Boris Tadic was reelected president in February 2008. In May 2008 voters elected a new parliament in which some minority ethnic parties won seats. Observers considered both elections to be mostly in line with international standards. Civilian authorities generally maintained effective control of the security forces. The following human rights problems were reported: physical mistreatment of detainees by police; police corruption; inefficient and lengthy trials; harassment of journalists, human rights advocates, and others critical of the government; limitations on freedom of speech and religion; large numbers of internally displaced persons (IDPs); corruption in legislative, executive, and judicial branches of government; government failure to apprehend the two remaining fugitive war crimes suspects under indictment of the International Criminal Tribunal for the former Yugoslavia (ICTY); societal violence against women and children; societal intolerance and discrimination against minorities, particularly Roma and the lesbian, gay, bisexual, transgender (LGBT) population; and trafficking in persons.     31st SESSION Strasbourg, 19-21 October 2016 CG31(2016)21 19 October 2016 Information report on the observation of local and provincial elections in Serbia (24 April 2016) Monitoring Committee Rapporteur1: Karim VAN OVERMEIRE, Belgium (R, NR) Summary Further to an invitation by the Republic Electoral Commission of Serbia, the Congress’ Bureau decided to deploy a limited Electoral Assessment Mission in order to monitor the local and provincial elections organised on 24 April 2016. The early Parliamentary elections held on the same day in Serbia were observed by the Parliamentary Assembly of the Council of Europe. The present information report reflects the key findings of the 12-member delegation based on in- depth briefings in Belgrade and Novi Sad prior to the E-Day and on observations made by six Congress teams in more than 120 polling stations throughout the country, with a special attention to the organisation of the regional elections in the Autonomous Province of Vojvodina and the vote organised for the Municipal Councils. Apart from isolated irregularities, the elections were carried out in a calm and orderly manner, largely in line with European electoral standards. However, the Congress’ delegation found that there was room for improvement of the practical side of the elections, notably regarding the protection of the secrecy of the vote and the level of professionalism of the electoral administration. In particular, the extended composition of polling boards led to difficulties in managing different aspects of the electoral process including the vote count. At the same time, the Congress supports a genuine reform in order to complement the legal framework of elections focusing on issues such as party and campaign financing, misuse of administrative resources, the quality of the voters’ lists, candidates’ registration and the minority status of political parties.

    DEFAMATION AS A “WEAPON” IN EUROPE AND IN SERBIA: LEGAL AND SELF- REGULATORY FRAMEWORKS Jelena Surculija Milojevic* This article examines the legal framework for defamation in Europe and in the Republic of Serbia. It offers a possible definition of the term “weaponized defamation.” In the first part, regional organizations, such as the Council of Europe and European Union, are analyzed to identify their legal framework for defamation. This Article focuses on the legal system of the Republic of Serbia, examined from two points of view - that of media legislation and that of the Journalist’s Code of Ethics, as a self-regulatory framework. The following section of the article focuses on the decriminalization of defamation in Europe at the end of the 20th and beginning of the 21st century. The paper shows that there are countries where defamation is not a criminal offence anymore, while in some countries defamation still poses a criminal threat to journalists. The case law of Serbia at the European Court of Human Rights relevant for defamatory statements (Article 10 (2)) and its positions on them are looked at next, after decisions were made by the European Court of Human Rights. This article will illustrate the misunderstanding of the term “defamation” and the frequent lack of understanding of the differing levels of protection for the honor and reputation of a “public figure” in comparison to that of an individual. The final part of the research focuses on several case studies that may fall into the “weaponized defamation” category as well as the consequences such offenses could have on its victims.

    NEDELJNE ANALIZE I PROGNOZE THE DEFENCE AND LAST DAYS Conflict at the head of the Democratic Party ( DS ) between the President of the party Boris Tadi ć and his deputy and popular Mayor of Belgrade Dragan Djilas has lasted since this party lost the elections held in May this year. The conflict escalated during the last week by the exchange of public accusations between the two leading people of the party. Thus was revealed the fact that between Boris Tadi ć and Djilas does not exist any communication and that they have completely different visions of the party’s future. The experts in knowing the situation in the Democratic Party reveal that problems between the leading people in the Democratic Party have started a few years earlier, since the moment when Djilas as the Mayor of Belgrade according to the research of the public opinion has become more popular than Tadi ć who was at the time the President of Serbia. That is exactly why, during the pre-electoral campaign for the May elections, it was more important to Tadi ć that Djilas and the list of the Democratic Party for the Assembly of the city of Belgrade did not gain even one more vote than he would gain as the candidate for the President of the Republic than how many votes he was going to gain in total?! And when it becomes more important where the votes are gained instead of thinking of the fact that every vote enables general success of the party and its candidates – the consequence is the defeat.
