Prior to any development commencing on site, details of the ventilation of the kitchen/cooking area(s) shall be submitted to the Local Planning Authority for approval and shall thereafter be carried out in accordance with the approved details prior to beneficial occupation of the development hereby approved.

(10) Prior to the commencement of any work on site, a scheme of investigation for the archaeological excavation of the area to be developed shall be submitted to and agreed by the Local Planning Authority and the works shall thereafter be carried out in accordance with that scheme. Such a scheme shall include the supervision of a suitably qualified archaeologist who will record any remains, the results of that work shall be published and a copy shall be provided to the Local Planning Authority.

(11) Before any development takes place on site details of the slab level of the development shall be submitted to and approved by the Local Planning Authority.
