The Off Broadway production, with previews beginning at the Clurman Theater Sept. 11 and an opening night set for Oct. 2, includes songs that, producers say, have never been performed on a New York stage before, most notably "Rainbows," from an as yet unmade film version of "Into the Woods." Last staged in New York in 1987 in a brief revival by the York Theater Company and seen more recently in regional theaters, "Marry Me a Little" is the story of two lonely people yearning for love, who happen to be residents of the same Brooklyn apartment building and unaware of each other. Conceived by Craig Lucas and Norman Rene, it is a revue without dialogue and draws on songs that were cut from other Sondheim works, among them "Follies," "Company" and "A Little Night Music." "Marry Me a Little" will be directed by Keen's artistic director, Jonathan Silverstein, who will also be overseeing the second production in the company's season, a revival of A.R. Gurney's drama "The Old Boy," from 1991.     DETROIT’S THANKSGIVING DAY TRADITION It was, legend says, a typically colorful, probably chilly, November day in 1622 that Pilgrims and Native Americans celebrated the new world's bounty with a sumptuous feast. They sat together at Plymouth Plantation (they spelled it Plimouth) in Massachusetts, gave thanks for the goodness set before them, then dined on pumpkin pie, sweet potatoes, maize, cranberry sauce, turkey and who knows what else. Actually, fish was just as predominant a staple. And history books say pumpkin pie really debuted a year later. But regardless of the accuracy of the details, that's how Thanksgiving Day is seen by Americans -- except Detroiters. They may have most of the same images as everyone else, but with a new twist that began in 1934. That's when Detroiters and their outstate Michigan compatriots found themselves at the dawn of an unplanned behavior modification, courtesy of George A.     ENTERTAINMENT LAW REPORTER RECENT CASES Paramount Pictures is not entitled to include copy- righted song in videocassettes of "Medium Cool" be- cause synchronization license authorized song's use only for theatrical and television exhibition A synchronization license granting H&J Pictures the right to use the song "Merry-Go-Round" in the film "Medium Cool" and to exhibit the film in theaters and television did not include the right to use the song in videocassettes of the film, a Federal Court of Appeals has held. Herbert Cohen, the copyright holder in the song, which was written by Larry ("Wildman") Fischer, granted the synchronization license to H&J in 1969. Subsequently, H&J assigned its rights, title and interest in "Medium VOLUME 9, NUMBER 12, MAY 1988 ENTERTAINMENT LAW REPORTER Cool" to Paramount Pictures. Paramount eventually manufactured and sold about 2700 videocassettes of the film, receiving a gross revenue of about $69,000 from the sales. When Cohen sued Paramount for copyright infringe- ment, the District Court granted Paramount's motion for summary judgment. In reversing the District Court's de- cision, Judge Proctor Hug set forth the relevant language of the license, which began by granting H&J the "authority ... to record, in any manner, medium, form or language, the words and music of the musical composi- tion ... with ['Medium Cool'], all in accordance with the terms, conditions, and limitations hereinafter set forth ... " Paragraph 4 of the license stated, "The ... license herein granted to perform ... said musical composition is granted for: (a) The exhibition of said motion picture ... to audiences in motion picture theaters ..
