1. EXISTING ROADS

See attached topographic map A.

To reach NGC Well #41-8-H, proceed west from Myton, Utah along U.S. Highway 40 for 1.5 miles to its junction with Highway 53. Proceed south on Highway 53 for 2 miles to its junction with County Road #216. Follow County Road #216 for 10 miles and then take the Sand Wash Road to the right. Follow

this road for .8 miles and the road will fork. Take the road to the right.

Follow this road .3 miles and the proposed road will start at this point.

2. PLANNED ACCESS ROAD

See attached topographic map B.

The proposed road will be 500' long. No off-lease right-of-ways will be required. The access road will be constructed to the following standards:

1) Width - The running surface will be 18 feet and the total disturbance width including the ditches will not exceed 30 feet. 2) Maximum grade - 3%.

3) Turnouts - None.

4) Drainage designs - Ditches will be constructed on each side of the road, V-shaped, 1 foot deep at 3:1 slopes.

5) Location and size of cuiverts, major cuts and fills - None.

6) Surfacing materials - None.

7) Gates, cattleguards, or fence cuts - None. 8) The proposed road has been flagged.

3. LOCATION OF EXISTING WELLS

The following wells are located within a one mile radius of the location site.

1) Water wells - None.

2) Abandoned wells - None.

3) Temporarily abandoned wells - None.

4) Disposal wells - None.

5) Drilling wells - None.

4. LOCATION OF EXISTING AND/OR PROPOSED FACILITIES

A. (1) Tank batteries - A tank battery will be built on the location.

(2) Production facilities - None.

(3) Oil gathering lines - No lines will be constructed as the oil will be hauled by trucks.

(4) Gas gathering lines - None.

B. (1) In the event production is established, all petroleum production facilities are to be contained within the proposed location site. In the event that production of oil from this well is established, a berm will be constructed around the tank battery large enough to contain the contents of tanks. (2) Construction methods and materials - Production facilities will be placed on the proposed pad. Construction materials will come from the unused portion of the pad. (3) Livestock and wildlife protection - The evaporation pond will be fenced on all .four sides and overhead wire with flagging installed, if there .is oil in the pit.

C. The rehabilitation of disturbed areas no longer required for the production of this well will be completed by backfilling, recontouring, topsoiling and seeding.

5. LOCATION AND TYPE OF WATER SUPPLY

See attached topographic map A. Water will be obtained from the Upper Pleasant Valley Canal in Section 33, T.4S., R.2W., or at the Clark Roberts Ranch in Section 21, T.8S., R.17E. Agreements have been made with both in the past. The location will depend on the availability of water at the time the well is drilled.

6. SOURCE OF CONSTRUCTION METHODS

All construction materials for this location site and access road will be borrow materials, accumulated during construction of the location site. No additional road gravels or pit lining material from other sources are anticipated at this time, but if they are required, the appropriate actions will be taken to acquire them from private sources.

7. METHODS FOR HANDLING WASTE DISPOSAL

1) Cuttings, drilling fluids and produced fluids - A reserve pit will be constructed. The reserve pit will be approximately 10' deep and at least one-half of this depth shall be below the surface of the existing & Q

One half of the reserve pit will be used as a fresh water storage area during the drilling of this well and the other one-half will be used to store nonflammable materials such as cutting, salts, drilling fluids, chemicals, produced fluids, etc.

Prior to the onset of drilling, a "stock tight" fence shall be installed on three sides of the reserve pit. This fence will be either (1) woven wire at least 28 inches high and within four inches of ground surface with two strands of barbed wire above the woven wire with 10-inch spacing, or (2) at least five strands of barbed wire spaced, starting from the ground, at approximately 6-, 8-, 10-, 12-, and 12-inch intervals. At the completion of drilling operations, the fourth side of the reserve pit will be fenced and allowed to dry completely before the pit is backfilled. If there is oil on the pits, overhead wire and flagging will be installed on the pits.

If deemed necessary by the agencies concerned to prevent contamination to surrounding areas, the reserve pit will be lined with a gel.

2) Sewage - A portable chemical toilet will be supplied for human waste.

3) Garbage - Trash cages will be on all locations and all trash will be removed to an authorized landfill.

4) Site Clean-up - Immediately after the rig is moved out, the area around the well site will be cleaned and all refuse placed in the burn pit.

8. ANCILLARY FACILITIES

There are no ancillary facilities planned for at the present time and none foreseen in the near future.

9. WELL SITE LAYOUT

See typical rig layout.

10. PLANS FOR RESTORATION OF THE SURFACE

Prior to construction of the location, the top six inches of soil material will be stripped and stockpiled. This will amount to approximately 1800 cubic yards of material that will be stockpiled.

If the well is producing, the platform and pit areas no longer required for the production of the well will be backfilled, recontoured, topsoiled and If the well is abandoned, the entire disturbed area (including roads) will be restored by: (1) backfilling; (2) recontouring; (3) topsoiling; (4) seeding. Specifically: the platform highwall(s) and road fill(s) will be eliminated by moving all excavated material back in place. Restoration of the location and access road will begin within 90 days after completion of the well. The BLM representative will be notified prior to starting the rehabilitation operations.

The following seed mixture and methods for seeding will be used: The seed mixture will be determined by the Bureau of Land Management at the time of abandonment.

Seed will be planted after September 1 and prior to ground frost; or seed will be planted after the frost has left and before May 15. All seed will be drilled on the contour at a depth of ¼ to ½ inch. Slopes too steep or rocky for machinery will be broadcast and the seed hand raked into the soil. When broadcasting the seed, the rate per acre will be doubled.

The Lessee further convenants and agrees that all of said clean-up and restoration activities shall be done and performed in a diligent and most workmanlike manner and in strict conformity with the above mentioned Items #7 and #10.

11. OTHER INFORMATION

1) The Vernal District BLM will be contacted by the Operator or dirt contractor forty-eight hours prior to beginning any work on public land. 2) The dirt contractor will be furnished a copy of the approved APD and Surface Use Plan prior to beginning any work on public land. 3) All permanent (on-site for six (6) months duration or longer) structures constructed or installed, including the pumpjack, shall be painted a flat, non-reflective, earthtone color to match Tnemec 23-08351 Mesa Brown Enduratone or an approved equal. All faci,lities shall be painted within six months of when the production facilities are put in place. Facilities that are required to comply with 0.S.H.A. (Occupational Safety and Health Act) are excluded. 4) Construction and maintenance of roads, rehabilitation of disturbed areas, and construction of pipeline routes shall be in accordance with the surface use standards as set forth in the booklet, "Surface Operating Standards for Oil and Gas Exploration and Development".

Supplemental Stipulations

General Outline for the Protection and Isolation of Ground Water and Oil Shale in the Uinta Basin.

The oil shale occurs with varying thicknesses in most parts of the Uinta Basin and at varying depths. Ground water also occurs at varied depths above and below the Oil Shale. These ground waters have varying degrees of salinity. Nonetheless, drilling for hydrocarbon in the Uinta Basin should provide for the protection of the oil shale and the ground water if either is present.

The protection of the oil shale and the ground water can effectively be carried on through the design of an adequate casing and cementing program for each well drilled in the area.

In the Uinta Basin, water occurs mainly in the Uinta and the Green River formations. As drilling for hydrocarbon gets deeper into the crust of the earth, more ground water might be encountered and will be protected as it is encountered.

This notice's purpose is to attempt to lay the groundwork for a casing program and cementing program that will protect the oil shale and the ground water if present.

These programs are to be considered as guidelines. The specificity of casing depth, amount of cement and the depth of staging collars will be considered on an individual basis after a careful study of the logs of each individual well. Cementing from the bottom up is an economical solution if carefully conducted.

The casing and cementing program presented here as an example, will assume that fresh water was encountered in the upper parts of the Green River, that the oil shale -occurs in the middle of the Green River (1000 foot section) and that some ground water is encountered in the lower parts of the Green River.

In this case, three areas will have to be cemented to assure the integrity of the ground water and oil shale; These areas are above the upper fresh water, across the oil shale and below the lower water aquifer. Deep aquifers that do not contain useful water are cemented to prevent water zone influence on production.

The following casing and cementing program will be appropriate for this example:

A. Surface casing is set at approximately 300 feet and cemented to the B. The next casing string will be set at approximately 300 feet below the lowest aquifer. Cementing will be done in three stages, using two stage collars and cement baskets or equivalent as described below and on attached sketches:

1. Cement .first stage through the casing shoe to fill annulus back to base of lower aquifer.

2. Place 1st stage collar (with cement basket immediately below) at a selected point at the base of the oil shale. Cement will have to reach top of oil shale.

3. Place 2nd stage collar (with cement basket immediately below) 50 feet above the top of the Bird's Nest aquifer and cement to at least 300 feet above the stage collar.

C. The above is an example. Reasonable equivalents that accomplish these same protective measures, (such as cementing the water zones instead of isolating them), depending on the individual cases will be considered for approval.

D. When the above mentioned well is to be abandoned, inner-casing plugs will have to be placed at the same depth as the above mentioned annulus cement jobs.

The use of cement bond logs will verify the authenticity of the cement job performed.

E. The Operator of such well should notify U.S.G.S. 48 hours prior to commencement of casing and cementing activity, so a technician could be dispatched to witness the operations to verify compliance with casing and cementing program.

Operator advises that due to contractual problems with pipeline companies and FERC, 15 of our Pleasant Valley wells began venting gas September 26, 1986. At that time we began testing to determine the amount of gas being vented at each well.

We are presently unable to sell our casinghead gas from the wells listed below because of problems with Amsel's gathering system that are preventing it from operating. As a result we are having to vent gas from these wells and they were recently tested at the following volumes:

The Newfield Production Company's request to convert the former Green River Formation oil well NGC 41-8H-9-17 to an enhanced recovery injection well in the Pleasant Valley Unit Area Permit is hereby authorized by the Environmental Protection Agency (EPA) under the terms and conditions of the Authorization For Additional Well.

The addition of the proposed injection well, within the exterior boundary of the Uintah & Ouray Indian Reservation, is being made under the authority of 40 CFR §144.33(c) and terms of the Pleasant Valley Unit Area, Permit No. UT20771-00000, and subsequent modifications.

Please be aware that Newfield does not have authorization to begin injection operations into the well until all Prior to Commencing Injection requirements have been submitted and evaluated by the EPA, and has received written authorization from the Dírector to begin injection. Please note that the Permit limits injection to the gross interval within the Green River Formation between the depths of 3622 feet and the top of the Wasatch Formation at 6005 feet.

Prior to receiving authorization to inject, the EPA requires that Newfield submit for review and approval: (1) the results of a Part 1 (Internal) mechanical integrity test (MIT),.(2) a pore pressure calculation of the injection interval, (3) and a complete EPA Form No. 7520-12 (Well Rework Record) with a new schematic The initial Maximum Allowable Injection Pressure (MAIP) for the NGC 41-8H-9-17 was determined to be 1315 vsia. UIC Area Permit UT20771-00000 also provides the opportunity for the Permittee to request a change in the MAIP based upon results of a step rate test that demonstrates that the formation breakdown pressure will not be exceeded.

The Pleasant Valley Unit Final UIC Area Permit No.UT20771-00000, effective November 6, 1995, authorizes injection for the purpose of enhanced oil recovery into multiple lenticular sand units which are distributed throughout the lower portion of the Green River Formation. On March 11, 2008, the Permittee provided notice to the Director concerning the following additional enhanced recovery injection well:

Pursuant to 40 CFR §144.33,Area UIC Permit No. UT20771-00000 authorizes the Permittee to construct and operate, convert, or plug and abandon additional enhanced recovery injection wells within the area permit. This well was determined to satisfy additional well criteria required by the permit.

This well is subject to all provisions of UIC Area Permit No. UT20771-00000, as modified and as specified in the Well Specific Requirements detailed below. This Authorization shall expire one year after the Effective Date unless the Permittee has converted the well to injection or submits a written request to extend this Authorization prior to the expiration date.

This Authorization is effective upon signature.

The Federal NGC 31-8H and Pleasant Valley Federal F-9-9-17 wells will be monitored weekly at the surface for evidence of fluid movement out of the injection zone.

In addition, Newfield developed a corrective action monitoring program, effective July 10, 2008, entitled "Procedure related to proposed Class II Enhanced Oil Recovery Injection Wells determined by the EPA to have specific Area of Review (AOR) wells with inadequate cement across the Confining Zone".

If possible fluid movement out of the Injection Zone is identified, either through the weekly monitoring, through Newfield's July 10, 2008 procedure described above, or through any other means, (for example, evidence of fluid flow or increased bradenhead annulus pressure readings, the Permittee will shut in the NGC 41-8H-9-17 well immediately and notify the Director. No injection into the NGC 41-8H-9-17 well will be permitted until the Permittee has notified the Director that the situation has been resolved, submitted Reword Records (EPA Form No.7520- 12) and a schematic diagram, and received authorization from the Director to re-commence injection.

Demonstration of Mechanical Integrity: A successful demonstration of Part I (Internal) Mechanical Integrity using a standard Casing-Tubing pressure test is required for the NGC 41- 8H-9-17 prior to injection and at least once every five years thereafter.

If after the CBL is run in the NGC 41-8H-9-17 there is insufficient 80% cement bond over the

Confining Zone (3585 feet - 3622 feet); pursuant to 40 CFR 146.8(a)(2), the Permittee shall conduct a Part II (External) Mechanical Integrity Test within a 180-day period of "Limited Authorization to Inject". A Part II (External) Mechanical Integrity Test shall be run at least once every five (5) years thereafter.

Page 3 of Demonstration of Financial Responsibility: The applicant has demonstrated financial responsibility by an Annual Statement that has been approved by the EPA. The Plugging and Abandonment cost has been estimated by the Permittee to be $35,401.

Plugging and Abandonment: The well shall be plugged in a manner that isolates the injection zone and prevents movement of fluids into or between USDWs. Tubing, packers, and any downhole apparatus shall be removed. Class A, C, G, and H cements, with additives such as accelerators and retarders that control or enhance cement properties, may be used for plugs; however, volume extending additives and gel cements are not approved for plug use. Plug placement shall be verified by tagging. Plugging gel of at least 9.2 lb/gal shall be placed between all plugs. A minimum 50 ft. surface plug shall be set inside and outside of the surface casing to seal pathways for fluid migration into the subsurface. Within sixty (60) days after plugging the owner or operator shall submit Plugging Record (EPA Form 7520-13) to the Director. The Plugging Record must be certified as accurate and complete by the person responsible for the plugging operation. At a minimum, the following plugs are required:

PLUG NO. 1: Set a cast iron bridge plug (CIBP) no more than 50 feet above the top perforation with a minimum 20 foot cement plug on top of the CIBP.

PLUG NO. 2: Squeeze a cement plug on the backside of the 5-1/2" casing across the Trona and the Mahogany Bench zone between approximately 2793 ft. (KB) to 2945 ft. (KB). If pre-existing backside cement precludes cement- squeezing this interval then a minimum 152 foot balanced cement plug shall be placed inside the 5-1/2" casing from approximately 2793 ft. (KB) to 2945 ft. (KB).

PLUG NO. 3: Squeeze a cement plug on the backside of the 5-1/2" casing across the top of the Green River Formation between approximately 1360 ft. (KB) and 1460 ft. (KB). If pre-existing backside cement preludes cement-squeezing this interval then a minimum 100 foot plug shall be placed inside the 5-1/2 casing from approximately 1360 ft. (KB) to 1460 ft (KB).

PLUG NO. 4: Set a Class "G" cement plug within the 5-1/2" casing to 335 ft. and up the 5-1/2" x 8-5/8"casing annulus to the surface.

Cut off surface and 5-1/2" casing at least 4 ft below ground level and set P&A marker; submit Sundry Notices and all necessary data as required by the EPA and other regulatory agencies.

Page 4 of Reporting of Noncompliance: (a) Anticipated Noncompliance. The operator shall give advance notice to the Director of any planned changes in the permitted facility or activity which may result in noncompliance with permit requirements.

(b) Compliance Schedules. Reports of compliance or noncompliance with, or any progress on, interim and final requirements contained in any compliance schedule of this Permit shall be submitted no later than thirty (30) days following each schedule date.

(c) Written Notice of any noncompliance which may endanger health or the environment shall be reported to the Director within five (5) days of the time the operator becomes aware of the noncompliance. The written notice shall contain a description of the noncompliance and its cause; the period of noncompliance including dates and times; if the noncompliance has not been corrected the anticipated time it is expected to continue; and steps taken or planned to prevent or reduce recurrence of the noncompliance.

Twenty-Four Hour Noncompliance Reporting: The operator shall report to the Director any noncompliance which may endanger health or environment. Information shall be provided, either orally or by leaving a message, within twenty-four (24) hours from the time the operator becomes aware of the circumstances by telephoning 1-(800)-227-8917 and asking for the EPA Region 8 UIC Program Compliance and Enforcement Director, or by contacting the Region 8 Emergency Operations Center at (303)-293-1788, if calling from outside EPA Region 8. The following information shall be included in the verbal report: (a) Any monitoring or other information which indicates that any contaminant may cause an endangerment to a USDW. (b) Any noncompliance with a Permit condition or malfunction of the injection system which may cause fluid migration into or between underground sources of drinking water.

Oil Spill and Chemical Release Reporting: The operator shall comply with all other reporting requirements related to oil spills and chemical releases or other potential impacts to human health or the environment by contacting the National Response Center (NRC) 1-(800)-424-8802 or 1-(202)-267-2675, or through the NRC website at http://www.nrc.useg.millindex.htm.

Other Noncompliance: The operator shall report all other instances of noncompliance not otherwise reported at the time monitoring reports are submitted.

Underground Sources of Drinking Water (USDWs): USDWs in the Gilsonite Unit Area Permit generally occur within the Uinta Formation. According to "Base ofModerately Saline " Ground Water in the Uinta Basin, Utah, State of Utah Technical Publication No. 92, the base of moderately saline ground water may be found at approximately 32 feet below ground surface in the NGC 41-8H-9-17 http:NRWRT1.NR.STATE.UT.US: There are no reservoirs, streams, domestic or agricultural water wells within a quarter (1/4) mile of the well.

Composition of Source, Formation, and Injectate Water: (Total Dissolved Solids {TDS):

- TDS of the Douglas Creek Member - Green River Formation Water: 4,358 mg/l.

- TDS of Beluga Facility Injection System source water: 13,555 mg/l.

The injectate is water from the Jonah Facility Injection System blended with produced Green River Formation Water resulting in TDS < 10,000 mg/l.

Aquifer Exemption is being prepared because the total dissolved solids (TDS) of the Green River Formation water is 4358 mg/l is less than 10.000 mg/l in the injection well. Please refer to 40 CFR§l46.4 (Criteria for Exempted Aquifers)

Confining Zone: The Confining Zone, which directly overlies the Garden Gulch Member of the Green River Formation, is approximately thirty-seven (37) feet of shale between the depths of 3585 ft. and 3622 ft. (KB).

Injection Zone: The Injection Zone at this well location is approximate 2383 ft. of mukiple lenticular sand units interbedded with shale, marlstone and limestone from the top of the Garden Gulch Member at 3622 feet (KB) to the top of the Wasatch Formation at 6005 ft. (KB). All formation tops are based on correlations to the Newfield Production Federal #1-26-8-17 (UT20702-04671) Type Log.

Well Construction: There is no CBL for this well. A CBL will be run prior to injection.

Surface Casing: 8-5/8"casing is set at 285 ft. (KB) in a 12-1/4" hole, using 210 sacks Class G cement, circulated to the surface.

Longstring Casing: 5-1/2" casing is set at 6071ft. (KB) in a 7-7/8" hole secured with 772 sacks of cement. Total driller depth 6110 ft. Plugged back total depth is 5915 ft.. Approved Injection Zone: Injection is approved between the top of the Garden Gulch Member of the Green River Formation [3622 feet (KB)] to the top of the Wasatch Formation [6005 feet (KB)].

Maximum Allowable Injection Pressure (MAIP): The initial MAIP is 985 psia, based on the following calculation:

Well Construction and Corrective Action: There currently is no CBL run in the NGC 41-8H- 9-17 therefore the Operator is required to run a CBL to TD so that the cement bond over the Confining Zone can be evaluated prior to beginning injecting.

Tubing and Packer: 2-7/8" or similar size injection tubing is approved; the packer shall be set at a depth no more than 50 feet above the top perforation.

Corrective Action for Wells in Area of Review (AOR): The following five (5) wells, that penetrate the confining zone within or proximate to a 1/4 mile radius around the NGC 41-8H-9-17, were evaluated to determine if any corrective action is necessary to prevent fluid movement into USDW:

RE: Procedure related to proposed Class II Enhanced Oil Recovery Injection Wells determined by the EPA to have specific Area of Review (AOR) wells with inadequate cement across the confining zone

Effective July 10, 2008 Newfield Production Company will implement the following procedure to address concerns related to protection of Underground Sources of Drinking Water (USDW) in AOR wells where the interval of cement bond index across the confining zone behind pipe has been determined to be inadequate. The procedure is intended to meet the corrective action requirements found in the UIC Class II permit, as well as provide data that could be used to detect and prevent fluid movement out of the proposed injection zone.

1) Establish baseline production casing by surface casing annulus pressures prior to water injection in subject well with a calibrated gauge. 2) Record the baseline pressure, report findings to Newfield engineering group and keep on file so it is available upon request 3) Place injection well in service. Run packer integrity and radioactive tracer logs to verify wellbore integrity and determine zones taking water. 4) Construct a geologic cross section showing zones taking water and their geologic equivalent zones in the AOR wells. 5) Submit a report of the packer integrity log, radioactive tracer log, and geologic cross section to to the Newfield engineering staff for review and keep on file so it is available upon request 6) Weekly observations of the site will be made by Newfield during normal well operating activities. Any surface discharge of fluids will be reported immediately. 7) After injection well is placed in service, weekly observations of annulus pressure will be made and compared to baseline pressure and will be recorded once monthly. The recorded pressure information will be kept on file and be available upon request. 8) If pressure increases by more than 10% above baseline at any timein an AOR well with insufficient cement bond, Newfield will run a temperature survey log in subject well. This log, in concert with the geologic crossection, will enable the determinationof water movement in the open hole by production casing annulus through a shift in geothermal gradient. 9) If water movement is determined in annulus, Newfield will shut in the injection well and repair the production casing by open hole annulus or leave the injection well out of UNITED STATES ENVIRONMENTAL PROTECTION AGENCY REGION 8

Newfield Production Company (Newfield) has satisfactorily completed Environmental Protection Agency (EPA) Prior to Comthencing Injection requirements for Final Permit UT20771-08153, effective September 28, 2008. The Part I (Internal) Mechanical Integrity Test (MIT), Well Rework Record (EPA Form No. 7520-12), schematio diagram, and pore pressure, were received on June 30, 2009. In addition, a Sector Bond Log, run on June 15, 2009 and received by EPA on July 17, 2009, was evaluated. The Sector Bond Log showed there to be 37 feet (3,585'-3,622') of 80% or greater cement bond index over the ConfininggBoth the MIT data and Sector Bond Log were approved by EPA on July 20, 2009.

As of the date of this letter, Newfield is authorized to commence injection into NGC 41- 8H-9-17 at a maximum allowable injection pressure (MAIP) of 985 psig. Until such time as the Permittee demonstrates through a Step Rate Test (SRT) that the Fracture Gradierit (FG) is other than 0.680 psilft, NGC 41-8H-9-17 shall be operated at a MAIP no greater than 985 psig.
