Sydney: Australia’s National Research Organisation for Women’s Safety Foreword In the past decade there has been unprecedented national action on the prevention and response to violence against women in Australia.1 This national action gained momentum in 2015, when Rosie Batty was named Australian of the Year. The award recognised Rosie’s courageous and effective advocacy for change following the death of her son, Luke, who was killed by his father, Rosie’s former partner. Rosie’s advocacy was a catalyst for broad-based local community action. Many Australians not otherwise connected to policy or practice responding to domestic and family violence began asking “what can we do?”. In late 2015 the Australian Government’s Department of Social Services (DSS) established the Building Safe Communities for Women and their Children (BSCW) program to capitalise on this community engagement opportunity. DSS provided establishment funds for communities across the country to develop and implement practical solutions to reduce violence against women and their children. Funded projects were required to implement an action research approach, with support from ANROWS, to build their initiatives on an evidence base and to share their learnings with other communities. This compendium of stories from the field complements the Action Research Support Initiative report, Evidence to action and local action as evidence: Findings from the Building Safe Communities for Women and their Children Action Research Support Initiative (Orr, Backhouse, & La, 2018) and is best read in conjunction with that report. ANROWS was honoured to have the opportunity to work with the BSCW projects across Australia in the development and implementation of the action research components of the projects. We thank DSS for funding the establishment of the BSCW projects and the ANROWS Action Research Support Initiative, and we wish the projects continued success with the support of their local communities. Preparing the stories required workers to extend their knowledge and skills. Practice research is seldom factored into the “doing” of everyday work but in the Building Safe Communities for Women and their Children (BSCW) projects, an action research approach assisted workers to record and share what their projects did, what they learned, and what they see as the challenges to building safe communities for women and their children. Project stories in this compendium were written in a spirit of collaboration so that other community-based projects might learn from, and then build upon, the local knowledge and practice shared in the stories. We thank all storytellers and their organisations for their commitment to the projects, for their time and dedication to see the projects through to completion, and for sharing their stories here.     2018 Harming Women with Words 939 HARMING WOMEN WITH WORDS: THE FAILURE OF AUSTRALIAN LAW TO PROHIBIT GENDERED HATE SPEECH TANYA D’SOUZA,* LAURA GRIFFIN,** NICOLE SHACKLETON*** AND DANIELLE WALT**** In Australia, gendered hate speech against women is so pervasive and insidious that it is a normalised feature of everyday public discourse. It is often aimed at silencing women, and hindering their ability to participate effectively in civil society. As governmental bodies have recognised, sexist and misogynist language perpetuates gender-based violence by contributing to strict gender norms and constructing women as legitimate objects of hostility. Thus, gendered hate speech, like other forms of hate speech, produces a range of harms which ripple out beyond the targeted individual. The harmful nature of vilification is recognised by the various Australian laws which prohibit or address other forms of hate speech. But as we map out in this article, gendered hate speech is glaringly absent from most of this legislation. We argue that by failing to address gendered hate speech, Australian law permits the marginalisation of women and girls, and actively exacerbates their vulnerability to exclusion and gender-based harm. I INTRODUCTION Since the shock victory of Donald Trump in the 2016 United States presidential election, western nations like Australia have witnessed a renewal of grassroots feminist activism, as movements such as #MeToo1 and #TimesUp2 continue to unfold across social media platforms and other public spaces. Although the cause(s) for this phenomenon are difficult to determine, research increasingly shows that environmental factors play a greater role than genetics/biology in producing this anomaly (D. Freeman and J. Freeman 2013). Current psychological models of mental illness, however, tend to negate social and political aspects of experience by depicting anxiety as a naturally occurring pathology within women (Ussher 2010). This thesis seeks to critically interrogate and re-create constructions of mental illness by examining how our conceptions of female anxiety have been shaped by negative images in psychiatric discourse and liberal political theory. I analyze hysteria as a precursor to anxiety to show how the age-old association between femininity and madness continues to influence prevailing attitudes around gender. To challenge these negative depictions, I reconceptualize anxiety as a natural response to power, in particular, patriarchal relationships. Further, I contend that while anxiety can be debilitating, it is also the source of a significant contribution to diverse and oftentimes empathetic voices.

These last 20 years have seen great changes for women in the legal profession, however, there is still much to be done to achieve gender equality. In selecting what to feature in this issue, we relied on a key theme underpinning the history of VWL and Portia: diversity. We have republished a selection of past Portia articles that examine gender and cultural diversity in the profession and how diversity affects access to the law. They remain as relevant today as they did in their original year of publication. The artwork that accompanies the republished articles, Moving Landscape (oil on canvas, ten panels each 1000 x 760mm), is the work of Fern Smith. The series is a representation of the women of Victoria and the history of their struggle for equality over the 20th century. The suffragists’ colours of white, green and violet inspired the artist’s palette, with ‘W.G.V’ prominent on the first panel: ‘Women Get Vote’. The women depicted in the background of the work are the first women to enter Victorian Parliament: Lady Milly Peacock, Ivy Weber, Dorothy Goble, Paulina Toner, Joan Chambers, Gracia Baylor, Joan Coxsedge, and Joan Kirner. Fern Smith’s reinterpretations of the work of artists Dorothea Black, Ethel Spowers, Joy Hester, Mirka Mora, Janet Dawson, and Angela Brennan are also woven into the panels.
