(E.) 240 of 2021 PREVENTION AND CONTROL OF DISEASE (COMPULSORY TESTING FOR CERTAIN PERSONS) REGULATION Compulsory Testing Notice I hereby exercise the power conferred on me by section 10(1) of the Prevention and Control of Disease (Compulsory Testing for Certain Persons) Regulation (the Regulation) (Chapter 599, sub. leg. J) to:— Category of Persons (I) specify the following category of persons:— (a) any person who had been present on the following premises in any capacity (including but not limited to full-time, part-time and relief staff and visitors) at any time on 9 April 2021:— (1) HSBC, Basement, G/F, 1/F, 2/F & 4/F, HSBC Building Tsim Sha Tsui, 82–84 Nathan Road, Yau Tsim Mong, Kowloon, ; (2) Standard Chartered Bank, Basement, Shop B1 on G/F & M/F, Golden Crown Court, 66–70 Nathan Road, Yau Tsim Mong, Kowloon, Hong Kong; (b) any person who had been present on the following premises in any capacity (including but not limited to full-time, part-time and relief staff and visitors) at any time on 11 April 2021:— (1) Wellcome, Basement, 45–53 Austin Road, Yau Tsim Mong, Kowloon, Hong Kong; (2) Harbour City (only the shopping mall is included), 3–27 Canton Road, Yau Tsim Mong, Kowloon, Hong Kong; (c) any person who had been present at Hung Lok Seafood Restaurant, G/F, 13B Pak She Praya Road, , New Territories, Hong Kong in any capacity (including but not limited to full-time, part-time and relief staff and visitors) at any time on 14 April 2021; (d) any person who had been present on the following premises in any capacity (including but not limited to full-time, part-time and relief staff, passengers and visitors) at any time on 14 April 2021:— (1) Central Pier No. 5, Central, Hong Kong; (2) Cheung Chau Ferry Pier, New Territories, Hong Kong; (e) any person who had taken any of the ferries running on the route between Central and Cheung Chau operated by Services Company Limited in any capacity (including but not limited to full-time, part-time and relief staff, passengers and visitors) on 14 April 2021; (f) any lodger who had checked out from Ramada Hong Kong Grand, 23 Austin Avenue, Yau Tsim Mong, Kowloon, Hong Kong at any time during the period from 9 April to 17 April 2021; (g) any person who had been present at The Centrium, 60 Wyndham Street, Central, Hong Kong in any capacity (including but not limited to full-time, part-time and relief staff and visitors) at any time during the period from 29 March to 18 April 2021; (h) any person who had been present at Ramada Hong Kong Harbour View, 239 Queen’s Road West, Sai Ying Pun, Hong Kong in any capacity (including but not limited to full-time, part-time and relief staff and visitors) at any time during the period from 27 March to 23 April 2021; (i) any person who had been present on the following premises in any capacity (including but not limited to full-time, part-time and relief staff and visitors) at any time on 19 April 2021:— (1) Melbourne Plaza, 33–33A Queen’s Road Central & 6–16 Chiu Lung Street, Central, Hong Kong; (2) Immigration Tower, 7 Gloucester Road, Wan Chai, Hong Kong; (3) Kam On Building, 176A–176F Queen’s Road Central & 129–133 Wellington Street, Central, Hong Kong; (j) any person who had been present at Hin Ming Court, 6 Chiu Shun Road, Tseung Kwan O, New Territories, Hong Kong in any capacity (including but not limited to residents, visitors and workers) for more than 2 hours at any time during the period from 10 April to 23 April 2021; (k) any person who had been present at YesStyle.com Limited, 5/F, KC 100, 100 Kwai Cheong Road, Kwai Chung, New Territories, Hong Kong in any capacity (including but not limited to full-time, part-time and relief staff and visitors) for more than 2 hours at any time during the period from 10 April to 23 April 2021; (l) any person who had been present at Physical, Shop W201–W202, 2/F, West Wing, TKO Gateway, 2 Sheung Ning Road, Tseung Kwan O, New Territories, Hong Kong at any time during the period from 10 April to 23 April 2021; (m) any person who had been present on the following premises in any capacity (including but not limited to full-time, part-time and relief staff, students and visitors) for more than 2 hours at any time during the period from 10 April to 23 April 2021:— (1) Shatin Tsung Tsin School, Lek Yuen Estate, Shatin, New Territories, Hong Kong; (2) TWGHs Kwan Fong Kai Chi School, 28 Nam Shan Chuen Road, Shek Kip Mei, Kowloon, Hong Kong; (3) Boarding Section of TWGHs Kwan Fong Kai Chi School, G/F, Pak Yuen House of Chuk Yuen (North) Estate, Wong Tai Sin, Kowloon, Hong Kong; (4) Cannan Kindergarten (Whampoa Garden)/Cannan Nursery (Whampoa Garden), G/F, Banyan Mansions, Site 10, Whampoa Garden, Hung Hom, Kowloon, Hong Kong; (5) The Salvation Army Wo Che Nursery School, No. 101–114, G/F, Tak Wo House of Wo Che Estate, Sha Tin, New Territories, Hong Kong; (6) Academy Kindergarten (Tin Shui Wai), G/F, Ancillary Facilities Block, Tin Chung Court, Tin Shui Wai, New Territories, Hong Kong; (7) Tivoli Anglo-Chinese Kindergarten, G/F, Block 4, Tivoli Garden, 75 Tsing King Road, Tsing Yi, New Territories, Hong Kong; (8) TWGHs Tsui Tsin Tong Kindergarten, G/F, Block 6, Tin Hee House of Tin Ping Estate, Sheung Shui, New Territories, Hong Kong; Requirements and Procedure for the Test (II) require every person who falls within the above category [Note 1] to undergo a polymerase chain reaction-based nucleic acid test for the coronavirus disease 2019 (the Specified Test) in compliance with the requirements and procedure set out below:— (a) for a test at mobile specimen collection stations:— (i) attend one of the mobile specimen collection stations [Note 2] set up by the Government on or before 26 April 2021; (ii) undergo the Specified Test, including providing a sample, in accordance with the instructions given by the staff at the stations; and (iii) keep the SMS (mobile phone text message) notification containing the result of the test, and provide the relevant SMS notification for checking by a prescribed officer when the prescribed officer requires the person to provide information about his or her undergoing the Specified Test; OR (b) for a test at Community Testing Centres:— (i) attend one of the Community Testing Centres [Note 3] set up by the Government on or before 26 April 2021 during its opening hours; (ii) undergo the Specified Test, including providing a sample, in accordance with the instructions given by the staff at the centre; and (iii) keep the SMS (mobile phone text message) notification containing the result of the test, and provide the relevant SMS notification for checking by a prescribed officer when the prescribed officer requires the person to provide information about his or her undergoing the Specified Test; OR (c) for a test with a specimen bottle obtained:— (i) obtain a specimen bottle from one of the 121 post offices, 47 general out-patient clinics of the Hospital Authority or vending machines set up at 20 MTR stations [Note 4]; (ii) collect deep throat saliva sample in the specimen bottle as per the guidelines provided together with the specimen bottle; (iii) return, by 26 April 2021, the specimen bottle with the sample to one of the designated collection points [Note 4]; and (iv) keep the SMS (mobile phone text message) notification containing the result of the test, and provide the relevant SMS notification for checking by a prescribed officer when the prescribed officer requires the person to provide information about his or her undergoing the Specified Test; OR (d) for a test using a specimen bottle distributed to the buildings specified in Part (I) above by the Centre for Health Protection (CHP) (if applicable):— (i) obtain a specimen bottle from the CHP; (ii) collect relevant sample in the aforesaid specimen bottle as per the guidelines in the specimen collection pack; (iii) for a person who falls within the category specified in Parts (I)(a) to (I)(m)(3) above, return, by 26 April 2021, the specimen bottle with the sample to one of the designated collection points [Note 4]; for a person who falls within the category specified in Parts (I)(m)(4) to (I)(m)(8) above, return, by 28 April 2021, the specimen bottle with the sample to one of the designated collection points [Note 4]; and (iv) keep the SMS (mobile phone text message) notification containing the result of the test, and provide the relevant SMS notification for checking by a prescribed officer when the prescribed officer requires the person to provide information about his or her undergoing the Specified Test; OR (e) for a test at general out-patient clinics of the Hospital Authority:— (i) undergo, by 26 April 2021, the Specified Test at general out-patient clinics of the Hospital Authority as instructed by a medical professional of the Hospital Authority; and (ii) keep the SMS (mobile phone text message) notification containing the result of the test, and provide the relevant SMS notification for checking by a prescribed officer when the prescribed officer requires the person to provide information about his or her undergoing the Specified Test; OR (f) for a self-arranged test:— (i) arrange for the carrying out of the Specified Test at a laboratory which is included in a list of recognised laboratories for the Specified Test published at the coronavirus disease 2019 thematic website on https://www.coronavirus.gov.hk/pdf/List_of_recognised_laboratories_RTPCR.pdf and which can issue SMS (mobile phone text message) notifications in respect of test results; (ii) undergo, by 26 April 2021, the Specified Test in accordance with the instructions given by the staff of the laboratory; and (iii) keep the SMS (mobile phone text message) notification containing the result of the test, and provide the relevant SMS notification for checking by a prescribed officer when the prescribed officer requires the person to provide information about his or her undergoing the Specified Test; (III) require every person who falls within the above category to take appropriate personal disease prevention measures as far as reasonably practicable, including wearing a mask and maintaining hand hygiene; and unless for the purpose of undergoing the Specified Test, stay at his/her place of residence and avoid going out until the test result is ascertained as far as possible; Period Specified for the Purpose of Section 14(3)(b) of the Regulation (IV) specify in relation to the category of persons in Parts (I)(a) to (I)(m)(3) above the 30-day period from 27 April to 26 May 2021; and specify only in relation to the persons in Parts (I)(m)(4) to (I)(m)(8) above who had undergone the Specified Test in accordance with the requirements and procedure as specified in Part (II)(d) above the 30-day period from 29 April to 28 May 2021 as the period during which a Compulsory Testing Order may be issued under the Regulation upon non-compliance with this Notice; Appointment of Prescribed Officers (V) appoint members of the Auxiliary Medical Service and all public officers of the Government of the Hong Kong Special Administrative Region to perform a function under the Regulation concerning a requirement specified under this Notice [Note 5]. Note 1:— If a person who falls within the category specified in Parts (I)(j) and (I)(m) above has previously undergone the Specified Test during the period from 21 April to 23 April 2021, he/she would be taken to have complied with the requirements set out in this Notice regardless of whether or not the test was conducted for complying with this Notice. The aforesaid arrangement does not apply to a person who falls within the category specified in Parts (I)(a) to (I)(i). Note 2:— The location, opening hours and target groups (if applicable) of the mobile specimen collection stations are set out in https://www.coronavirus.gov.hk/eng/early-testing.html. Note 3:— The location and opening hours of the Community Testing Centres are set out in https://www.communitytest.gov.hk/en/. Note 4:— The location and opening hours of post offices, general out-patient clinics and MTR stations distributing specimen bottles as well as the specimen collection location and time are set out in https://www.coronavirus.gov.hk/eng/early-testing.html. Note 5:— Under the Regulation, health officers may, without the need of an appointment, perform a function concerning a requirement under a Compulsory Testing Notice.
