Vol. CX—No. II NAIROBI, 1st February, 2008 Price Sh. 50 GAZETTE NOTICE No. 652 THE CONSTITUTION OF KENYA THE NATIONAL ASSEMBLY AND PRESIDENTIAL ELECTIONS ACT (Cap. 7) THE NATIONAL ASSEMBLY ELECTIONS (ELECTION PETITION) RULES APPOINTMENT OF ELECTION COURTS IN EXERCISE of the powers conferred by section 60 (5) of the Constitution of Kenya and section 19 of the National Assembly And Presidential Elections Act, the Chief J ustice of the Republic of Kenya directs that the Election Petitions whose details are given hereunder shall be heard in the • High Court of Kenya by Election Courts comprising of the Judges and sitting at the court stations indicated, respectively, in the sixth and seventh columns of the schedule below on such dates to be fixed by the Election Courts on priority basis in terms of , section 19 (4) of the said Act. The Election Courts will give directions as to the hearing of the petitions during Mentions thereof on Monday, the 11th February, 2008 except where otherwise indicated in the schedule.     (2016) 4(1) NIBLeJ 5 Drivers of Insolvency Reforms in Kenya Fancy Chepkemoi TOO* Abstract Insolvency frameworks have increasingly become a subject of reform activities all over the world. In fundamental nature, the importance of reforming these regulations is generally recognised but the velocities at which the reforms are realised in different jurisdictions significantly differ. Besides opinions differ as to what the drivers for such reforms are, or ought to be, in a country. How can Kenya’s slow progress and rate of regulatory changes, or lack of them, be explained? Some scholars believe in internal factors, such as the importance of history, social norms or political factors, such as leadership, democracy and/or some form of state centralisation. Others identify the relevance of external factors, in particular international trade or globalisation, with some emphasising the influence of reforms by neighbouring countries through regional integration. In essence, the reform drivers are arguably many and bear some similarity in all jurisdictions. However, the degree of influence of each of the drivers varies in different jurisdictions. In Kenya, insolvency reforms were recently realised with the enactment of the Insolvency Act 2015, yet attempts to reform started in the early 1990s. This article examines the Kenyan reform pathways by identifying and investigating the reform drivers of corporate insolvency law within the wider area of business reforms in Kenya. What Afro-Kenyanist approach can be used to assess and judge performance of presidents and premiers in Kenya and Africa? 19.1.1 Jomo Kenyatta (12 . 12 .1964 - 22 . 8 . 1978) The institution of the Presidency in Kenya was first held by President Jomo Kenyatta. At independence, executive authority was vested in the Queen of England and exercised on her behalf by the Governor-General. A Prime Minister was appointed by the Governor-General from among members of the House of Representatives. The institution of the Presidency was a creation of the first constitutional amendment (Act No. 28 of November 24, 1964). This amendment abolished the office of Prime Minister and created the office of an executive and powerful President who became the Head of State, Head of Government, and Commander-in- Chief of the Armed Forces. 19.2.2 Assumption of Presidency by Kenyatta Kenyatta was then declared President in December 1964 by constitutional or Parliamentary fiat.1 No elections were held in order to give all Kenyans an opportunity to elect a President of their choice; nor was a referendum held on this fundamental constitutional change.

Sc) degree in Botany and Zoology (1990) from the University of Nairobi Cabinet Secretaries (CSs) Cabinet Secretary, Ministry of Interior and Coordination of National Government Dr. Fred Okengo Matiang'i is the current Cabinet Secretary for the Ministry of Interior and Coordination of National Security in Kenya. He assumed office on 7 July 2017 on acting capacity after the sudden Demise of Gen Joseph ole Nkaissery. He took up the full position of Cabinet Secretary for Internal Security and Coordination of National Government after being appointed by President Uhuru Kenyatta in January 2018 in the president's second comprehensive cabinet appointments. On the 22nd of January 2019, President Uhuru Kenyatta, through Executive Order Number 1 of 2019, appointed him chairperson of the National Development Implementation and Communication Cabinet Dr. Fred Okengo Committee. The committee is composed of all Cabinet Secretaries, Matiang’i The Attorney-General and the Head of the Public Service who acts as the secretariat.     Article Settler-Missionary Alliance in Colonial Kenya and the Land Question Julius Gathogo http://orcid.org/0000-0002-1718-0082 Kenyatta University, Kenya Research Fellow, University of South Africa [email protected] Abstract This article sets out to demonstrate the hugger-muggers that oiled the existence of an unholy alliance between European settler-farmers and missionaries—the Anglicans and Presbyterians and/or the Protestant wing in particular—in 20th century Kenya and East Africa, and especially on land policies. With land for settlement being the key factor to both missionaries and settler-farmers, the land question undoubtedly became one of the major factors that glued them together in colonial Kenya (1895–1963). Was the settler-missionary alliance meant to hurt the same people whom the missionaries had come to convert to the God of Christendom? Most importantly, how did the missionaries relate with the African chiefs regarding the land question, especially with reference to Kirinyaga County of central Kenya? This further drives us to wonder: Was the Devonshire White Paper of 1923 and/or the Indian Question related to the land question? The article sets out on the premise that while land remained the most prized commodity in colonial Kenya (1895–1963) and the entire 20th century, the 21st century has seen the church—and especially the afro-Pentecostal wing of the church—focusing on money and wealth without necessarily focusing on land. In its methodology, the article has heavily relied on archival resources, unpublished works, and field work materials, especially with regard to Kirinyaga County of central Kenya where oral sources on missionaries and land acquisition were sought.
