An Act authorizing the Massachusetts bay transportation AUTHORITY TO EXTEND ITS RAPID TRANSIT FACILITIES IN THE CITY OF CAMBRIDGE AND TOWNS OF ARLINGTON AND BELMONT. 1 Whereas, The deferred operation of this act would tend to 2 defeat its purpose which is to enable the Massachusetts Bay 3 Transportation Authority to proceed forthwith with the 4 construction of rapid transit line set forth in this act in order 5 to relieve traffic congestion as soon as possible and to take 6 maximum advantage of federal aid under the Urban Mass 7 Transportation Act of 1964, therefore, it is hereby declared to 8 be an emergency law, necessary for the immediate preserva- -9 tion of the public convenience. Be it enacted hy the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: 1 Section 1. The Massachusetts Bay Transportation Au- -2 thority, hereinafter called the authority, may, subject to the 3 approval of the advisory board established by section seven, 4 of chapter one hundred and sixty-one A of the General Laws, 5 construct and equip in an extension of the existing Cam- -6 bridge subway in and through the city of Cambridge and 7 towns of Arlington and Belmont, consisting of a mass trans- -8 portation facility partly in a subway or tunnel and partly on ) HOUSE 1560. Jan. 9 the surface, beginning in the existing subway under Massa- 10 chusetts avenue at Plympton street and extending in a 11 westerly direction approximately nine hundred feet to Har- 12 vard square thence north to the proposed Harvard station 13 between Harvard square and Garden street, and thence to a 14 point under Flagstaff park where it curves to the west and 15 again comes under Massachusetts avenue and extends to the 16 proposed Porter station between Linnean and Arlington 17 streets, for which additional areas beyond the street limits 18 shall be required by station facilities, and as it extends north # 19 from Porter square, it leaves Massachusetts avenue with a 10 curve to the west on a radius of about eight hundred and fifty 21 feet, passes through private property and goes under Mt. 92 Vernon street and Upland road, thence it crosses the Boston 23 & Maine Railroad about four hundred feet west of Massa- 24 chusetts avenue and then rises to the surface near Creighton 25 street, from which point it extends west parallel to the 26 Boston & Maine Railroad to Alewife Brook parkway and 27 after passing under the existing Alewife Brook parkway 28 bridge, it curves to the north and generally follows the 29 Lexington branch of the Boston & Maine Railroad to an area 30 now owned by the metropolitan district commission in the 31 city of Cambridge and towns of Arlington and Belmont. 32 The authority may, for the purpose of this act, use or take 33 land of the commonwealth without compensation therefore, 34 and may acquire, either by purchase or by eminent domain 35 under chapter seventy-nine of the General Laws, such portion 36 of the properties of said railroad and other properties as the 37 ithority may determine to be necessary for said rapid 38 msit line and its appurtenances. After the acquisition of ,d nor the 40 authority shall be responsible for the maintenance or repair 41 of the bridges over that portion of the properties of such 42 railroad acquired by the authority, but said bridges shall I 43 thereafter be maintained and repaired by the state depart- 44 ment of public works, except that any of said bridges pres- 45 ently under the jurisdiction of the metropolitan district 46 commission shall thereafter be maintained and repaired by 47 said commission. 1968 HOUSE — No. 1560. 9 1 Section 2. The provisions of section one hundred and five 9 of chapter one hundred and thirty, section one hundred and 3 seventeen of chapter one hundred and thirty-one, and sec- 4 tions one to twenty-three inclusive of chapter two hundred 5 and fifty-two of the General Laws shall not apply to the use 6 of the land for the purposes authorized by this act. .
