Bradford De Long NBER and Harvard University Andrei Shleifer Harvard University and NBER March 1992; revised December 1992 Abstract As measured by the pace of city growth in western Europe from 1000 to 1800, absolutist monarchs stunted the growth of commerce and industry. A region ruled by an absolutist prince saw its total urban population shrink by one hundred thousand people per century relative to a region without absolutist government. This might be explained by higher rates of taxation under revenue-maximizing absolutist governments than under non- absolutist governments, which care more about general economic prosperity and less about State revenue. *We thank Alberto Alesina, Marco Becht, Claudia Goldin, Carol Heim, Larry Katz, Paul Krugman, Michael Kremer, Robert Putnam, and Robert Waldmann for helpful discussions. Introduction One of the oldest themes in economics is the incompatibility of despotism and development. Economies in which security of property is lacking—either because of the possibility of arrest, ruin, or execution at the command of the ruling prince, or the possibility of ruinous taxation— should, according to economists, see relative stagnation. The Territorial Clause of the Constitution authorizes the Congress to “make all needful Rules and Regulations respecting the Territory or other Property” of the United States.2 Relying on the Territorial Clause, the Congress has enacted legislation making some provisions of the Constitution explicitly applicable in the insular areas. In addition to this congressional action, courts from time to time have ruled on the application of constitutional provisions to one or more of the insular areas. You asked us to update our 1991 report to you on the applicability of provisions of the Constitution to five insular areas: Puerto Rico, the Virgin Islands, the Commonwealth of the Northern Mariana Islands (the CNMI), American Samoa, and Guam. You asked specifically about significant judicial and legislative developments concerning the political or tax status of these areas, as well as court decisions since our earlier report involving the applicability of constitutional provisions to these areas. A REPORT ON INDIAN TOWNSHIP PASSAMAQUODDY TRIBAL LANDS IN THE VICINITY OF PRINCETON, MAINE Anthony J. Kaliss 1971 Introduction to 1971 Printing Over two years have passed since I completed the research work for this report and during those years first one thing and ttan another prevented its final completion and printing. The main credit for the final preparation and printing goes to the Division of Indian Services of the Catholic Diocese of Portland and the American Civil Liberities Union of Maine. The Dioscese provided general assistance from its office staff headed by Louis Doyle and particular thanks is due to Erline Paul of Indian Island who did a really excellent job of typing more than 50 stencils of title abstracts, by their nature a real nuisance to type. The American Civil Liberities Union contrib uted greatly by undertaking to print the report Xtfhich will come to some 130 pages. Finally another excellent typist must be thanked and that is Edward Hinckley former Commissioner of Indian Affairs who also did up some 50 stencils It is my feeling that this report is more timely than ever. The Indian land problems have still not been resolved, but more and more concern is being expressed by Indians and non-Indians that something be done. Hopefully the appearance of this report at this time will help lead to some definite action whether in or out of the courts. Further research on Indian lands and trust funds remains to be done. The material, I believe, is available and it is my hope that this report will stimulate someone to undertake the necessary work. -

Anisman policy fellow at the Rockefeller Institute of Government 2 Is It Time for New York State to Revise Its Village Incorporation Laws? Over the past several years, New York State has taken considerable steps to eliminate or reduce the number of local governments — streamlining the law to make it easier for citizens to undertake the process as well as providing financial incentives for communities that undertake consolidations and shared services. Since 2010, the residents of 42 villages have voted on the question of whether to dissolve their village government. This average of 4.7 dissolution votes per year is an increase over the .79 a-year-average in the years 1972-2010.1 The growing number of villages considering dissolution is attributable to the combined influence of declining populations, growing property tax burdens, and the passage of the New N.Y. Government Reorganization and Citizen Empowerment Act (herein after the Empowerment Act), effective in March 2019, which revised procedures to make it easier for citizens to place dissolution and consolidation on the ballot. While the number of communities considering and voting on dissolution has increased, the rate at which dissolutions have been approved by the voters has declined. That is, 60 percent of proposed village dissolutions bought under the provisions of the Empowerment Act have been rejected at referendum (see Dissolving Village Government in New York State: A Symbol of a Community in Decline or Government Modernization?)2 While the Empowerment Act revised the processes for citizen-initiated dissolutions and consolidations, it left the provisions for the incorporation of new villages unchanged. -
