Oxford University Press. 2018. ‘A commonly heard complaint’, remarked Alexis de Tocqueville in his analysis of events leading up to 1789, ‘is that the French have no respect for law’. To his mind, given the corruption characteristic of the Ancien Régime, this was not surprising. He blamed this lack of respect on the deficit of ‘intermediary powers’ capable of integrating the concerns of ‘private individuals’ with the policies of the state. Yet what Tocqueville wrote with respect to attitudes concerning law in pre-Revolutionary France is sometimes also said of the post-1945 Republic, when intermediary powers were quite robust. No sooner did World War II end than did resistance – often violent – arise against dirigisme économique. -

Causes and Consequences of the Inflation Taxi Abstract: While ethical implications of direct taxation systems have recently received renewed attention, a more veiled scheme remains unnoticed: the inflation tax. We overview the causes of inflation, and assess its consequences. Salient wealth redistributions are a defining feature of inflation, as savers and fixed income individuals see a relative wealth reduction. While evasion of this tax is difficult in many instances due to the primacy of money in a monetary economy, the tax codes of most developed countries allow avoidance techniques to be employed. We analyze the ways that inflation taxes may be avoided in an attempt to preserve personal wealth, as well as the consequences of such practices. 1 Causes and Consequences of the Inflation Tax Introduction Much recent literature focuses on the ethics of direct taxation (Joel Slemrod 2007; Bagus et al. 2011; Robert W. McGee 2012c). Whether income and consumption taxes are coercively imposed on both consumers and producers has long been contested. Being this as it may, taxes can be, and often are, remitted to the government voluntarily as if they were not reliant on their coercive imposition. In this case we are led to believe that there is no difference between taxation and voluntarily donations of money to the government –both will result in spending that is consistent with taxpayers’ desires. The curiosity that arises is that if people did not donate money voluntarily to the government, neither coercion nor taxation would be necessary.ii However, the degree of “voluntariness” of the governing process implementing taxation cannot affect the core nature of the problem (Robert McGee 1994). -

ME, MYSELF & MINE The Scope of Ownership _________________________________ PETER MARTIN JAWORSKI _________________________________ May, 2012 Committee: Fred Miller (Chair) David Shoemaker, Steven Wall, Daniel Jacobson, Neil Englehart ii ABSTRACT This dissertation is an attempt to defend the following thesis: The scope of legitimate ownership claims is much more narrow than what Lockean liberals have traditionally thought. Firstly, it is more narrow with respect to the particular claims that are justified by Locke’s labour- mixing argument. It is more difficult to come to own things in the first place. Secondly, it is more narrow with respect to the kinds of things that are open to the ownership relation. Some things, like persons and, maybe, cultural artifacts, are not open to the ownership relation but are, rather, fit objects for the guardianship, in the case of the former, and stewardship, in the case of the latter, relationship. To own, rather than merely have a property in, some object requires the liberty to smash, sell, or let spoil the object owned. Finally, the scope of ownership claims appear to be restricted over time. We can lose our claims in virtue of a change in us, a change that makes it the case that we are no longer responsible for some past action, like the morally interesting action required for justifying ownership claims. iii ACKNOWLEDGEMENTS: Much of this work has benefited from too many people to list. CHAPTER 18 COUNTY BUDGETS AND FISCAL CONTROL Last Revision September, 2010 18.01 INTRODUCTION Balancing the Budget Ohio counties and other local political subdivisions are required by state law to adopt a budget resolution annually. Along with other local governmental entities, Ohio’s counties should adopt proper financial accounting, budgeting, and taxing standards as part of the requirement to maintain their fiscal integrity. 1 The basic outline of the county budget process is set by state law. Each board of county commissioners is required to pass an annual appropriation measure based on a “tax budget” that certifies that tax revenues and other receipts and resources will be sufficient to meet planned expenditures. It should be noted that ORC Section 5705.281 allows the county budget commission to waive the tax budget, and a number of counties have implemented this authority. For those counties that have waived the tax budget, the county budget commission may require the commissioners to provide other information during the budget process. See Section 18.10 for additional information. Counties maintain a variety of funds that support their programs and services. Budgeting by fund is a distinguishing feature of the public sector. The following passage from the Ohio Revised Code (ORC) contains this fundamental requirement of balancing each fund within a county’s budget: The total appropriations from each fund shall not exceed the total of the estimated revenue available for expenditure therefrom, as certified by the budget commission, or in case of appeal, by the board of tax appeals. -

Kinsella (2007, 2009A) takes issue with this position and likens it to the properly denigrated Lockean pro- viso. The present paper is an attempt to distinguish the two provisos one from the other, and defend the former from Kinsella’s critiques. What is the Lockean proviso? Let us allow “da man” to speak for himself on this issue. According to Locke (1689, emphasis added): “Though the earth, and all inferior creatures, be common to all men, yet every man has a property in his own person: this nobody has any right to but himself. The labour of his body, and the work of his hands, we may say, are properly his. Whatsoever then he removes out of the state that nature hath provided, and left it in, he hath mixed his labour with, and joined to it something that is his own, and thereby makes it his property. -

Left-libertarianism is not a new star on the sky of political philosophy, but it was through the recent publication of Peter Vallentyne and Hillel Steiner’s anthologies that it became clearly visible as a contemporary movement with distinct historical roots. “Left- libertarian theories of justice,” says Vallentyne, “hold that agents are full self-owners and that natural resources are owned in some egalitarian manner. Unlike most versions of egalitarianism, left-libertarianism endorses full self-ownership, and thus places specific limits on what others may do to one’s person without one’s permission. Unlike right- libertarianism, it holds that natural resources may be privately appropriated only with the permission of, or with a significant payment to, the members of society. Like right- libertarianism, left-libertarianism holds that the basic rights of individuals are ownership rights. Left-libertarianism is promising because it coherently underwrites both some demands of material equality and some limits on the permissible means of promoting this equality” (Vallentyne and Steiner (2000a), p 1; emphasis added). -

On the one hand, there are those who favor the pro-choice position. In their view, the woman, and she alone (along with the advice of her doctor – but the final decision must be hers), should be able to legally determine on what basis, and whether, her pregnancy should be conducted. She should be as free to end her pregnancy at any stage of the development of her fetus, or give birth to it after the usual term of nine months. On the other hand, there are those who favor what is called the pro-life position. In this perspective, the fetus, from the moment of conception, is a full rights-bearing human being. -

INTRODUCTION What does Yoga,1 the German band Enigma,2 fan fiction,3 anti-fungal properties of Neem,4 Wikipedia,5 the Chain Art Project,6 and aboriginal paintings have in common? They all belong to a legal lacunae, a lacuna relating to group-rights (or collective rights) in Intellectual Property Law.
