Tammy Baldwin Previously Paid Elias $90,000 to Quell Tomah Scandal The Free Beacon: "Baldwin tapped Marc Elias, a partner at the D.C.-based Perkins Coie law firm, to help with crisis control on the scandal. Elias is considered the "go-to fixer" for Democrats and was behind Soros- backed lawsuits against voter identification laws in numerous states leading up to the 2016 presidential election, including a lawsuit in Wisconsin. Elias was serving as Hillary Clinton's top campaign lawyer at the time he was brought in to help Baldwin. Perkins Coie, which has been on Baldwin's campaign payroll since 2011, was paid $87,779 by the senator's campaign committee for the services Elias provided in weathering the Tomah VA scandal, filings show. Perkins Coie was given a combined $50,994 the five other years that they appear on Baldwin's campaign payroll. Representative Nunes’s overt involvement with the highly-publicized lawsuits threatens to establish a precedent that the Legal Expense Fund (“LEF”) regulations no longer apply to Members. Although Representative Nunes is entitled to legal representation and he may pursue any legal action to protect and defend his interests, he must comply with House rules. An OCE investigation will preserve Representative Nunes’s legal right to counsel while upholding well-established House rules and precedent.     Facing the Coordination Reality: Removing Individual and Party Limits on Contributions to Presidential Campaigns BY ZACHARY MORRISON* Since Citizens United, a new era of campaigning has emerged in which traditional campaign functions have been outsourced to candidate-centric outside groups. In the 2016 presidential election, ten campaigns had raised less money than their allied Super PACs and other outside groups. Federal election regulations that restrict coordination between these outside groups and campaigns are outdated and poorly enforced. American democracy is weakened by this unprecedented electoral activity because of decreased donor transparency, increased negativity without accountability, and voter confusion. This Note concludes, after examining outside group political activity in the 2012 and 2016 presidential cycles, that candidate-centric outside groups create the same risk of corruption as direct contributions to campaigns. Therefore, this Note proposes that proponents of stricter campaign finance regulation should consider removing limits on individual and political party contributions to presidential campaigns. Allowing individuals and parties to provide unlimited funds to campaigns would diminish the appeal of outside groups and increase the political pressure on campaigns to disavow their use.     Mediation and Post-Election Litigation: A Way Forward REBECCA GREEN* I. INTRODUCTION Most who have looked at the use of alternative dispute resolution (ADR) in election disputes have concluded that ADR is not appropriate in the election context, particularly in post-election disputes. This article challenges that orthodoxy and suggests that ADR, specifically mediation, can play a useful role when elections go awry. As someone who teaches both ADR and Election Law, I like to point out to my students the natural link between these two disciplines-elections, after all, are a form of dispute resolution. So it seems almost cannibalistic to ask the question of how ADR might inform election law. Not only that, but as discussed in different ways at the Symposium underlying this volume, election disputes do not fit well with many of the theories that animate ADR scholarship. Elections are inherently binary. Elections are the zero-sum game that any admirer of Getting to Yes' abhors. In an election, there is no way to split the pie any differently, no way to "create value." 2 Democracy demands a winner and a loser. There is nothing in elections Beyond Winning.3 This article explores what the ADR field can contribute to resolving disputes in elections based on the premise that although elections themselves are binary, the many disputes that can arise during the election process reveal a more nuanced picture.
