The Division of Marine Fisheries (DMF) has implemented a temporary closure within a discrete nearshore area of Western Cape Cod Bay adjacent to Ellisville (Plymouth/Sandwich) to the use of surf clam/ocean quahog dredge gear. This closure is effective immediately and shall continue to be in effect through October 31, 2017 (Declaration Notice). This action is being taken to alleviate ongoing gear conflicts in the area between dredge fishermen and lobster trap fishermen and protect egg-bearing and new-shell lobsters from interactions with this mobile gear. Surf clam/ocean quahog dredge fishermen will be allowed to access this area again beginning on November 1, 2017.

The temporary closure occurs within a portion of the 0-3 zone from Manomet Point in Plymouth to the east end of the Cape Cod Canal (see map). The closed area is encompassed by an imaginary line drawn from Manomet Point in Plymouth, at 41° 55’ latitude and 70°32.2’ longitude; thence due east for 2.5 miles to where it intersects with a point at 41°55’ latitude and 70°29’ longitude; thence due south along the 70°29’ longitudinal line to where it intersects with the shoreline in the town of Sandwich.

Throughout this summer, there have been ongoing gear conflicts between lobstermen and surf clam/ocean quahog dredge fishermen in this general area. On August 17, DMF met with stakeholders to discuss potential resolutions. Following the meeting, DMF determined the best course of action was to temporarily close the area under existing regulatory authority. The temporary closure will expire after October 31, 2017.

DMF may consider closing this area on a seasonal basis through future rule-making. Any such 7 1 0 2 changes will be subject to a separate public comment and rule making process and will require approval of the Marine Fisheries Advisory Commission. Additionally, DMF intends to hold industry scoping meeting with surf clam/ocean quahog dredge fishermen this fall. The purpose of this meeting will be to discuss the variety of issues facing this fishery and consider a comprehensive review of how this fishery is managed.

Instructions for Public Comment on the Temporary Closure DMF will accept public comment on this temporary closure through September 15, 2017. Any comment received during this period will be reviewed and may be used to alter, amend or rescind the temporary closure. The Massachusetts Lobstermen’s Association (MLA) submits these comments on behalf of our 1800 members in response to the Bureau of Ocean Energy Management’s (BOEM) BOEM 2017-0050 Comments on the Preparation of the 2019-2024 National Outer Continental Shelf Oil and Gas Leasing Program MAA10400 with great concern for the commercial fishing industry and the ecosystem in which they depend upon.

Established in 1963, the MLA is a member-driven organization that accepts and supports the interdependence of species conservation and the members’ collective economic interests. With over 1800 members comprised of fishermen from Maryland to Canada and encompass a wide variety of gear types from fixed gear to mobile gear alike. We are extremely concerned about the negative economic and ecological impacts and oil and gas exploration will have on the commercial fishing industry as well as the shoreside businesses such as marinas, seafood dealers and processors and fuel companies to name a few.

While the MLA continues to work conscientiously through the management process with the Division of Marine Fisheries, the Atlantic States Marine Fisheries Commission as well as the New England Fisheries Management Council to ensure the continued sustainability and profitability of the resources in which our fishermen are engaged in. The MLA is also actively involved in the Northeast Regional Ocean Council, the Massachusetts Coastal Zone Management and MA Ocean Planning Commission to ensure the recommendations and concerns of the commercial fishermen are vetted and implemented.

As stated by Massachusetts Attorney General Maura Healey “The Massachusetts commercial fishing industry generated $7.3 billion in seafood sales in 2015. The state’s maritime economy employed 90,500 workers, paid $3.9 billion in wages, generated more than $9.8 billion in sales, and contributed $6.4 billion to the gross state product. Moreover, we are alarmed and frustrated with the increase in projects that our oceans are besieged with from cables out of Canada, offshore wind in the Southern Waters off New England, offshore and more all have a direct and unknown impacts on the ecosystem. When the commercial 7 1 0 2 fishing industry is told they can not fish somewhere because of a protected species or a coral and now the government is considering allowing the exploration for oil and gas in the Atlantic is completely counter productive.

In closing, the Massachusetts Lobstermen’s Association is hopeful that the Bureau of Ocean Energy Management will make the right judgment to not allow the exploration for oil and gas or grant ANY lease in the Atlantic Ocean, allowing the commercial fishermen here in the Northeast to keep working without any further duress, supplying clean and local protein to the American people.

AG HEALEY OPPOSES NEW FEDERAL OFFSHORE LEASE PLAN THAT COULD OPEN UP MASSACHUSETTS COAST TO OIL OR GAS DRILLING Comments Warn that New Lease Plan Risks Oils Spills That Could Devastate the Massachusetts Fishing Industry and Ravage Coastal Communities

BOSTON— Attorney General Maura Healey has filed public comments with the federal Bureau of Ocean Energy Management (BOEM) opposing the agency’s effort to create a new five-year national offshore oil and gas leasing program that could open up all currently restricted offshore areas to drilling, including Atlantic waters off the Massachusetts coast.

In her comments, AG Healey argues that opening up the Atlantic Ocean to oil and gas leasing would severely threaten the Massachusetts economy and the state’s coastal environment. AG Healey warns that an oil spill could devastate Massachusetts’ commercial fishing industry – the third largest in the country – and the state’s robust recreation and tourism industries.

“By opening up our coastal areas to drilling, the Trump Administration is prioritizing Big Oil over the interest of Massachusetts’ commercial fishing industry, our economy, and our environment,” said AG Healey. “We will continue to fight back against these reckless moves by the administration that threaten our state’s prosperity and our precious natural resources.”

Citing the catastrophic impacts of Bouchard oil spill in Buzzards Bay in 2003, the Massachusetts Lobstermen’s Association is also opposing BOEM’s preparation of the new five- year leasing plan.

Following the issuance of President Trump’s Offshore Energy Strategy Executive Order in April, BOEM issued a request for information and comments on its intent to develop a new five- year plan for oil and gas lease sales in the Atlantic Outer Continental Shelf. The current five- 7 1 0 2 year-plan, which was finalized on Jan. 17, 2017, by the Obama Administration, excludes leasing for gas and oil exploration and drilling in the Atlantic and Pacific Outer Continental Shelf.

The Massachusetts commercial fishing industry generated $7.3 billion in seafood sales in 2015. The state’s maritime economy employed 90,500 workers, paid $3.9 billion in wages, generated more than $9.8 billion in sales, and contributed $6.4 billion to the gross state product. More than 41,000 businesses and 500,000 commercial fishing families along the Atlantic coast oppose offshore oil and gas drilling because of the harm it poses to the coastal ecosystem.

In her comments, AG Healey also contends that the massive and long-lasting economic harm to Gulf coast state economies caused by the Deepwater Horizon oil spill in 2010 reveals the potential disastrous scale of lost jobs, wages, and tax revenue that could result from the effects of an oil spill on commercial fishing in Massachusetts.

An oil spill along the state’s 1,519 miles of tidal coastline - marked by destination beaches in areas like Cape Cod, Cape Ann and Plum Island - could destroy Massachusetts’ tourism and recreation industry. Opening up the currently restricted offshore areas in the Atlantic to drilling will also harm the state’s coastal environment and protected endangered species, including the Northern Right Whale, which feeds in the waters off of the Cape and Nantucket, according to the comment letter. There are only about 500 critically endangered Northern Right Whales remaining worldwide.

AG Healey also notes in her letter that expanded offshore oil and gas drilling is not needed to meet the country’s future energy needs and doing so would increase harmful greenhouse gas emissions.

As part of her office’s longstanding efforts to protect the coastal ecosystem, AG Healey joined seven other attorneys general last month in submitting comments opposing the National Marine Fisheries Service’s proposal to conduct seismic testing for oil and gas drilling in the Atlantic.

By sending her comments this week, AG Healey is urging BOEM to discontinue its effort to create a new five-year plan and maintain the current restrictions on leasing in all offshore areas of the Atlantic Ocean.

The event was attended by thousands of visitors SEAFOOD from around the world all to show their support and love to the local seafood industry. FESTIVAL 2017 This was the 6th Boston Seafood Festival, a celebration of seafood created by the Boston Fisheries Foundation designed to enrich the cultural, economic & social vitality of Boston by promoting all aspects of the commercial fishing industry and the importance to the local economy here in the Commonwealth. There certainly were plenty of things to do, see and eat at this years’ event, from the Battle of the Shuckers, The beer garden, the famous lobster bake and many educational lectures for all to partake in. There were also many sea creatures walking among the patrons bringing smiles to everyone.

The MLA distributed countless MLA handouts on the benefits of eating locally harvested lobsters and seafood. A great time was had by all and we would like to thank MLA’s Secretary Treasurer Dave Casoni, Julia Logan and Wendy Moran for manning the MLA booth.

S EPIRBS have been available e for over forty years. The original ones transmitted on either 121.5 MHz. Or 243 Mhz., the VHF and UHF frequencies used by aircraft. Later, the COSPAS-SARSAT system was developed using polar orbiting satellites and a frequency in the 406 MHz. range. From the analysis of the shift in frequencies received by the satellite and the encoded signal, it was possible to determine within a few miles, the position and identity of the signal. Recent developments have added a GPS receiver which will improve the accuracy. The other development of interest to fishermen and others at sea I the Personal Locator beacon, or PLB. This is worn by an individual and will also transmit position and identification to the satellite. However the PLB must be turned on manually, which may limit its usefulness. The GPS EBPIRB or one manufacturer calls it a “GBIRB” has decreased in price, so it an economical substitute for the EPIRB.

EPIRBs for fishing vessels are classes as type 1 or type 2. The type 1 EPIRB has a hydrostatic Massachusetts's Division of Marine Fisheries, in collaboration with the Atlantic release which will deploy the EPIRB if the Offshore Lobstermen’s Association, is tagging Jonah crabs to investigate migration vessel sinks and it will activate when it contacts water. As we all know, any legal action costs lots of money and this Association needs to be prepared. We certainly would prefer and will continue to try and resolve issues on our fishery without going into court but we must be ready to do so in order to protect our industry and our individual fishermen’s livelihoods. These are real threats and our members frequently say – just sue them – well, that’s fine to say but to do that we need your support. On August 4, 2017 the USDA Foreign Agriculture Service young professionals, 22 in total, visited Lobster Trap in Bourne to learn firsthand about the seafood and lobster business. Dave Madden, Lobster Trap, provided a tour, business overview and discussed some of the challenges and opportunities in exporting lobster to international markets.

M.L.A. Secretary Treasurer, Dave Casoni recently gave a talk to the individuals on the MA. Lobster Industry. The individuals will hopefully be working at U.S. Embassy’s through out the world, promoting U.S. Seafood. The program “Seafood Export U.S.A. Northeast” introduces individuals to global food marketing with concentration on seafood. By direct involvements with industry, individuals will have a better understanding (hopefully) of seafood (U.S.) products (Lobster).

Colleen Coyne, Food Export Seafood Program Coordinator, reviewed the commercial seafood sector more widely, including the importance of USDA’s Market Access Program to support export market development.

On June 28, 2017, the Secretary of Commerce announced that three New England Council members, whose terms were scheduled to expire, had been reappointed to serve for another three years effective August 12, 2017.

• Peter Kendall of New Hampshire was appointed to his third term on the Council; • Elizabeth “Libby” Etrie of Massachusetts was appointed to a second term; and • John Pappalardo of Massachusetts was appointed to a second term. Terry Stockwell of Maine was appointed to fill the seat being vacated by Tooley, who had served three consecutive terms. Stockwell is the Council’s vice chairman and previously served as the state of Maine’s designated fisheries official to the Council. In June, however, Stockwell retired from state service following a 21-year career at DMR, and he now is beginning his first term as a secretarial appointee. Pat Keliher has headed DMR since 2011 and will assume the official state seat at the Council table. He has been active in the Council process over the years and has attended numerous meetings. He is well known and respected among Council members and stakeholders alike. Council members serve three-year terms and can be reappointed to three consecutive terms – a total of nine years – either in a state-specific “obligatory” seat or an “at-large” regional seat. All four 2017 New England Council appointments were for at-large seats.

New England Council Chairman Dr. John Quinn recounted the numerous contributions that Mary Beth Tooley had made over her nine years of service on the Council. “Your steadfast focus was remarkable, not just for scallops and herring – two species of high interest to you – but for all Council actions,” Chairman Quinn said. “You had a gift for incrementally forging consensuses on extremely difficult issues. You remained gracious and measured in the face of controversy and routinely brought a needed dose of reality to the table with your in-depth understanding of the day-to-day operations of both the scallop and herring fisheries.” Dr. Quinn said the Scallop Committee especially benefited from Tooley’s skills during the five years she served as committee chair. He added, “Your effective leadership was immensely respected by all involved.” At the time of the June meeting, the Council was aware that Maine Gov. Paul LePage had nominated Terry Stockwell to fill the seat being vacated by Tooley, although final secretarial appointments had yet to be announced. Still, Dr. Quinn said the Council wanted to thank Stockwell for all he had done to date. In addition to sitting on and heading up numerous Council committees, Stockwell was elected Council vice chairman in 2012 and then served as chair for three years beginning in 2013. “You have been an exemplary leader, and your comradery and jovial demeanor have helped us get through some long days,” said Dr. Quinn of Stockwell. “Your relationships with industry members and familiarity with their vessels, homeports, and families helped humanize our fishery management process.” In honor of Howard King, Chairman Quinn said, “I want to express my thanks for the time you devoted to helping us better understand issues of importance to the Mid-Atlantic Council. As a liaison between your Council and ours, you routinely provided NEFMC Atlantic Herring Plan Coordinator Deirdre Boelke, valuable insight into the evolution of Mid-Atlantic left, with Mary Beth Tooley and Atlantic Scallop Plan management actions, whether for squid, surf clams Coordinator Jonathon Peros. Atlantic Menhaden Stock Assessment Update Finds Resource Not Overfished and Not Occurring

Alexandria, VA – The Commission’s Atlantic Menhaden Management Board reviewed the results of the 2017 Atlantic Menhaden Stock Assessment Update, which indicates the resource remains healthy; it is not overfished nor experiencing overfishing relative to the current biological reference points. In 2016, population fecundity, a measure of reproductive capacity, is estimated to be 83,486 billion eggs which is well above the threshold (57,295 billion eggs) but below the target (99,467 billion eggs). Additionally, total fishing mortality is estimated to be 0.51, below both the fishing mortality threshold (1.85) and target (0.80). The stock assessment update uses the same modeling approach as the 2015 Atlantic Menhaden Benchmark Stock Assessment but added additional years of data from 2014‐2016.

While the stock status was assessed in the same way as the 2015 benchmark report, the reference point values have changed. Adding additional years of data to the model resulted in generally higher fishing mortality values throughout the times series which changed the scale of the reference points. While the scale is different and the trend differs in some years, the stock status for both fishing mortality rate and fecundity has been similar over the past decade.

The Atlantic States Marine Fisheries Commission was formed by the 15 Atlantic coastal states in 1942 for the promotion and protection of coastal fishery resources. The Commission serves as a deliberative body of the Atlantic coastal states, coordinating the conservation and management of nearshore fishery resources, including marine, shell and anadromous species.

Atlantic menhaden is harvested by both commercial reduction and bait fisheries. In 2013, Amendment 2 to the Fishery Management Plan implemented a total allowable catch (TAC) of 170,800 metric tons (mt). The coastwide TAC was increased by 10% to 187,880 mt for the 2015‐ 7 1 0 2 2016 fishing years and by another 6.45% to 200,000 mt for the 2017 fishing year. In 2016, reduction landings were 137,400 mt and accounted for approximately 76% of coastwide landings and bait landings were 43,100 mt and comprised 24% of coastwide landings.

Dear Mr. Brown,

Effective immediately, please terminate the Massachusetts Lobstermen’s Association (Association) membership to Seafood Harvesters of America. At this time the Association has differing viewpoints on critical issues such as catch shares and electronic monitoring, all of which affect the small boat fleet of which our Association is primarily made of.

The Association established in 1963 is a member-driven, self funded organization that accepts and supports the interdependence of species conservation and the members’ collective economic interests and we intend to stay the course for another 54 years.

Going forward we are hopeful to work together on key issues that would impact the commercial fishing industry collectively. Ultimately, achieving a positive outcome the small boat fleet as well as the large vessel fleet alike.

We would like to thank you and the other members of Seafood Harvesters of America for the opportunity to participate over the past several years and wish you the best in you endeavors going forward.
