As required by the Federal Register Notice issued by Copyright Royalty Judges (“Judges”), MPAA included, as Exhibit A, detailed lists of its represented claimants for each of the 2010, 2011, and 2012 cable and satellite royalty years, including identifying the claim number associated with each MPAA-represented claimant as to each year. See 79 Fed. Reg. 76396 (December 22, 2014). In the course of preparing its January 21, 2015 filings, MPAA discovered that one of its represented claimants, Telco Productions, Inc. (“Telco”), which filed a timely claim for the 2011 satellite royalty year, did not appear on official claim list of Copyright Royalty Board (“CRB”) for that year (“2011 Satellite Claims List”). As a result of Telco’s omission from the 2011 Satellite Claims List, MPAA did not have a 2011 satellite claim number reference to associate with Telco in Exhibit A to its January 21, 2015 filing. Thereafter, on February 4, 2015, MPAA received an updated copy of the 2011 Satellite Claims List from the CRB. This updated copy of the 2011 Satellite Claims List assigned claim number 211 to the Telco claim. Accordingly, MPAA respectfully moves to amend Exhibit A to its petition to participate for the 2011 satellite royalty year to reflect Telco’s claim as claim number 211. Attached to this Motion as Exhibit A is a revised list of all MPAA-represented claimants for the 2011 satellite royalty year that includes the claim number designation for Telco. Also, accompanying this filing is a CD ROM containing a revised copy of the Microsoft Excel worksheet that MPAA submitted with its original satellite petition to participate, which now reflects Telco’s the 2011 satellite claim number assigned to Telco. Through a combination of organic growth and strategic acquisitions, our revenues for the year rose by more than 30% to $775.4 million, resulting in GAAP net income of $34 million, or $0.86 per diluted share. GAAP net income in 2005 was reduced by various non-cash charges primarily associated with our acquisition of Pinnacle Systems, Inc. – including a non-recurring in-process research and development charge of $32.4 million. The Pinnacle acquisition was the pivotal event for Avid in 2005. Pinnacle’s professional products complemented our portfolio of video postproduction and broadcast solutions, and the company’s leadership in consumer video editing – with the world-leading Pinnacle Studio™ line – gave Avid an opportunity to expand into this industry in a position of strength. As we head into 2006, we are now organized as three divisions: Video, which represents a little more than half of our business; Audio, which makes up slightly more than one-third; and Consumer, accounting for the balance.
