chapter 7 Men, Monsters and the History of Mankind in Vattel’s Law of Nations Pärtel Piirimäe 1 Introduction Emer de Vattel has been widely considered a seminal figure in the European tradition of the law of nations. While attaching himself to the earlier tradition of natural jurisprudence, he offered a normative system of the law of nations that was more firmly and explicitly anchored to the political practice of his contemporary Europe than were the doctrines of his predecessors. Vattel pro- moted the practical applicability of his Droit des gens (1758), stressing that it was not so much written for interested ‘private individuals’, i.e. other scholars or the general public, but it was a ‘law of sovereigns’ that was primarily in- tended for ‘them and their ministers’. It would not help much, he explained, if his maxims were studied only by those who had no influence over public affairs; the ‘conductors of states’, on the other hand, if they chose to learn this science and adopt its maxims as the ‘compass’ for their policies, could produce many ‘happy results’.1 Vattel emphasized the easy comprehension and applica- bility of his book, contrasting his approach with that of Christian Wolff, whose treatise on the law of nations could be understood only if one ‘previously stud- ied sixteen or seventeen quarto volumes which precede it’.2 As Vattel famous- ly declared, his original intention was to introduce Wolff’s system to a wider readership, by rendering his rigid and formal work more ‘agreeable and better calculated to ensure it a reception in the polite world’.3 While it is clear that Vattel’s work amounted to much more than a system- atic account of Wolff’s principles,4 it is in the manner of presentation that the differences between the two scholars are the most striking. -

REID IN EUROPE DANIEL SarutTHESS For several decades, Thomas Reid enjoyed a wide readership in Continental Europe, and his works contributed much to shape its philosophical ways.1 This is true for Cennany, as Manfred Kuehn has shown in his extended study Swttish Common Sense in Germany, 1768-1800: A Contribution to the History aJCritical Philosophy.2 It is true also for France, although at a somewhat Iater time. The local adaptations of the Scottish doctrines in France were corn.mon to a degree that very few suspect today. In his classical paper "De l'influence c;le la philosophie écossaise sur la philosophie français'13, Emile Boutroux unëletlined that in France in the 1870s, Scottish doctrines stiI1 dominated the teaching of philosophy at the pre-university level (p.441). Theywere central to the philosophical climate during practically the whole 19th century. There is a link of some interest between the German and the French reception of Reid in the persan of Pierre Prevost (1751-1839), a philosopher and scientist from Geneva. Prevost stayed in Berlin in the 1780s before returning to Geneva ta teach a philosaphy clearly permeated by Scottish doctrines. I have found some new material on Prevost which has been published recently, but this will not i be my tapie in this paper.4 ~-/~,~. Germany and France are not the whole of Europe and the title of t:his paper may thus appear ambitious, net to say scandalous, to some readers. But in fact, ~~PL given that Scottish doctrines were more popular in Franœ than anywhere el.se on the Continent, and thatitwas largely France that contributed ta making them known elsewhere, I shall concentrate on that country. -

WOLFE OFER GAL It was in 1660s England, according to the received view, in the meetings of the Royal Society of London, that science acquired the form of empirical enquiry that we recognize as our own: an open, collaborative experimental practice, mediated by specially-designed instruments, supported by civil, critical discourse, stressing accuracy and replicability. Guided by the philosophy of Francis Bacon, by Protestant ideas of this-worldly benevolence, by gentlemanly codes of decorum and integrity and by a dominant interest in mechanics and a conviction in the mechanical structure of the universe, the members of the Royal Society created a novel experimental practice that superseded all former modes of empirical inquiry– from Aristotelian observations to alchemical experimentation. It is enlightening to consider that this view is imparted by both the gentlemen of the Royal Society, in their official self-presentations, and by much of the most iconoclastic historiography of our time. Lines like ―Boyle‘s example … was mobilized to give legitimacy to the experimental philosophy,‖1 are strongly reminiscent of Bishop Sprat‘s 1667 eulogy of the ―Lord Bacon in whose Books there are everywhere scattered the best arguments for the defence of experimental philosophy; and the best directions, needful to promote it.‖2 One reason for the surprising agreement is that this picture of openness, benevolence and civility does capture some of the moral-epistemological mores of the empiricism of the New Science, but this very agreement of historians and apologists also harbors a paradox. -

Why was there no controversy over Life in the Scientific Revolution? * Charles T. Wolfe Unit for History and Philosophy of Science University of Sydney Well prior to the invention of the term ‗biology‘ in the early 1800s by Lamarck and Treviranus, and also prior to the appearance of terms such as ‗organism‘ under the pen of Leibniz in the early 1700s, the question of ‗Life‘, that is, the status of living organisms within the broader physico-mechanical universe, agitated different corners of the European intellectual scene. From modern Epicureanism to medical Newtonianism, from Stahlian animism to the discourse on the ‗animal economy‘ in vitalist medicine, models of living being were constructed in opposition to ‗merely anatomical‘, structural, mechanical models. It is therefore curious to turn to the ‗passion play‘ of the Scientific Revolution – whether in its early, canonical definitions or its more recent, hybridized, reconstructed and expanded versions: from Koyré to Biagioli, from Merton to Shapin – and find there a conspicuous absence of worry over what status to grant living beings in a newly physicalized universe. Neither Harvey, nor Boyle, nor Locke (to name some likely candidates, the latter having studied with Willis and collaborated with Sydenham) ever ask what makes organisms unique, or conversely, what does not. In this paper I seek to establish how ‗Life‘ became a source of contention in early modern thought, and how the Scientific Revolution missed the controversy. ―Of all natural forces, vitality is the incommunicable one.‖ (Fitzgerald 1945: 74) Introduction To ask why there was no controversy over Life – that is, debates specifically focusing on the status of living beings, their mode of functioning, their internal mechanisms and above all their ‗uniqueness‘ within the physical universe as a whole – in the Scientific Revolution is to simultaneously run the risk of extreme narrowness of detail and/or of excessive breadth in scope. -

DOI: https://doi.org/10.32881/jomp.3 RESEARCH Staying Optimistic: The Trials and Tribulations of Leibnizian Optimism Lloyd Strickland Manchester Metropolitan University, GB [email protected] The oft-told story of Leibniz’s doctrine of the best world, or optimism, is that it enjoyed a great deal of popularity in the eighteenth century until the massive earthquake that struck Lisbon on 1 November 1755 destroyed its support. Despite its long history, this story is nothing more than a commentators’ fiction that has become accepted wisdom not through sheer weight of evidence but through sheer frequency of repetition. In this paper we shall examine the reception of Leibniz’s doctrine of the best world in the eighteenth century in order to get a clearer understanding of what its fate really was. As we shall see, while Leibniz’s doctrine did win a good number of adherents in the 1720s and 1730s, especially in Germany, support for it had largely dried up by the mid-1740s; moreover, while opponents of Leibniz’s doctrine were few and far between in the 1710s and 1720s, they became increasing vocal in the 1730s and afterwards, between them producing an array of objections that served to make Leibnizian optimism both philosophically and theologically toxic years before the Lisbon earthquake struck. Chapter 2 The Problem of Change An evolving world is a world of change. A created world does not change. It just is. Or if it seems to change, the change is only apparent, as it is preconceived and preordained by the blueprint of Creation. Change is paradoxical: how can something change and yet remain the same? How much remodeling can be done to a house before we no longer call it the same house, but a new and different one? Some Ancient Greek philosophers solved the ‘problem of change’ through the concept of dynamic permanence: planets are in constant motion, continuously changing their position relative to other heavenly bodies, but they travel in immutable, eternal orbits. These orbits can be described in terms of universal laws of nature, which in turn can be expressed in the timeless language of mathematics. The concept of dynamic permanence is less easily applied to organisms. The developing chicken appears to change continuously, but here, organs such as the heart, the brain, and the limbs seem to come into existence without having been apparent before. -

How to Buy a Continent: The Protocols of Indian Treaties as Developed by Benjamin Franklin and Other Members of the American Philosophical Society Abstract In 1743, when Benjamin Franklin announced the formation of an American Philosophical Society for the Promotion of Useful Knowledge, it was important for the citizens of Pennsylvania to know more about their American Indian neighbors. Beyond a slice of land around Philadelphia, three quarters of the province were still occupied by the Delaware and several other Indian tribes, loosely gathered under the wing of an Indian confederacy known as the Six Nations. Relations with the Six Nations and their allies were being peacefully conducted in a series of so-called “Indian Treaties” that dealt with the fur trade, threats of war with France, settlement of grievances, and the purchase of land. -

Pre-Darwinian thinking, the voyage of the Beagle, and the Origin of Species How did life originate? What is responsible for the spectacular diversity that we see now? These are questions that have occupied numerous people for all of recorded history. Indeed, many independent mythological traditions have stories that discuss origins, and some of those are rather creative. For example, in Norse mythology the world was created out of the body of a frost giant! Some early attempts at scientific or philosophical discussion of life were apparent in Greece. For example, Thales (the earliest of the identified Greek philosophers) argued that everything stemmed ultimately from water. He therefore had a somewhat vague idea that descent with modification was possible, since things had to diversify from a common origin. Aristotle suggested that in every thing is a desire to move from lower to higher forms, and ultimately to the divine. Anaximander might have come closest to our modern conception: he proposed that humans originated from other animals, based on the observation that babies need care for such a long time that if the first humans had started like that, they would not have survived. Against this, however, is the observation that in nature, over human-scale observation times, very little seems to change about life as we can see it with our unaided eyes. Sure, the offspring of an individual animal aren’t identical to it, but puppies grow up to be dogs, not cats. Even animals that have very short generational times appear not to change sub- stantially: one fruit fly is as good as another.
