2 1.0 Consultation under Regulation 25

1.1 Before preparing the Statement of Community Involvement, in March to April 2005 we consulted with the bodies listed in Appendix 1 (other than adjoining Parish Councils) to gather their views on consultation in our area. To this purpose we used:

• A series of workshops and follow up telephone calls to parties unable to attend; • A questionnaire to the Leicestershire County Council Citizen’s Panel and key questions to the Leicester City Citizen’s Panel; • A letter, newsletters and questionnaires to all parish councils; • Newsletters and questionnaires distributed through all libraries and available on the Leicestershire County Council website; • Open surgeries.

1.2 The main issues raised in this round of consultation were:

♦ The need for education and information, as well as opportunities to participate in decision-making, throughout Leicestershire County Council’s planning process. It was generally agreed that planning for development in general and waste and minerals in particular are of real interest and concern to many people in Leicestershire, but that it is important to explain the issues and options, limitations and imperatives properly, to generate interest, give people confidence in their understanding of what needs to be achieved and in turn allow them to take part in decision-making in a meaningful way. ♦ The need to use a wide range of techniques and approaches to reach different people and give them choice in the way they respond. Another important point was that Leicestershire County Council needs to understand that while people may want to take part, they have many other commitments in their lives. Stakeholders and community members need to be given control, flexibility and choice in when and how they decide to get involved at any given time. It was interesting how many different variations of preferred methods of involvement were suggested, highlighting the truth of the view that the widest range of approaches possible is needed to reach the widest number of people. ♦ The need for different types of involvement for different elements of the planning process. Everyone agreed that what might be the right kind of involvement for the sustainability appraisal, would be different for strategic plan making, different again when it came to discussing particular major proposed development sites and different again for small applications ♦ The need for key stakeholders, such as the city, borough, district and parish councils; the local strategic partnerships; industry; and special interest groups to take a proactive role. The proactive role required of key stakeholders in helping to inform, generate interest and encourage involvement on a local level also emerged as centrally important.

3 1.3 The results of the workshops, questionnaires and Citizen’s Panel are attached at Appendices 2 to 4. A copy of the newsletter is attached at Appendix 5.

1.4 We addressed these issues in a draft SCI by including provision for:

• Building on existing community involvement work, using many of our established techniques and approaches, such as the Citizen’s Panel and the help and support of key stakeholders and groups such as the district and parish councils, the local strategic partnerships and the voluntary and community sector organisations listed in the Leicestershire County Compact.

• Exceeding the minimum legal requirements where we feel it is necessary to ensure a genuinely participative process. The SCI sets out how we will use a range of communication and involvement techniques designed to reach a wide range of people and to respond to the need to educate, inform, consult, involve and feed-back at different stages in - and for different elements of - the planning process. The aim is to: • Reach and engage as many people as possible as early in the planning process as we can to develop consensus; • Provide opportunities for people to take part at all stages of the planning process in a variety of ways; • Use different types and scales of consultation appropriate to different elements of the planning; • Give people choice in the way they respond; • Make sure that we inform and educate as well as provide opportunities to take part.

• Keeping always in mind the need for realism and to manage expectations, both the community’s and our own. The SCI sets out what is and is not possible in terms of planning for development and the level of involvement and influence that people can expect. It is also realistic about the level of involvement we can ask from our community and the resources we have available to achieve our aims. We believe our approach is practical, achievable and cost-effective, prioritises our time, staff and money where they are needed most and strikes a balance which will encourage as many people as possible to take part in planning for development in Leicestershire, at the same time as offering choice in the level and type of that involvement.

• Including plans for monitoring the progress of the Statement of Community Involvement and how effective it has been, for reporting back to the community and for revising it as necessary.

1.5 We then carried out a further consultation exercise on the draft SCI from June to September 2005, as follows:

• We sent copies of the document and/or details of where the document was available for inspection to all the statutory consultees and bodies listed in Appendix 1 • The document was available on our website; • Hard copies were available for inspection in libraries;

4 • Hard copies of the document were available on request from the County Council; • A press release to all local media (see Appendix 6); • We held a drop-in day at the County Council for people to discuss the document.

1.6 We received 9 representations on our initial draft SCI. We have revised the draft SCI in view of the comments received. The main amendments are as follows:

• Expanding the list of community groups that might not normally become involved in the process and explaining how such groups might be reached; • Amplifying the proposed approach to community involvement to explain in more detail the types of consultation methods that might be used, given the resources available, and the means of engaging interested parties in the process; • Making reference to Supplementary Planning Documents; • Clarifying the different stages of involvement of informing, consulting, participating and giving feedback; • Confirming that the minimum legal requirements will always be met, with additional approaches as appropriate; • Clarifying the mechanism for monitoring and review of the SCI • Including provision for press advertisements at certain stages of the Framework process; • Appending a list of local liaison committees and the Council’s Development Control Charter.

1.7 A summary of the issues raised and our response is at Appendix 7.

5 2.0 Consultation under Regulation 26

2.1 From February to March 2006 we carried out a consultation exercise for a six week period on the revised pre-submission draft SCI, as follows:

• We sent copies of the SCI with the initial Pre-Submission Consultation Statement and/or details of where the documents were available for inspection to all the statutory consultees and bodies who had been consulted previously; • The documents were available on our website; • Hard copies were available for inspection in libraries; • Hard copies of the documents were available on request from the County Council; • A public notice in local newspapers (see Appendix 8); • A feedback form with a series of questions was provided to assist respondents (see Appendix 9).

2.2 We received 55 representations on the pre-submission draft SCI, and have revised the document in light of the comments received. There was in general broad support for the SCI. The amendments are summarised as follows:

• Clarification of the involvement of some of the stakeholders; • Additional explanation in areas of the document that were unclear; • Inclusion of the possible use of additional community planning tools; • Reference to the availability of the Planning Aid Service.

2.3 A summary of the issues raised and our responses together with the results of the completed feedback forms are at Appendix 10.

2.4 The County Council considered the revisions to the SCI at a Cabinet meeting of 30 May 2006 and approved the document for submission to the Secretary of State. A copy of the cabinet report is at Appendix 11.

MINERALS AND WASTE DEVELOPMENT FRAMEWORK CONSULTATION

Leicestershire County Council is publishing its first round of consultations on two issues: • options for preparing its plans for how raw materials that are needed for the economy are extracted in the County; • options for dealing with the waste that we produce.

The results of the consultation will assist the preparation of the future plans, called the “Framework”, which will be developed over the next 3 years.

Consultation Issues and Options papers will set out the general background and options as to how the Council can plan for the future provision of waste facilities and mineral resources.

Lead Cabinet Member for Community Services, Ernie White commented: “The two issues concerned – Waste and Minerals are both of great significance to Leicestershire and involving people and organisations in preparing these plans is an important part of the consultation process. The County Council will be ensuring that communities are given opportunities to influence the choices that have to be made.”

The Authority has prepared a draft Statement of Community Involvement, which sets out how it is proposed to involve people in the planning process.

The consultation will be with a range of organisations including statutory consultees, district and parish councils, with members of the public also invited to make their views known.

The documents are available on the County Council’s web site (www.leics.gov.uk) and leaflets are available in local libraries and service shops. A “drop-in” session will be held at County Hall on 14th July 2005 and will be available for anyone who wants to learn more about the issues and options. This PRESS RELEASE first consultation period will last for 6 weeks beginning on 20th June 2005. After that the County Council will be considering the response to the consultation exercise and will present its preferred options later this year where there will be further opportunity for people to get involved. The above table indicates the pattern of responses given to the questions posed on the feedback form provided in consultation on the pre-submission draft SCI. In some cases respondents did not answer all the questions. According to the above results the conclusions of the consultation exercise are that the majority of respondents considered that the SCI provided a clear understanding of the planning processes and how to get involved. Only a few felt that there were points on which they were unclear. In these cases responses are provided in Table 1 and appropriate changes have been made to the SCI. The respondents, with the exception of one, also thought that the approach would provide good community engagement. Most of them also replied that the stakeholders identified were appropriate. Where new stakeholders were specified they have been added to the list of consultees.
